About this file

This document is a Justification and Approval (J&A) for a Blanket Purchase Agreement (BPA) to continue the transition of composite sunshields for the U.S. Navy, U.S. Army, U.S. Coast Guard, and Military Sealift Command ship classes.

The J&A states that RE:BUILD CR, LLC (CAGE Code 8W9A9) is the only qualified contractor per NAVSEA Drawing 710-8931717A for the construction of composite sunshields. The BPA will have a 5-year ordering period from FY25 through FY29, with estimated funding amounts provided for tooling, drawings, set up information, and the future procurement of specific sunshield configurations. The contract will use Product Service Codes 5860 (Detection and Coherent Radiation Equipment) and H958 (Quality Control, Testing and Inspection Services). The J&A justifies the use of other than full and open competition, as RE:BUILD CR, LLC is the only approved vendor for this technology, and no other vendors have been identified that can meet the Government's requirements. The Contracting Officer has determined the costs to be fair and reasonable based on prior contracts with RE:BUILD CR, LLC.

J&A Number: N00167-24-SIMACQ-CD-63-0002

1. Tooling drawings, tooling, and set up information for fabrication of each sunshield configuration.

2. Sunshields

4. Statutory Authority Permitting Other Than Full and Open Competition

Only RE:BUILD CR, LLC (CAGE CODE 8W9A9) is the only qualified contractor per NAVSEA Drawing 710-8931717A for the construction of composite sunshields.

Per 10 U.S.C. 3204(a)(1), the head of an agency may use procedures other than competitive procedures when the property or services needed by the agency are available from only one responsible source and no other supplies or services will satisfy agency requirements.

This agreement will be awarded in fiscal year (FY) 24 and have a five-year ordering period through FY29.

The below table provides estimated funding amounts for tooling, drawings, set up information for fabrication of each sunshield configuration as well as the future procurement of specific configurations. There are many different configurations of sunshields due to a variety of ready service locker vendors which range in size from ” to .” Each BPA call will provide the NAVSEA drawing for the specific sunshields that are requested under the BPA call. The specific call quantity and configurations of composites sunshields to be determined for each specific BPA Call by dollar value, FY, and appropriation.

Approp. FY25 FY26 FY27 FY28 FY29 Total Varies

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The Product Service Codes (PSC) for this procurement will be 5860 (Detection and Coherent Radiation Equipment) and H958 (Quality Control, Testing and Inspection Services: Communication, Detection and Coherent Radiation Equipment), and are aligned with the DoD taxonomy associated with the acquisition of services, supplies and equipment.

5. Rationale Justifying Use of Cited Statutory Authority

NSWCCD has spent several years developing RSL Composite Sunshield technology for the mitigation of corrosion-related maintenance on the current metallic sunshields for the fleet. During these years, and in conjunction with the Office of Navy Research’s (ONR’s) Manufacturing Technology (ManTech) Program, NSWCCD worked to leverage their sunshield prototype effort and develop an efficient commercial manufacturing method that can be used to transition composite sunshield technology to the fleet. In FY23 the NRE and first production articles for DDG 51 class ships were funded and are expected to be delivered in FY24. NSWCCD Code 617 is looking for a BPA to support the transition of composite sunshields for US Navy, US Army, US Coast Guard, and Military Sealift Command Ship Classes.

NSWCCD has spent multiple years working on this technology and helping spin up the manufacturing capabilities, the only approved vendor per NAVSEA Drawing 710-8931717 is RE:BUILD CR, LLC. There is currently no other vendor approved by NAVSEA, to open this agreement to more vendors would delay the implementation of Composite RSL Sunshields and force additional cost related to startup costs on

NSWCCD.

6. Description of Efforts Made to Solicit Offers from as Many Sources as Practicable

As shown in section 5 there is currently only one approved producer of composite RSL sunshields. Composite Resources makes these to order and have not sold them for resale to any reseller. As such, no secondary offerors have been solicited for these items.

Pursuant to FAR 13.501(a)(1)(iii), the Government will make this justification available on the Government Point of entry (SAM.gov) The Government will ensure that the contract file will be documented as to any responses received from making the justification available.

This acquisition is determined to be sole source based on RE:BUILD CR, LLC singular ability to provide the required service and material to meet the Government’s needs.

NAVSEA will allow vendors to become qualified to fabricate the composite sunshield once the company submits first article test package that shows that the materials and composite sunshields meet the performance requirements on NAVSEA drawing 710-8931717. NSWCCD has been approached by one vendor that is working in the refurbishment of ready service lockers that has expressed an interest in potentially making composite sunshields in the future. Due to the high cost of the material, it is unclear if any other vendors would be interested in developing this capability. NSWCCD is working to set up a CRADA with this company to support the development of alternative manufacturing methods for composite sunshields to lower the cost of procurement in the future.

7. Determination of Fair and Reasonable Costs

In accordance with FAR 13.106-3(a), the Procuring Contracting Officer (PCO) shall ensure that all services and supplies provided under the anticipated agreement are procured at a fair and reasonable price.

The Government will require the contractor to submit a price offer and sufficient information to support the accuracy and reliability of the estimate. The PCO shall determine that the proposed offer represents the best value (as defined in FAR 2.101) to meet the Government’s needs; however, the price being determined fair and reasonable will occur at the individual BPA call level.

The NSWCCD Code 617 procured the same services and materials support from RE:BUILD CR, LLC in the past via contracts N0016723P0201 with a delivery date on 31 March 2024 and N0016723P0176 with a delivery date on 31 January 2024. The PCO will rely on Code 617’s technical expertise, as well as information from prior contracts, when conducting the price analysis. This information will form the basis for a fair and reasonable price.

8. Actions to Remove Barriers to Competition

For the reasons set forth in section 5, NSWCCD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. NAVSEA is able to approve another vendor upon the delivery of composite RSL sunshields that are able to meet the standards set by NAVSEA drawing 710-8931717 and perform without concern for impact on warfighter readiness. NSWCCD has been in active discussion with an additional vendor, but no technical data package delivery date has been discussed.
