(ERP #: 1300920662)
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
WHA International will provide Level 2 and Level 3 oxygen and hydrogen safety training and materials for to up to 30 personnel via a layered approach to allow both sets of training to be presented in four consecutive days. These courses of instruction will provide Government personnel with a knowledge and awareness of oxygen and hydrogen combustion hazards, fire risks, materials compatibility, ignition mechanisms, and the application of industry best practices pertaining to oxygen and hydrogen safety. The courses will also provide Government personnel with the knowledge to effectively design safe oxygen and hydrogen systems while performing effective risk analyses based on proven industry standards.
The total estimated costs are as follows:
1) Training Course Customization and Development to NEDU’s Facilities –On-site Technical Training including course materials, travel/per diem, and instructor labor for up to 30 students -
2) Shipping of Course Materials -
The total estimated cost of this procurement is $38,600. The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. The contract action will be funded with FY21 Operation and Maintenance Navy (OMN) Funds.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10 U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).
For over 30 years, WHA International has been known internationally as the de-facto experts in oxygen and hydrogen safety. WHA International personnel have written or contributed too many of the standards governing gaseous and liquid oxygen and hydrogen including but not limited to ASTM, CGA, EIGA, NFPA, NASA, SAE, and ISO. They provide training and consultation services to NASA, all US Military branches, aircraft, and other industrial and health care activities.
This procurement is sole source for the following reasons: WHA International aided NEDUs Immediate Superior in Command (ISIC), NAVSEA 00C, in drafting MIL-STD 1330, which is the MIL-STD required by NEDU for oxygen cleanliness and safety for the Navy. The standards and practices required by NAVSEA 00C and NEDU are taught and certified through WHA International. Due to WHA Internationals vast experience in the safety and consultations throughout the DoD and industry, they are the only entity capable of providing the level of training and certification that NEDU requires.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
No other venders were found to fulfill the level of instruction, familiarity with NAVSEA requirements, or certification requirements that WHA International can provide.
7. Any other facts supporting the justification.
None
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 and 6 above, WHA International is the only company that can provide the level of instruction and certification required.
