SUBJ: SOLE SOURCE JUSTIFICATION TO ACQUIRE RAIDER OUTBOARD MOTOR

REPAIR FOR HAWAII BASED SPECIAL OPERATIONS UNITS

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price order to Raider Outboards Inc., 1855 Shepard Drive, Titusville, FL 32780 on a sole source basis for required repair/refurbishment of small (50 HP or less) Raider outboard motors (OBM) in support of Hawaii based special operations units.

3. A description of the supplies or services required to meet the agency’s needs

This requirement is for the inspection, repair and refurbishment of small (50hp or less) Raider OBMs (including lower end units) in order to return the items to a reliable, operational condition that can be sustained with routine maintenance. The items covered under this requirement are the multi fuel Raider 40hp OBM (National Stock Number (NSN) 3H 2805-01-652-3067) and the multi fuel Raider 50hp OBM (NSN 3H 2805-01-652-3076) located at special forces units based at Joint Base Pearl Harbor Hickam (JBPHH), Pearl Harbor HI. The Government will be responsible for shipping the OBMs to and from the Contractors facility for repair.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. The period of performance will be for twelve months from award of the order with an option for an additional twelve months of support. The purchase will be funded with FY 2021 – FY 2023 Operation and Maintenance, Navy (O&MN) funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1

The Naval Surface Warfare Center Panama City Division (NSWC PCD) Maritime Mission Systems Division, Code E10 has a requirement to support various Special Operations programs. These programs support the United States Special Operations Command, Naval, Air Force, and Army Special Operations Commands, Explosive Ordnance Disposal activities, and Foreign Military Sales activities. This requirement for engineering and technical support requirements covers special operations related projects which include Naval Special Warfare (NSW) surface mobility craft. This requirement is not suitable for full and open competition for the following reasons. NSWC PCD has conducted extensive market research on this requirement. A market research report was prepared identifying potential resources on the East and West coasts. However, these sources, when contacted by phone, have indicated that they have no interest in proposing. Additionally, NSWC PCD has released two Sources Sought Announcements (one for the East coast and one for the West Coast on 24 July 2018. There have been no responses to date except for a response from Raider Outboards Inc. Raider Outboards Inc. is the original equipment manufacturer (OEM) for these OBMs and the fueling system is proprietary to Raider Outboards Inc. The OEM does not utilize distributors and does not maintain a network of independent service providers. This makes the OEM the only source that can meet this requirement.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on the Contract Opportunities website at SAM.gov per FAR

5.2. No additional market research was conducted for the reasons specified in paragraph 4 above. .

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the Raider Outboards Inc. is the only source that can meet the requirement.
