About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for the Department of Defense Washington Headquarters Services. The purpose is to establish a short-term bridge contract with Poplicus, Inc. (dba Govini) for a Data Mining Software-as-a-Service (SaaS) Platform from July 18, 2025, to September 30, 2025, with a potential 6-month extension. The contract will support existing platform customers by renewing licenses for a data analysis platform that enables cross-referencing between DoD systems, including financial, acquisition, and contracting databases.

The justification highlights the critical nature of the platform for various DoD missions, including counter-threat finance analysis, naval acquisition, weapons system readiness, and industrial base mapping. The sole-source award is justified by the urgency of maintaining uninterrupted access to the platform, the complexity of replicating its specialized features, and the comprehensive nature of its data. The contract involves approximately 30 task order requirements valued at $50M in expiring FY2025 funds. After this bridge contract, future requirements will be fulfilled through a GSA Supply Chain Risk Illumination Professional Services and Tools (SCRIPTS) blanket purchase agreement.

DEPARTMENT OF DEFENSE

WASHINGTON HEADQUARTERS SERVICES

WASHINGTON, DC 20301-1155

ACQUISITION

DIRECTORATE

WHS-2025-1755-JA

JUSTIFICATION FOR

OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

UNDER FEDERAL ACQUISITION REGULATION FAR SUBPART 6.3

July 18, 2025

1. AGENCY AND CONTRACTING ACTIVITY: The contracting activity is the Department of Defense (DoD), Washington Headquarters Services, Acquisition Directorate (WHS/AD), Enterprise Office of the Secretary of Defense Division (EOSD). The requiring activity is the office of Director of Administration and Management (ODA&M) and ODA&M’s successor organization, Acquisition Policy and Innovation (API).

2. DESCRIPTION OF ACTION: The purpose of this action is to established a short-term contract to bridge the gap between the completed Data Mining Software-as-a-Service Platform with Data and Analytics Solutions single-award indefinite-delivery, indefinite-quantity (IDIQ) contract (herein: the Data Mining IDIQ) and the General Services Administration’s (GSA) Supply Chain Risk Illumination Professional Services and Tools (SCRIPTS) blanket purchase agreement (BPA). WHS/AD awarded the Data Mining IDIQ (HQ0034-20-D-0002) to Poplicus, Inc. (dba Govini) on 10 December 2019; the contract ended on 10 June 2025. Under the Data Mining IDIQ Govini provided a SaaS platform to enable real-time data analysis across the DoD and licensed data through metadata that enabled linkages between currently siloed DoD systems, e.g., the ability to crosswalk between databases of financial, acquisition, contracting, and other data. The short-term IDIQ contract (herein: Data Mining Bridge) will support existing Platform customers only via license renewals. The Data Mining Bridge contract’s period of performance will end on 30 September 2025.

3. DESCRIPTION OF SUPPLIES/SERVICES: The Data Mining Bridge IDIQ will support existing Platform customers license renewal needs only. The Government will issue task orders under the Data Mining Bridge for continued at-scale Data-Mining Software-as-a-Service (SaaS) platform licenses to sustain current reform efforts and analytics needed to support the DoD’s business operations.

FAR 52.217-8

4. AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION: This action is authorized under the provisions of 10 United States Code (U.S.C.) 3204(a)(2) as implemented by Federal Acquisition Regulation (FAR) 6.302-2, “Unusual and Compelling Urgency.” Specifically, as implemented at FAR 6.302-2(a)(2), “When the agency’s need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for”.

Further, as required by 10 U.S.C. 2304(l) and implemented by FAR 6.305, the approved justification will be publicly available at the Government Point of Entry (GPE), www.sam.gov, within 14 days after award.

5. REASON FOR AUTHORITY CITED: Discussions with the customers and market research did not result in credible sources other than the current Data Mining IDIQ contract holder that could support the anticipated requirements in a timely manner. The GSA has awarded a BPA that will provide similar products , however GSA has indicated it will not be prepared to support orders via assisted acquisitions until after 30 September 2025. The current contractor, Poplicus Incorporated (dba Govini), is the only vendor that can satisfy the agency’s minimum needs of providing uninterrupted Data Mining Software-as-a-Service Platform licenses in the required timeframe.

Additionally, DoD has approximately 30 task order requirements valued at approximately $50M in expiring Fiscal Year (FY) 2025 funds that must be obligated by 30 September 2025. Failure to execute a bridge contract to Govini could result in the loss of approximately $M in expiring FY2025 funds.

