WEATHER DATA

1.1 WEATHER DATA INFORMATION

The project area for the U.S. Virgin Islands National Guard in St. Thomas is located in the north eastern area of the island.

The Contractor must obtain information concerning rain and wind.

Reference is made to the National Oceanic and Atmospheric Administration (NOAA) publication entitled Local Climatological Data - Monthly Summary, which contains climatological and meteorological observations and data, including wind, rain, and temperature data for the project area.

Subscription price and ordering information is available from the National Climatic Data Center, Federal Plaza, 151 Patton Avenue, Asheville, North Carolina 28801-5001. NOAA also has an internet information page at:

http://www.ncdc.noaa.gov/.

Potential for Flash Floods. Due to mountainous terrain in St. Thomas, Virgin islands, rainfall inland has the potential to create flash floods in coastal areas. Weather forecasts as well as actual rainfall amounts upstream of locations where personnel, equipment, and/or material are within the river channel or floodplain should be continuously monitored.

The National Weather Service San Juan forecast office can be accessed at the following website: http://www.weather.gov/sanjuan/

1.6.1 Established Project Control

The Government has established monuments along the work site(s). Each monument is represented in the contract drawings by a Designation and in most cases, an alphanumeric Permanent Identifier (PID). Information concerning the location and elevations can be found within the Survey Notes on the plan sheets. The Survey Notes for each included field survey will cite a particular survey number, and specify the control used to conduct that survey. Additional information is included in the Survey Notes that must be duplicated if an attempt to recreate the subject survey is desired.

1.6.2 Layout

From the monuments, control data and elevations established by the Government, the Contractor shall complete the layout of the work and shall be responsible for all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.6.3 Survey

The Contractor shall furnish, at his own expense, such stakes, templates, platforms, equipment, tools and material, and all labor as may be required in laying out any part of the work from the monuments, control data and elevations established by the Government. It shall be the responsibility of the Contractor to maintain and preserve all monuments, stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks or monuments are destroyed by the Contractor or through his negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at his discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor. The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.7 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which

SECTION 01 11 00 Page 5 damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or job prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or job prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or job prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.8 EXISTING WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.

1.9 LOCATION OF UNDERGROUND FACILITIES

Obtain digging permits with the base DPW prior to start of excavation.

Local Utilities are given 48 hours notice to mark their asset before start of construction. If a utility company fails to identify services, the Contractor is responsible for scanning the construction site with appropriate equipment and marking where existing underground utilities are discovered.

Verify the elevations of existing piping, utilities, and any type of underground or encased obstruction not indicated to be specified or removed but indicated or discovered during scanning in locations to be traversed by piping, ducts, and other work to be conducted or installed. Verify elevations before installing new work closer than nearest manhole or other structure at which an adjustment in grade can be made.

1.9.1 Notification Prior to Excavation

Notify the Contracting Officer at least 15 days prior to starting excavation work.

1.10 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

SECTION 01 11 00 Page 6

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.10.1 Schedule of Monthly Anticipated Adverse Weather Delays

The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

See Section 00 33 50 WEATHER DATA to obtain MONTHLY ANTICIPATED ADVERSE WEATHER DELAY WORK DAYS BASED ON 5-DAY WORK WEEK. A reasonable number of anticipated weather delay work days is obtained from the average number of days per month (rounded to the nearest whole number) with precipitation greater than that indicated in Section 00 33 50 WEATHER, WATER STAGE AND

TIDE DATA.

1.10.2 Contractor Responsibility

Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor must record on the daily CQC report the occurrence of adverse weather and resultant impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's scheduled work day. The number of actual adverse weather delay days shall include days impacted by actual adverse weather (even if adverse weather occurred in a previous month), be calculated chronologically from the first to the last day of each month, and be recorded as full days. If the number of actual adverse weather delay days exceeds the number of days anticipated in Section 00 33 50 WEATHER DATA (rounded to the nearest whole number), the Contracting Officer will convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days, and issue a modification in accordance with the Clause DEFAULT (FIXED PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1.

1.11 UNITS OF MEASURE

The standard U.S. system or the metric systems of measure may be utilized by the Contractor in the performance of his work. All survey records, official documentation, engineering data, and all correspondence, including any submittals and shop drawings, shall clearly denote which system of measure is being utilized, referenced or discussed. Any omission or inaccurate use of a unit of measure on the part of the Contractor shall not relieve him of his responsibilities under the contract terms. The unit of measure used in this contract is the U.S.

Imperial system. The contract drawings denote both standard U.S. system and metric system where appropriate. If no unit of measure is indicated on the drawing such as on ranges, stations, slope elevations, and distance numbers, then they are to be considered the standard U.S. Imperial system.

Goal of initial Partnering Meeting is to build trust, identify common goals, develop an initial Joint Risk Plan and Register, and understand individual project members' expectations and organizational values. Usual results include better communication between contract parties, shortened project learning curve and a cohesive two party contract partnership.

Participants usually sign a voluntary partnering agreement generally describing mutual obligation to cooperate to achieve project goals and maintain effective communication. Initial Partnering Meeting is mandatory. The expected duration for the initial partnering session is one day (at least eight hours).

1.7.1.1 Contractor Responsibility

Provide a facilitator for all partnering meetings from an approved list of vendors on the web site https://www.saj.usace.army.mil/About/Divisions-Offices/Construction/ under the BUSINESS WITH US tab. All deliverables must be provided in editable Microsoft Office Suite (i.e., Word, Excel) and PDF formats to the Government for review within 10 work days after completion of the meeting.

1.7.2 Partnering Regroups

After initial Partnering Meeting, participation will be voluntary in accordance with a signed Partnering Agreement. Partnering Agreements include provisions for Contracting Officer and Contractor to request Partnering Regroups when needed. A Partnering Regroup is usually a partnering session of one day (at least four hours) where senior level Contractor and Contracting Officer project members and other interested parties review project issues of concern to include an update to the Joint Risk Register. Issues of conflict are reviewed, attempt to affirm common project goals and understand concerns of other partners.
