MEMORANDUM
Subj: SOLE SOURCE MEMORANDUM TO ACQUIRE AIR AFFAIRS LIMITED (AAL) SERVICES FOR THE MANUFACTURE AND DELIVERY OF PARTS FOR A MARITIME, EOD, TRAINING, RANGING, AND EVALUATION SYSTEM (METRES) (ERP 1300936332)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order to Air Affairs Limited, 49C Arrenway Drive, Rosedale, Auckland 0632, New Zealand, for manufacture and delivery of parts for a “Maritime, EOD, Training, Ranging, and Evaluation System” (METRES).
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
The contractor shall manufacture, build, assemble, and test:
1. three (3) Pressure Sensor Assemblies – Mod 1 (Part No. 13022-01),
2. three (3) Magnetic Sensor Assemblies – Mod 1 (Part No. 13008-01),
3. fifteen (15) Seacon Connectors AWL-S030-0019 (Part No. 18021), and
4. twelve (12) Seacon Connectors AWL-S021-006 (Part No. 18016).
The parts shall be received, assembled, and tested by AAL. A report of test results shall be delivered to the Naval Surface Warfare Center Panama City Division within seven months of the start date. If test results show satisfactory performance, the sensor assemblies shall be delivered with the report to the Naval Surface Warfare Center Panama City Division. No documentation changes are required. The estimated value of this effort is approximately $43,000. The contract action will be funded with Fiscal Year 2021 (FY21) Operation and Maintenance Navy (OMN) funds.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1) - 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements Since Air Affairs Limited is the METRES original equipment manufacturer (OEM) and the system contains proprietary technology, only AAL has the unique capability to provide these engineering services. Contractor proprietary data will be appropriately marked in accordance with the provisions of the contract and can be released to other non-Government personnel only after receiving written permission from the owner of the data.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No additional market research was conducted because it is not practical, for the reasons discussed in paragraph 4 above, for any company other than AAL to provide the product and services. This requirement will be synopsized in the government point of entry SAM.gov.
7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, the AAL employees are the only employees that can meet the requirement.
