Control No. 2018-WHS-0011
SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES
FOR CERTAIN COMMERCIAL ITEMS
UNDER FEDERAL ACQUISITION REGULATION (FAR) 13.5
1. AGENCY AND CONTRACTING ACTIVITY: The Department of Defense, Washington Headquarters Services, Acquisition Directorate Federal Facilities Division, Defense Post Office
2. DESCRIPTION OF ACTION: Mobile computers are used with Bear Tracks mobile application by staff to record/track the flow of material throughout the Pentagon and the National Capital Region (NCR). WHS currently uses Zebra MC55’s and MC70’s running Windows 6.5. Windows 6.5 is nearing the end of its lifecycle and will no longer be supported by Microsoft. In order to continue operation WHS will need to procure new mobile devices compatible with Bear Tracks application. The Mobile devices need to be configured to provide secure syncing and allow for batch synchronization. This will require the contractor to develop a secure form of tethered communication and a method to support batch synchronization that meet the current network security constraints.
3. DESCRIPTION OF SUPPLIES/SERVICES: The general nature of the work is for the contractor to provide Zebra TC72/TC77 Mobile Computers and accessories compatible with Bear Tracks material tracking application that supports batch synch and tethered communication.

5. AUTHORITY CITED: This action is under the procedures of under the procedures of
Federal Acquisition Regulation (FAR) 13.5 under the authority of:
☒41 U.S.C. 1901, Simplified Acquisition Procedures ☐41 U.S.C. 1903, Special Emergency Procurement Authority
6. REASON FOR AUTHORITY CITED:
a. The ITS/DMM system uses mobile computers/PDA’s to record events for material movement throughout the National Capital Region (NCR). The PDA’s are essential for the processing material movement. The current PDA’s have reached the end of their lifecycle, they are no longer under warranty and the current mobile platform will no longer be supported by the manufacturer. Mobile computers must meet JSP/DISA security requirements
b. The ITS/DMM program is in need of new mobile hardware. The mobile devices must be compatible with our current mobile material tracking application. In addition to software compatibility, the current mobile application will need to be upgraded to support batch synching and tethered communication. Bear River Associates remains the only company that has access to the source code for the current Material Tracking system (Bear Tracks) required to support batch synching and tethered communication.
c. The Zebra TC72 hardware/software is approved on the current OSD network and determined compatible with the current mobile material tracking application. The vendor will be required to configure the mobile application to support batch synching and tethered communication. Configuration of current mobile material tracking application can only be achieved by Bear River Associates due to source code ownership. Awarding this contract to a different vendor would prove costly and time consuming. Bear River is responsible for initial set up and maintenance of mobile device hardware/software (Covered under contract HC1028-17-C-0014, section 5.2.7). Configuration of TC72 hardware/software and mobile application is most advantageous to the Government compared to purchasing unapproved hardware/software and/or replacing current material tracking software. Purchasing authorized/approved products from Bear River Associates is most advantageous to the Government to ensure successful ITS/DMM integration and continuous maintenance support.
d. LPTA (Lowest Price Technically Acceptable) Sole Source Contract, due to the brand name item. The authority for permitting other than full and open competition for this acquisition is FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; FAR 8.405-6(b), Items particular to one manufacturer -- the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs;
FAR 8.405-6(a)(1)(i)(B), “Only one source is capable of providing the hardware/software/service required at the level of quality required because the hardware/software is unique or highly specialized.”
e. One vendor responded
f. There is an associated risk that would add an additional cost and hardship to the government if the J&A is not approved. The current mobile hardware is at the end of its lifecycle and will no longer be supported. ITS/DMM is currently experiencing major issues with the existing hardware and software. Not approving this J&A would impact top officials including the Secretary and Deputy Secretary of Defense and prove detrimental to the ITS/DMM program.
The mobile hardware/software is a used material tracking and accountability for material through the NCR. The mobile hardware/software is used by PFPA, FSD, ESD, and HQDA at the Pentagon, Mark Center, and Crystal City locations. Not approving this J&A will impact a number of DOD Agencies and U.S. Military Services located in the NCR who depend on the services provided these agencies.
7. EFFORTS TO OBTAIN COMPETITION: A sources sought notice was posted on FedBizOpps on December 14, 2018 with a close date of December 28, 2018. AD received one response from the sources sought notice
8. FAIR AND REASONABLE COST DETERMINATION: The Contracting Officer determines that the anticipated prices will be fair and reasonable by using the techniques identified in accordance with FAR 15.404-1(b)(2)(i) to ensure award will be at fair and reasonable prices. The selection will be made from Lowest Price Technically Acceptable (LPTA) quotes received in response to the Request for Quote. IAW FAR 15.403-1 (b)(5), certified cost and pricing data were not required.
9. MARKET RESEARCH: Government market research included internet searches, searches on Government wide contracts including GSA contracts and posting a sources sought notice. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions.
10. ANY OTHER FACTS SUPPORTING THE USE OF SOLE SOURCE: NA
11. INTERESTED SOURCES: The following vendor responded to the sources sought notice:
New Tech Solutions, Inc. (NTS) 4179 Business Center Drive Fremont, CA 94538 Tel: (510) 353-4070 x 307 Email: rajesh@ntsca.com
12. ACTIONS TO INCREASE COMPETITION: Due to network security constraints a COTs product would not fully satisfy the requirement. Custom code will need to be developed to meet network security requirements and ensure a fully functional system.
The hardware will need to be configured to support Bear Tracks mobile application.
Configuration of hardware and code to provide tethered communication and batch synchronization requires authorized support from a technical representative familiar with Bear Tracks mobile application. At this time only Bear River Associates can fully support the Governments’ needs.
