About this file

This document is a Justification & Approval for Other Than Full and Open Competition for a Simplified Acquisition over $3,000 and up to $150,000, as required by FAR 13.106-1.

The National Park Service (NPS) is procuring a one-year license for the Patch My PC software, which automates the patching of third-party applications in Microsoft Endpoint Configuration Manager. Patch My PC is a niche add-on product that is the only viable solution to meet NPS's requirements for maintaining software patching, due to its seamless integration with Microsoft's Configuration Manager, which is the core NPS management console. The expected cost of the Patch My PC license is redacted. Market research was conducted, but Patch My PC, LLC is identified as the sole source provider that can meet the integration and reliability requirements. The Justification & Approval document is signed by the IT Specialist/Project Officer, Contracting Officer, and the warranted individual one level above the Contracting Officer.

JUSTIFICATION & APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,000 AND UP TO $150,000 (See FAR 13.106-1)

Date: July, 12th, 2024 PR Number: 40667829

1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost):

Patch MY PC annual license covering period of one year. The expected cost [Redacted]. Patch My PC automates the patching of third-party applications in Microsoft Endpoint Configuration Manager. Patch My PC supports hundreds of third-party applications many of which are used by the National Park Service. Adobe Reader, Chrome, and Amazon Corretto are examples of supported third-party applications used by the National Park Service. Currently NPS is limited in its ability to update third-party applications due to time constraints and limitations in the base Microsoft Endpoint Configuration Manager product. Patch My PC is an add-on to Microsoft Endpoint Configuration Manager that automates the ability to patch multiple software applications in a minimum of time and effort. Patch My PC will enable NPS to more quickly and efficiently update the supported applications used in the Service. Usage of this software will ensure NPS can meet its security goal of staying up to date with software and security updates.

2. Sole Source Justification rationale (Check one and explain below):

X Only one responsible source.

Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met.

Other

Explain:

Patch My PC, LLC is the developer of this product. This product is niche add-on to Microsoft’s Configuration Manager (ConfigMgr) console. This component greatly assists in the ensure the timely, delivery of 3rd party software security updates and patches, reducing time spent on pushing software updates and incompatible patch break-fixing as well as Advance reporting and analytics for ConfigMgr and Microsoft Intune (the next iteration of endpoint management that the department is moving to).

Patch My PC is the only viable solution to meet the requirements for maintaining software patching requirements due to the integration requirements with Microsoft's ConfigMgr, the core NPS management console for remote control, patch management, software distribution and operating system deployment for NPS maintained laptops, desktops and servers.

In order to avoid incompatibility and assure the best value to the government this product meets the following requirements:

Integration with Microsoft ConfigMgr (and eventually Microsoft Intune). Other products would necessitate an undue burden on IT staff to integrate, deploy and reconfigure existing systems causing delays in deploying patches in timely manner.

Reliable interfacing with existing automated workflows to effectively deploy patches timely to meet FITARA (Federal Information Technology Acquisition Reform Act) and other IT security compliance regulations.

3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received, or anyone expressed interest:

Market research was conducted as there are a few developers of products in this niche market. Two small business vendors were identified as potentially interested in this procurement.
