DESCRIPTION:
THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT)
SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN
COMPETITION (INCLUDING BRAND-NAME).
On behalf of the National Institute of Neurological Disorders and Stroke (NINDS), the Office of Acquisitions Contracts Management Branch Red, NINDS Section of the National Institute on Drug Abuse (NIDA) intends to solicit on a sole-source basis by a request for quotation to Hydro Service & Supplies, Inc., for a HYDRO RO Water System Service Agreement for NINDS.
NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET
ASIDE STATUS
The intended procurement is classified under NAICS code 811210 with a Size Standard of $34M.
This acquisition is NOT set aside for small businesses, but rather is a sole-source acquisition to Hydro Service and Supplies, Inc.

REGULATORY AUTHORITY
This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures. Contracts awarded using FAR Part 13—Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6—Competition Requirements. FAR Subpart 13.106-1(b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization).
The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2024-05 dated 5/22/2024.
CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION
(INCLUDING BRAND-NAME) DETERMINATION
Hydro Service and Supplies, Inc., as the authorized provider of the Hydro Reverse Osmosis (RO) Series A system, which is the only contractor that is OEM-authorized and capable of providing the necessary parts, and maintenance support service. Hydro Service and Supplies, Inc. is the only source for factory trained and certified technicians to provide these parts, and to maintain and service the equipment.
In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, contact with knowledgeable individuals both in industry and Government, as well as reviews of available product literature, revealed no other sources. A review of the GSA Advantage, Dynamic Small Business Search, and previous Government acquisitions returned no results that meet all requirements.
Therefore, only Hydro Service and Supplies, Inc. is found to be capable of meeting the needs of this requirement.
The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Hydro Service & Supplies, Inc. is the only vendor in the marketplace that can provide the services required by the NINDS.

BACKGROUND, PURPOSE AND OBJECTIVES OF REQUIREMENT
The National Institutes of Health (NIH) is the nation’s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people’s health and save lives.
The mission of NINDS is to seek fundamental knowledge about the brain and nervous system and to use that knowledge to reduce the burden of neurological disease for all people.
The NIH Porter Neuroscience Research Center (Building 35) required a solution to address the poor-quality reverse osmosis (RO) water running throughout the facility. As a result, six (6) redundant systems were installed in the buildings ice rooms that are independent of each other that supply clean RO water. Each skid supplies one (1) or two
(2) Pods per floor with three (3) separate systems on the C side of the building. This system is critical to the infrastructure that ensures the safety and well-being of the intramural research conducted by NINDS.
A service agreement allows for quick repair, if needed and regular maintenance and upgrading work to ensure continued use of the HYDRO RO water system located in Building 35 (Rooms 1AB-602, 2AB-602, 3AB-602, 1CD-503, 2CD-503, and 3CD-503), which is required to perform at peak manufacturer’s standards.
Requirements:
The Contractor shall provide a HYDRO RO Water System Service Agreement during the base period and during each option period (if exercised) for the systems located in NIH’s Building 35 (Ice Rooms numbered 1AB-602, 2AB-602, 3AB-602, 1CD-503, 2CD-503, and 3CD-503) as follows.
1. The Contractor shall provide all labor and replacement parts for maintenance and repairs to maintain normal operation of the existing six (6) systems for which service shall be provided between the hours of 8 am and 5 pm, Bethesda, MD local prevailing time, Monday through Friday, unless notified otherwise.
Weekends and Federal holidays excluded.
2. The Contractor shall provide preventive maintenance to proactively maintain and monitor this equipment’s performance. This is to ensure peak performance for which service shall be performed by technically qualified factory trained personnel and shall consist of a thorough cleaning, calibration, adjustment, inspection, lubrication and testing of all equipment in accordance with the manufacturer's latest established service procedures.
3. The Contractor shall provide emergency service calls available within twenty-four
(24) hours of a request.
Period of Performance:
The anticipated period of performance is one 12-month base period and four 12-month option periods as follows:
Base Period: 9/02/2024 – 9/01/2025
Option Period One (1): 9/02/2025 – 9/01/2026 Option Period Two (2): 9/02/2026 – 9/01/2027 Option Period Three (3): 9/02/2027 – 9/01/2028 Option Period Four (4): 9/02/2028 – 9/01/2029
Contract Type:
A firm-fixed price type contract with option periods is planned for this acquisition, consistent with commercial practices.
CLOSING STATEMENT
THIS COMMERCIAL PRESOLICITATION NOTICE OF INTENT TO AWARD ON A
SOLE-SOURCE BASIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS.
However, interested parties may identify their interest and capability to respond to this notice.
A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the UEI, the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must provide evidence that they can provide equipment that meets all of the requirements in this announcement.
All responses must be received by the closing date and time of this announcement and must reference the solicitation number, 75N95024Q00349.
