PROCUREMENT SENSITIVE INFORMATION – FOR OFFICIAL USE ONLY
Justification and Approval for Other than Full and Open Competition under FAR Part 13
In accordance with FAR 13.106-1(b), Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
Per FAR 13.106-1(b)(1), this requirement does not exceed the Simplified Acquisition Threshold (SAT) and will be solicited to one source.
1. Identification of the agency and the contracting activity:
Uniformed Services University of the Health Sciences (USUHS), Acquisitions Directorate
2. Nature and/or description of the action being approved:
Issuance of a sole-sourced, firm fixed price award. This is a new firm-fixed price contract as a follow-on to HU000123P0026.
3. Description of the supplies or services required to meet the agency’s needs (including estimated value):
USU Department of Simulation has a requirement for one (1), 12-month Learning Space Matrix Warranty Plan. This warranty will support the Learning Space Management Platform at the Val G Hemming Simulation Center. This warranty includes:
Updates to Learning Space application;
Updates to the operating system of the server and additional installed applications by CAE Healthcare;
Nightly backup of textual data of the Learning Space database;
Response to server, camera, or audio outages;
Access to email and phone support during business hours;
Shipment of replacement components;
Hardware support.
The total estimated value for this annually-recurring requirement
4. Demonstration that the proposed contractor’s unique certifications or the nature of the acquisition requires use of the authority cited:
USU Learning Space Simulation Management Platform is proprietary and vendor-specific. Any services performed under the Learning Space Matrix Warranty Plan must be completed by the original manufacturer, CAE Healthcare Inc., as they own the original source code for the software programming. No other vendor is able to offer this warranty plan. Therefore, CAE Healthcare, Inc., is the only source that is available to meet the government’s needs.
5. Procedures of FAR 13.5 were or will be used in accordance with 41 USC 1901 or the authority of 41 USC 1903 (including publicizing required justifications):
Yes No X
If the notice to the Governmentwide Point of Entry (GPE) will not be publicized, indicate which exception applies:
X This requirement is under $25,000. No synopsis to the GPE is required. (FAR 5.101(a)(1))
The following exception under FAR 5.202 applies:
6. Determination by the Contracting Officer that the anticipated cost/price to the
Government will be fair and reasonable.
The anticipated cost or price to the Government for the items acquired under this justification are anticipated to be fair and reasonable. This determination shall be made by methods described at FAR 13.106-3(a)(2).
7. Description of market research conducted and the results, or a statement of the reason market research was not conducted:
Historical data for previous procurements and additional market research was conducted for this requirement; it was confirmed that there are no authorized third parties who can sell or distribute the Learning Space Matrix Warranty Plan due to the proprietary nature of this requirement.
8. Any other facts supporting the use of other than full and open competition:
None.
9. Listing of the sources, if any, that expressed, in writing, an interest in the acquisition:
N/A
10. Statement of the actions, if any, the agency may take to remove or overcome any barrier to competition before any subsequent acquisition for the supplies or services required:
The Government will continue to monitor the marketplace to remove the barriers of competition. However, the Learning Space Matrix Warranty Plan is the only warranty plan that currently meets all of the Government’s needs and is proprietary to the incumbent, CAE Healthcare. Any re-procurement to replace the existing system would result in duplication of costs to the Government and result in unacceptable delays.
