Subject: Single Source Documentation
In accordance with FAR subpart 13.106-1, this memorandum justifies soliciting a single source procurement herein.
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY. Bureau of Land Management, Oregon State Office, 1220 SW 3rd Avenue, Portland, Oregon 97204
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED. The BLM will solicit Benton County, Salem, Oregon Law Enforcement support as a single source procurement to Benton County 205 NW 5th Street, Corvallis, OR 97330-4808 to be issued as a firm fixed price commercial service contract.
3. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S
NEEDS (INCLUDING THE ESTIMATED VALUE). The Government requires law enforcement services to support the Bureau of Land Management in the administration and regulation of use and occupancy of the public lands administered by the BLM, within Benton County, Salem, Oregon.
The estimated value of this acquisition is $200,000.00; Base year of $40,000.00 plus four one-year options at $40,000.00 each year
4. AUTHORITY AND SUPPORTING RATIONALE AND, IF APPLICABLE, A DEMONSTRATION
OF THE PROPOSED CONTRACOR’S UNIQUE QUALIFICATIONS TO PROVIDE THE REQUIRED
SUPPLY OR SERVICE. The authority permitting the single source consideration is FAR 13.106(b) Soliciting from a single source. The Benton County Sheriff’s Office is the only available source that has the power to make arrests and serve before a magistrate or judge, serve warrants for arrest or order for arrest, and give a ticket/citation within the county of Benton.
5. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ORDER REPRESENTS THE
BEST VALUE. Based on comparison of collective bargaining agreements in other counties of Oregon and Washington the price is anticipated to be fair and reasonable.
The rates include salary, benefits, administrative, and equipment costs. Based on the documentation herein, it is determined that the contract represents the best value.
6. DESCRIPTION OF MARKET RESEARCH CONDUCTED AMONG SCHEDULE HOLDERS AND
THE RESULTS OR A STATEMENT OF THE REASON MARKET RESEARCH WAS NOT
CONDUCTED. Market research was conducted on 03/14/2023 using the Small Business Administration (SBA) Dynamic Small Business Search which yielded two (2) vendors within the local area. However, the vendors do not have jurisdictional authority in Benton County to enforce state and local regulations.
A search of Law Enforcement Agencies through the American Civil Liberties Union (ACLU) – Oregon yielded two law enforcement agencies: Benton County Sherriff and Corvallis Police. The Corvallis Police Department does not have the same jurisdictional authority as the Benton County Sheriff’s Department
7. ANY OTHER FACTS SUPPORTING JUSTIFICATION.
None.
8. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR
OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION
FOR THE SUPPLIES OR SERIVCES IS MADE. None.

The Bureau of Land Management (BLM), Oregon State Office intends to award one (1) firm-fixed price noncommercial items services contract for law enforcement services located in Benton County, Oregon within the vicinity of the Northwest Oregon District area of responsibility as a single source to the Benton County Sherriff's Office as the only reasonable source pursuant to FAR Subpart 13.106-1(b). The Benton County Sherriff's Office is the only reasonable source with jurisdiction to enforce the civil and criminal laws of the State of Oregon and Benton County on public lands, waters, roads and trails, to include those administered by the BLM. The performance period is from the date of award for a period of up to five (5) years. The NAICS code is 561612. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Responses shall be received by 04/24/2023, in order to be considered.
