The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All equipment will be delivered no later than March 31, 2022. The purchase will be funded with Overhead funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1:

The Naval Surface Warfare Center, Panama City Division (NSWC PCD) had 5 courses taught by Paradigm Leaders for the Level 3 Leadership Cohort of 20 employees as a pilot program in 2021 to evaluate the course content and relevancy to NSWC PCD attendees. These 5 courses are proprietary courses developed by Paradigm Leaders, LLC. The Pilot has concluded and the next Level 3 Leadership Cohort course will be taught in 2022 to accomplish the same learning objectives. The command will have 5 courses taught in the Level 4 Leadership Cohort. A total of 10 courses will be taught this year between the two Leadership Cohorts. To keep the course content and learning topics consistent in the training program, NSWC PCD must have the same vendor provide the proprietary training again. As such, the government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to Paradigm Leaders, LLC for leadership and supervisor training.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on the Contract Opportunities website at sam.gov per FAR Part 5.2. No additional market research was conducted for the reasons discussed in paragraph 4 above, for any company other than Paradigm Leaders, LLC to provide the products.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Paradigm Leaders, LLC is the only source that can meet the requirement.
