About this file
This document is a Determination to Solicit from a Single Source (RFQ No. 140R6025Q0023) issued by the U.S. Department of the Interior's Bureau of Reclamation, Missouri Basin Regional Office. The Bureau intends to award a Firm-Fixed-Price purchase order to the Blackfeet Tribe of the Blackfeet Indian Reservation for noxious weed control services on Reclamation lands surrounding St. Mary Canal Drop Structures 2 and 5 in Glacier County, Montana. The estimated contract value is $68,506.79, and the work includes weed, vegetation, and brush control on operations and maintenance grounds, guard railings, and surrounding Reclamation land.
The sole source justification is based on the Blackfeet Tribe's Noxious Weed Management Program being the only viable source due to specific constraints in the Performance Work Statement. These constraints include the requirement for the contractor to have authority under the Montana County Weed Control Act to issue noxious weed complaints and possess a valid Certified Montana State commercial/government applicator license. Market research, including a Notice of Sole Source Intent posted on SAM.gov and searches of small business databases, confirmed no alternative sources capable of performing the required services in Glacier County.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE
Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).
Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.
1. Agency and Contracting Activity: U.S. Department of the Interior, Bureau of
Reclamation, Missouri Basin Regional Office, Acquisition Services (MB-5000)
2. Name and Address of Single Source: Blackfeet Tribe of the Blackfeet Indian Reservation, 640 All Chiefs Road, Browning, MT 59417
3. Description of Supplies/Services and Estimated Cost: The Bureau of Reclamation’s
Missouri Basin Regional Office intends to award a Firm-Fixed-Price purchase order to the Blackfeet Tribe of the Blackfeet Indian Reservation to perform services to control noxious weeds in accordance with State and Federal law and to control invasive and nuisance species (as identified by Bureau of Reclamation (Reclamation), Montana Department of Agriculture, and Montana Weed Control Association) on Reclamation lands surrounding St. Mary Canal Drop Structures 2 and 5, on the Blackfeet Reservation, Glacier County, MT.
This work will include weed, vegetation, and brush control to features identified by Reclamation personnel. Features to be identified will include, but are not limited to operations and maintenance grounds, guard railings, and Reclamation land around St.
Mary Canal Drop Structures 2 and 5. The estimated value of this requirement is $68,506.79.
Noxious, invasive, and nuisance plants reduce habitat for native plants and animals, increase erosion, degrade riparian areas, create fire hazards, cause significant economic losses, and interfere with recreational activities. As such, the contractor must recognize that the timely and accurate performance of the required services is a vital and mandatory requirement of the contract.
Description of Circumstances, including why only one source is reasonably available: The place of performance for this work is on the Blackfeet Indian Reservation. Based on the customer’s market research, the Blackfeet Tribe has a Noxious Weed Management Program office that serves Reservation lands, and they
RFQ No. 140R6025Q0023 Page 2 of 3 couldn’t identify other viable sources. The Performance Work Statement (PWS) has constraints that impact competition. The contractor shall have the authority under the Montana County Weed Control Act (Title 7, Chapter 22, Part 21) to issue notice and process potential noxious weed complaints against Reclamation. The contractor shall have current and valid Certified Montana State commercial/government applicator license to apply pesticides with appropriate classification. Due to these considerations and the Contracting Officer’s market research (see Paragraph 6 below), the Blackfeet Tribe of the Blackfeet Indian Reservation (Noxious Weed Management Program) is the only viable source for this acquisition.
4. Determination of Fair and Reasonable Price: As permitted under FAR 13.106-2(b) –
Evaluation Procedures, the Contracting Officer may conduct a price analysis using the techniques at FAR 15.404-1(b)(2). The price analysis will include comparisons to historical prices paid for same services, published pricing, and the Independent Government Cost Estimate (IGCE). Historical pricing for same services will include weed mitigation services for similar locations in Montana. If there are any proposed travel expenses, they will be compared to the 2025 General Services Administration (GSA) daily per diem and mileage rates.
5. Description of Market Research: A Notice of Sole Source Intent special notice was posted to SAM.gov on 4/2/2025, with a closing date of 4/18/2025. The Notice of Sole Source Intent posting received one (1) response from Headwaters Flying Service, LLC (UEI: LLXQKCL46VH3). On their capability statement, their services include aerial herbicide, pesticide, and seeding application. In the PWS, no aerial spraying is allowed to moderate the amount of environmental impacts on non-target species. Additionally, campers may be in the area, and spraying is only allowed when campers have vacated the area.
Researching the North American Industry Classification System (NAICS) code in the Small Business Administration (SBA) Dynamic Small Business Search (DSBS) determined there is no small business that can perform the services needed in Glacier County. No Government wide contract is available or interagency options.
DETERMINATION
Based on the information within this document, the Contracting Officer has determined to solicit Request for Quote No. 140R6025Q0023 as a sole source to the Blackfeet Tribe of the Blackfeet Indian Reservation.
