Section SF 1449 - CONTINUATION SHEET

ADMINISTRATIVE INFORMATION

The U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC) Directorate of Public Works (DPW) requires commercial sources for the procurement of Moving Services in order to accomplish their mission in supporting the ERDC Laboratories. ERDC intends to establish Master Blanket Purchase Agreements (BPA’s) in order to facilitate the procurement of these services. A BPA is a simplified method of filling anticipated repetitive needs for supplies or services by establishing “charge accounts” with qualified sources of supply. Pursuant to Federal Acquisition Regulation (FAR) 13.303, Blanket Purchase Agreements (BPAs), the Contractor agrees to the identified terms and conditions for a BPA to provide the required Moving Services exclusively with the U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC).

If and when requested, the vendor shall provide Moving Services at the ERDC Vicksburg, 3909 Halls Ferry Road, Vicksburg, MS 39180 in accordance with the Specific Requires for the individual BPA Order.

The Master Blanket Purchase Agreement (BPA) does not obligate any funds. The government shall be obligated only to the extent of authorized purchases actually made via a properly executed BPA Order.

The Government estimates, but does not guarantee, that the total volume of purchases through this agreement will be $950,000.00 over a 5-year period. Individual purchases shall not exceed the simplified acquisition threshold which is currently $250,000. There shall be no guaranteed minimum or maximum order limits established and no guaranteed dollar amount of expenditures with the vendor.

Appointed Micro-Purchase Contracting Officers, in good standing, are authorized to place delivery orders against this BPA up to Agency/Organization Program Coordinator (A/OPC) delegated single purchase authority limit, not to exceed the Micro-purchase threshold of $10,000 (10 U.S.C. 2338). Cardholders/Micro-Purchase Contracting Officers throughout ERDC possess varying purchase limits, for example, $3,500, $5,000, and $10,000. A cardholder cannot place a delivery order that exceeds their delegated GPC authority/appointment.

Actions greater than $10,000 or greater than the A/OPC delegated single purchase authority limit require a complete Procurement Action Request (PAR) submitted to the Contracting Office for processing. Only a warranted.

Contracting Officer is authorized to initiate and complete a BPA delivery order greater than $10,000.

The Master BPA’s will expire in five (5) years from date of award or total purchases reaching the BPA limit, (whichever occurs first).

Actual purchases will be made via properly executed BPA Orders. These orders will be initiated at the time the services are needed by an authorized representative of the Contracting Office or by a warranted Micro-purchase Contracting Officer.

All BPA delivery orders shall be supported by a delivery ticket or sales slip that must contain the following information at a minimum:

1) Name of supplier.

2) BPA number.

3) Date.

4) BPA delivery order number and/or PR&C number.

5) Itemized list of services and supplies provided.

6) Quantity, unit price, and extension of each item; less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).

7) Date of service.

INVOICE INSTRUCTIONS:

Invoices will be submitted and processed for each individual BPA Order.

(1) A proper invoice must be in accordance with FAR 32.905 (b)(1).

(2) Submit invoice via email to: CEFC-payments@usace.army.mil

To avoid delay in payment, a copy must also be emailed to the person ordering the services and supplies.

RESPONSE REQUIREMENTS

Interested vendors need only provide a response (letter format) which verifies the company interest in providing the needed services and confirmation that they can provide the requested services within the delivery guidelines identified in the Administrative Information.

Interested vendors response should include a web site, price list or catalog which shows representative costs for moving services (if available). There is no requirement for a “pricing bid” associated with this action.

Interested vendors response should include documentation of past performance for the past five (5) years in meeting requirements as outlined above. The past performance will be considered in selection of Master BPA’s.

Interested vendors response shall include the company Cage Code and/or DUNS number. There is no requirement for a “pricing bid” associated with this action.

The Master BPA’s will expire in five (5) years from date of award or total purchases reaching the BPA limit, whichever is earlier.

Responses shall be submitted electronically to: Leah Cobb at Leah.B.Cobb@usace.army.mil.

PERFORMANCE WORK STATEMENT

ERDC Moving Services

1.0. BACKGROUND/INTRODUCTION.

The Engineer Research and Development Center (ERDC) requests numerous moves during a week or month for its different divisions/branches. These moves are generally ad hoc in nature; i.e., a move is scheduled when a need arises. Because of the ad hoc and spontaneous nature of the task, and the inability to predefine the specifics of a move, the ERDC requests that a Blanket Purchase Agreement (BPA) be established to provide moving services

2.0. SCOPE.

The services to be provided under this contract shall consist of a BPA consisting of a minimum of two (2) vendors who can provide moving services to the ERDC. Participating contractors shall coordinate, manage, and provide all labor and materials and transportation for services provided.

The contractor shall perform tasks including setup of conference tables, chairs, props and decorations, as provided by the Government technical point of contact.

The Government will provide the contractor with a two (2) work day notice prior to a special event.

The contractor shall be responsible for the cleanliness of the areas where work is performed. All packing materials and trash shall be properly removed and disposed of by the contractor.

Standards:

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE

Standard Form 1444 (SF-1444)

Conformance Process:

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e. the work to be performed is not performed by any classification listed in the wage determination) be classified by the contractor so as to provide a reasonable relationship (i.e. appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage and Hour Division shall make a final determination of conformed classification wage rate and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR 4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract a separate SF-1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award the contractor prepares a written report listing in order the proposed classification title(s) a Federal grade equivalency (FGE) for each proposed classification(s) job description(s) and rationale for proposed wage rate(s) including information regarding the agreement or disagreement of the authorized representative of the employees involved or where there is no authorized representative the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action together with the agency's recommendations and pertinent information including the position of the contractor and the employees to the Wage and Hour Division U.S. Department of Labor for review (See 29 CFR 4.6(b)(2)(ii)).

4) Within 30 days of receipt the Wage and Hour Division approves modifies or disapproves the action via transmittal to the agency contracting officer or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF-1444 or bond paper.

When preparing a conformance request the ""Service Contract Act Directory of Occupations"" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember it is not the job title but the required tasks that determine whether a class is included in an established wage determination.

Conformances may not be used to artificially split combine or subdivide classifications listed in the wage determination."
