Control No: 20-063 Contractor: Octo Consulting Group, Inc.

Department of the Army Justification for Exception to Fair Opportunity
Under Multiple Award Indefinite Delivery Contracts
1. Contracting Activity: U.S. Army Contracting Command – Rock Island (ACC-RI), Rock Island Arsenal, Rock Island, IL 61299-8000.
2. Description of Action: U.S. Army Program Executive Office, Enterprise Information Systems (PEO-EIS), Project Manager, Defense Cyber Operations (DCO) requests a firm-fixed-price bridge extension modification with Octo Consulting Group, Inc. (Octo).
ACC-RI will execute this action against the Enterprise Information Technology Services (EITS) Indefinite Delivery Indefinite Quantity (IDIQ) contract W52P1J-15-D-0015, Task Order (TO) 0002. ACC-RI projects award of the modification in
Other Procurement, Army funds. An acquisition plan is not required in accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 207.103(e) because this acquisition is included in the EITS IDIQ base approved on 27 September 2012 by PEO-EIS.
The requirement prior to this action was not competed under the authority of Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(C). That justification’s paragraph 7, actions to increase competition stated: PdM I3MP will be competing the follow-on requirement as a fair opportunity under a full explanation is contained within section 5 below.
3. Description of Supplies/Services: This action consists of a fourth extension for DCO Project Management Office (PMO) / Systems Engineering and Technical Assistance (SETA) services, supporting . The period of performance will consist of a
The DCO office includes Subject Matter Experts (SMEs) with critical support focusing on acquisition support planning, engineering, logistics, and information assurance services.
The required services supplement the DCO Government staff by assisting with lifecycle management, documentation development, and the development and writing of full Acquisition Requirement Packages (ARPs).

Octo’s SMEs will provide support that shall continue focus on planning, engineering, logistics, and information assurance services required until a follow-on contract vehicle exclusively for DCO, and its multiple programs, is established. Additionally due to the classified nature of some programs, Milestones for the competitive follow-on are as follows:
4. Authority Cited: FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
5. Reason for Authority Cited: This is the fourth bridge extension request under contract W52P1J-15-D-0015, TO 0002. This is the second time FAR exception 16.505(b)(2)(i)(C) is used for this procurement. TO 0002 was competed as a Request for Task Order Proposal (RFTOP) via EITS on 28 October 2015; offers were received in response to the RFTOP.
The DCO PMO acquisition strategy for Program Support was based on a Blanket Purchase Agreement (BPA), referred to as Eagle Shield. The BPA is made up of multiple Call Orders leveraging FAR Part 13 with each Call Order limited by a
. The acquisition strategy was determined in March 2018 and the BPA was initially awarded in April 2019. After the resolution of a protest, the BPA was awarded to in August 2019. To date, no call orders have been awarded under the Eagle Shield BPA.
PM DCO originally selected a BPA as the Acquisition Strategy based on the assumption it would provide increased flexibility with bringing key expertise into the organization and reduce contract timelines when compared to IDIQs or other contracts types. Based on the above assumptions FAR Part 13 (Simplified Acquisition Procedures) was selected in order to streamline the acquisition process.

These activities significantly impact DCO resources and its ability to complete this effort in a timely manner. Due to limited personnel available to develop the ARPs and participate in SSEBs the best case timeline to award all call orders is .
This would require that the current program support contract be in place in a reduced capacity until all call orders are awarded.
An added impact to contract award is the current COVID-19 Executive Orders that are in place requiring indefinite stay at home orders. This new challenge greatly restricts efficient progress towards call order awards and the ability to perform transition in/out of contractors. Unfortunately, there was no advanced indication of this impact and hence no opportunity to plan for the restrictions.
In order to mitigate the challenges and constraints of this strategy, PM DCO has determined that it is in the best interest of the program to move forward with a new Acquisition Strategy.
The requirements driving the DCOs follow on program support contract effort have remained consistent and have not changed, while DCO Cyber mission requirements are increasing as it continues to stand up additional Programs of Record (PORs), making it essential that the current vendor remain in place until the follow-on contract vehicle is awarded.
