SECTION 1 – INTRODUCTION
1.1 GENERAL INFORMATION
The Small Business Administration (SBA) is issuing this solicitation (SOL) # 73351023Q0322 as a Request for Quote (RFQ). This RFQ is pursuant to Federal Acquisition Regulation (FAR) Part 12— Commercial Items and FAR Part 13 Simplified Acquisition Procedures. This requirement is for the purpose of entering into an order for the Statement of Work (SOW) entitled, “Job Search Engine, Matching and Hiring Platform”.
This is a notice that the resultant contract is for a total small business set-aside requirement. Any quotation that is submitted by an Offeror that is NOT a Small Business will not be accepted.
The Government anticipates that the majority of this effort may be performed under NAICS Code Primary NAICS 541519 Information Technology Value Added Reseller. The following NAICS codes may be considered NAICS 541810 Advertising Agencies, NAICS 541613-Maketing Consulting Services, NAICS 541890-Other Services Related to Advertising. The Product Service Code is DA10- IT and Telecom - Business Application/Application Development Software As A Service.
1.2 RFQ QUESTIONS:
Offeror must submit all technical questions concerning this solicitation in writing by e-mail to the Contracting Officer, Tracie.Gutierrez@sba.gov and the Contract Specialist, Patrick.Ferguson@sba.gov All questions must be submitted via e-mail, and received no later than 1:00 PM Eastern Time (ET) on August 4, 2023.
1.3 RFQ DUE DATE:
The due date for response to this RFQ at the addresses specified below is on or before 1:00 PM ET August 10, 2023. Each volume shall be clearly marked by Volume Number and Title. The Government reserves the right to not accept quotes received after the closing date and time. It is the responsibility of the offeror to get their submission in on time and ensure successful delivery to the Government. Quotes shall also be emailed to the Contract Specialist, Patrick Ferguson at Patrick.Ferguson@sba.gov and the Contracting Officer, Tracie at Tracie.Recruiter@sba.gov.
1.4 INSTRUCTIONS

1. Background
The mission of the Small Business Administration (SBA) is to aid, counsel, assist and protect the interest of small business concerns to preserve free competitive enterprise and to maintain and strengthen the overall economy of our nation. The mission of PODD is to maintain and strengthen the nation’s economy by enabling the establishment and vitality of small businesses and by assisting in the economic recovery of communities after disasters.
Scope
The People Operations Disaster Division (PODD) must secure a platform that has a broad and immediate reach to a large, diverse, and quality applicant pool to support recruiting and outreach efforts. This platform must deliver the capability to connect qualified applicants in the contiguous United States, Puerto Rico, and all US territories. The job posting site must also allow PODD to post over 100 jobs during emergency hiring surges. Targeted candidate marketing, assistance with employee branding, and coordination with social media platforms are additional features that will allow PODD to meet the necessary recruiting goals in support of the disaster recovery operations within SBA. The selected system will have the capability to digitally integrate data to and from USAjobs and USAstaffing, which is currently used for all our primary HR functions.
The scope of work for this solicitation is to procure a Job search engine to post our jobs/vacancies for maximum visibility until vacancy has been filled. The contractor will work with each POC to ensure online posts are placed when required. SBA requires an online service that can provide raw data and guarantee outreach to a diverse audience across the United States to ensure the right talent is hired quickly and efficiently. The online service must enable SBA to provide the ability to capture metrics during the hiring life cycle. In addition, the following services are also requested:

The SBA would like to procure staffing recruitments services/capabilities with similar specifications as Indeed.

• Instant Match capabilities: to obtain qualified candidates when job is posted and ability to invite candidates to apply.

3. Place of Performance
The work shall be performed at the contractor’s office.
The administration of this requirement will be handled by the following location:
U.S. Small Business Administration Office of Capital Access (OCA) and Office of Disaster Assistance (ODA) 13221 Woodland Park Road Herndon, VA 20171
4. Hours of Operation The Contractor is responsible for providing support between the hours of 07:30AM EST and 18:00PM EST - Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.
The Contractor must maintain an adequate work force for the uninterrupted performance of all tasks defined within this work statement when the Government facility is not closed for the above reasons.
When hiring personnel, the Contractor shall keep in mind the stability and continuity of the work force are essential.
5. Travel and Other Direct Costs (ODC)