Critical acquisition missions rely on the capabilities the Data Mining Contract provides, including counter-threat finance analysis by the Security Assistance Group - Ukraine (SAG-U), Naval surface ship acquisition, including the digital mapping of common parts used across hulls, parts pricing analysis, weapons system readiness analyses, diminishing manufacturing sources and material shortages avoidance. The Defense Logistics Agency’s Industry Analysis and Engagement office, the Office of the Under Secretary of Defense Office of Strategic Capital, and the Office of the Deputy Assistant Secretary of Defense for Nuclear Matters rely on Data Mining Bridge platform licenses.

The data accessed via the SaaS platform is necessary to help prevent schedule delays and cost overruns in Defense Acquisition Programs by using advanced analytics and analysis to provide predictive capabilities for program managers. Without the Data Mining capabilities, Defense acquisition program managers will not be able to map and monitor elements of the Defense Industrial Base important to their programs, including mapping individual components to weapon systems, suppliers of those components, and the components’ supply chains. Integrated Portfolio Analysis of DoD investments to determine actual business cost, opportunities for savings, return on investment, and opportunities to increase DoD buying power will become manpower-intensive and unable to be completed at the speed of relevance without the capabilities access via the Data Mining IDIQ.

6. EFFORTS TO OBTAIN COMPETITION: The contracting office posted a notice of intent to award a sole source IDIQ contract to Govini for this requirement and received one response from Convergent Solutions, Inc., dba Exiger Government Solutions which was reviewed by the COR and determined to not be a viable solution. As previously noted in Section 4 above, FAR 6.302-1(a)(2)(iii)(B) permits services that are only available from the original source for the continued provision of highly specialized services when it is likely that award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.

7. FAIR AND REASONABLE COST DETERMINATION: The Contracting Officer determines that the price for this contract action will be fair and reasonable. The techniques identified at FAR 15.404-1(b)(2) will be used to ensure new task orders and task order modifications are awarded at fair and reasonable prices. Platform licenses will utilize the pre-negotiated schedule pricing which was established when the current IDIQ was awarded. Certified Cost and Pricing Data will not be obtained.

8. MARKET RESEARCH: On July 10, 2025, the contracting office posted a notice of intent to award a sole source IDIQ contract to Govini for this requirement. On July 16, Convergent Solutions, Inc., dba Exiger Government Solutions submitted a capabilities statement, requesting consideration as an alternative. After review, the program office determined Exiger's supply chain risk management (SCRM) solution was not viable for the Data Mining Bridge contract. Specifically:

Lack of Tailored Customization: Exige’s platform lacks the extensive, DoD-specific user-defined workflows, queries, and pre-configured analytical tools that have been developed over five years to support the DoD user community. Replicating these complex, tailored functionalities would exceed the short bridge contract duration.

Limited Scope: Exige’s solution is a commercial SCRM product not broadly tailored to the DoD's wider acquisition and sustainment requirements, which encompass production, science and technology market research, and modernization beyond just SCRM.

Data Deficiencies: Exige’s data is significantly less robust than the incumbent's, which includes over 20 years of DoD parts data, 30 million commercial parts, worldwide intellectual property, and China-focused corporate information. Building such a comprehensive, curated database within the short bridge period is infeasible.

Given Govini's unique qualifications, the impracticality of transitioning services within the short timeframe, and the absence of other formal challenges, the sole source award to Govini is justified.

9. OTHER FACTS: The work included is time sensitive and critical to DoD’s mission.

10. INTERESTED SOURCES: Exiger Government Solutions submitted a capability statement to the Government which was determined to not be a viable solution for this requirement.

11. ACTIONS TO INCREASE COMPETITION: Upon the conclusion of this contract, and once GSA assisted acquisition is available, new requirements will be fulfilled by the nascent GSA SCRIPTS BPA, a competed BPA with both small and other-than-small businesses.

12. INITIAL COMPETITION: Is this acquisition for a non-competitive follow-on acquisition previously awarded on a non-competitive basis?

Yes. A copy of the previous justification is attached. The actions to remove any barriers to competition cited on the previous justification were were not completed [Must include explanation of why the answer is “no”].

No. The original acquisition was conducted on a competitive basis.

Not Applicable. This is a new requirement.