SECTION 3 - GENERAL TASK ORDER TERMS AND CONDITIONS
3.1 SBA201-70 Authorities and Delegations (OCT 2022)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer may designate a Contracting Officer's Representative (COR) at the time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The contractor need not proceed with direction that it considers to have been issued without proper authority. The contractor shall notify the Contracting Officer in writing, within three days of occurrence and with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the contractor considers to exceed the COR's appointment. Unless otherwise provided in this contract, the contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause or as soon as practicable thereafter. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
3.2 SBA203-70 Restrictions on Endorsements (OCT 2022)
The Contractor shall not refer to contracts/agreements/orders awarded by the SBA in commercial advertising, as defined in FAR 31.205-1, in a manner which states or implies that the product or service provided is approved or endorsed by the Government, or is considered by the Government to be superior to other products or services. This restriction is intended to avoid the appearance of preference by the Government toward any product or service. The Contractor may request that the Contracting Officer make a determination as to the propriety of promotional material.
3.3 Payment for Unauthorized Work
No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications, terms, and conditions under this effort.
3.5 SECTION 508 COMPLIANCE REQUIREMENTS
All electronic and information technology (EIT) procured through this Performance Work Statement / Bill of materials and any resulting contract, task order, delivery order, or purchase order must meet the applicable accessibility standards at 36 CFR§ 1194, U.S. Architectural and Transportation Barriers Compliance Board (Access Board) under the authority of Section 508 of the Rehabilitation Act Amendment of 1998,.36 CFR§1194, unless an agency exception to this requirement exists. 36 CFR§1194, U.S. Architectural and Transportation Barriers Compliance Board (Access Board) is viewable at http://www.section508.gov. The Contractor shall indicate for each line item in the schedule whether each product or service is compliant or noncompliant with the accessibility standards at 36 CFR§1194.
Further, the quote must indicate where full details of compliance can be found (e.g., vendor’s website or other exact location).

3.6 508 Excluded Functions and Responsibilities
Functions and responsibilities directly involved or associated with the management of any SBA Office are expressly excluded from this contract or order issued hereunder. The parties hereby agree that any instructions, directives, or orders issued under this contract involving such management functions and responsibilities shall be null and void. The following activities are representative of the excluded functions and responsibilities that cannot be provided by the Contractor under this contract or order issued hereunder:
a) Policy making
b) Program management
c) Technical management of Government contracts.
d) Government purchasing, contracting, contract administration, acceptance of materials and/or performance, and payment and accounting.
e) Direction or supervision of other Government contracts or Government agencies, or otherwise acting as an agent to obligate or commit the Government in any capacity.
f) Clerical and other administrative type functions required to be performed by civil service personnel; and
g) Supervision of Government employees
3.7 Authority to Obligate the Government
The Contracting Officer is the only individual who can legally commit or obligate the Government to the expenditure of public funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific authorization from the Contracting Officer.
3.8 Administrative Considerations
3.8.1 Correspondence
To promote timely and effective administration, correspondence shall be subject to the following procedures:
a) Technical correspondence (where technical issues relating to compliance with the requirements herein) shall be addressed to the Contracting Officer’s Representative (COR) with an information copy to the Contracting Officer (CO) and the Contract Administrator
(CA).
b) All other correspondence, including invoices, (that which proposes or otherwise involves waivers, deviations or modifications to the requirements, terms or conditions of this SOW) shall be addressed to the Contracting Officer with an information copy to the COR.

6.0 SBA232-70 Invoice Submission (OCT 2022)
(a) Invoices shall be submitted via the Invoice Processing Platform (IPP), a service provided by the U.S.
Treasury’s Bureau of the Fiscal Service. Contractors are solely responsible for ensuring invoices are accepted by IPP and transmitted to the SBA. IPP will submit a status update to the vendor when the invoice is transmitted to the SBA.
(b) Contractors not enrolled in IPP will be notified to register upon award of a contract, agreement, or order. (c) Contractors shall ensure that their System for Award Management (SAM) account remains active during contract or order performance. IPP will not allow a submission or payment of an invoice if the contractor’s SAM registration is expired.
(d) The contractor shall include or input the following information. Additional information may be required by the contract, agreement, or order. Items with asterisks typically automatically populate from the contract or order.
(1) * Vendor name and address.
(2) Invoice date: Future dates and dates greater than five years in the past cannot be entered into IPP; the start date must not be prior to the start of the contract period of performance.
(3) Invoice number. Duplicate invoice numbers cannot be used.
(4) * Contract and/or order number.
(5) Quantity per Contract Line-Item Number (CLIN).
(6) * Description, unit of measure, unit price, and extended price of delivered items or provided services.
(i) Unless otherwise specified in the contract or order, a billing period for services is a month. The “Service Date” is a required field and must reflect the period of performance billed.
(ii) For time-and-materials contracts or orders, the contractor shall invoice no less often than monthly, and shall include the following on the invoice or an attachment to the invoice:
(A) Total amount funded by CLIN.
(B) Total amount invoiced to date by CLIN.
(C) Funding balance by CLIN.
(D) Estimated completion cost by CLIN.
(7) Discount terms for prompt payment if offered.
(8) Name and phone number of the contractor’s Point of Contact (POC).
(9) Attachments as applicable including the Contractor’s internally generated invoice or supporting documentation.
(e) IPP allows contractors to view the status of invoices in IPP. IPP invoice status codes are:
(1) Pending Approval – Invoice has been submitted via IPP and received by
SBA.
(2) Rejected – Invoice has been rejected (overnight batch process system interface) and the invoice must be resubmitted with new invoice number.
(3) Paid – Payment has been made to the Contractor’s financial institution.
(4) Saved in Exception – Invoice has not been created in IPP because of a rule set error.
TBD has been delegated to serve as the Point of Contact (POC) for this order.
