PROJECT TITLE: WAREHOUSE AND MUNITIONS STORAGE FACILITY
PROJECT DESCRPTION: The U.S. Army Corps of Engineers, Baltimore District, has a requirement for the design and construction of a new 12,000 SF w arehouse facility and the retrofit of an existing 2,000 SF Earth Covered Munitions Storage Facility to include heavy w eapons storage, munitions storage, and general w arehouse requirements. The site w ill be adjacent to and include utilities to service a future training facility sharing the same site located on Ft. Carson, CO. This project includes This project is know n as Warehouse and Munitions Storage Facility.
This proposed procurement is a Total Small Business Set-Aside; NAICS Code: 236220 Commercial and Institutional Building Construction w ith a size standard of $39,500,00.00.

This is a Firm-Fixed Price Tw o Phase Design-Build Construction Contract utilizing the Best Value Trade-off Process. Contractors are requested to review requirements and instructions for this Tw o Phase Design-Build selection in response to this RFP. This is Phase 1 of the solicitation. Phase II of the Solicitation w ill be issued as an amendment and w ill only be available to those offerors selected to advance from Phase I to Phase II.

Section 00 10 00 - Solicitation
INSTRUCTIONS FOR PROCUREMENT
This is a Two- Phase Design-Build procurement in accordance with FAR Subpart 36.3 Two- Phase Design-Build Selection Procedures.
This Request for Proposal (RFP) is for Phase I only. Phase I submissions will be reviewed and a maximum of five
(5) of the most highly qualified proposals will be invited to submit Phase II proposals. Bid bonds are not required to be submitted until Phase II submissions. Additionally, a bid schedule and expanded specifications and details regarding the concept design will be provided in Phase II via an amendment to this RFP.
INSTRUCTIONS TO OFFERORS
IMPORTANT NOTES REGARDING THIS ACQUISITION
1. PROPOSAL CONDITIONS
a. Contractors must provide all required documents for Phase I and bid all items in Phase II with no exceptions. Should a contractor fail to fully complete the bid schedule, its offer will not be considered responsive to the solicitation and ineligible for the resultant contract award.
b. Split awards or multiple award contracts will not result from this solicitation.

3. SUBMISSION OF PROPOSAL
a. Proposals shall be submitted electronically, as described. The proposal shall not contain classified data. The use of hyperlinks in proposals is prohibited.
NOTE: The only authorized transmission method for proposals in response to this solicitation is electronically via DODSAFE online submission. NO OTHER TRANSMISSION METHODS (E- MAIL, FACSIMILE, REGULAR MAIL, HAND CARRIED, ETC.) WILL BE ACCEPTED.
Proposals must be submitted not later than the time designated for proposal submission. Proposal submission times are detailed below. Proposals submitted after the proposal submission time will be considered late proposals.

SUBMISSION FORMAT: Submission shall be in Adobe PDF format. You are limited to five (5) maximum files per upload (total size cannot exceed 2GB). If you have a large number of files, recommend that you combine or ZIP your files before uploading to the SAFE site. Offerors may use compression utility software such as WinZip or PKZip to reduce file size and facilitate transmission.
FILE DESCRIPTION: Include a “File Description” for each file you upload. The “File Description” will be included in the e-mail notice to each of the recipients you choose to have access your file(s). NOTE: Do NOT enter Privacy Act Data (Personal Identification Information (PII)) in the File Description.
INSTRUCTIONS TO FOLLOW ON THE SAFE WEBSITE:
1. Once at the SAFE website, select the “Drop-off” icon. This allows users without a Common Access
Card (CAC, an ID issued to certain Government users), or users whose computer is not configured to read a CAC the option to access the SAFE site as a guest.
2. After selecting the “Click Here” link, you will be prompted to add your personal information, file information, recipient (Government points of contact) information and e-mail settings.
3. When completing your file information, you will be required to enter the e-mail addresses for all recipients. For this solicitation, the recipients are the Contract Specialist and the Contracting Officer, listed above. The Offeror must enter and add the email addresses for both the Contracting Officer and Specialist listed above to the Recipient List. The Offeror can enter an additional e-mail address if desired. After entering the e-mail address, click the ADD button to add the e-mail to the “Recipients List” for your response. When your proposal is submitted, a notification will be sent to the selected recipients.
NOTE: Do NOT send the SAFE site packages to group e-mail accounts.
Even if you successfully upload your proposal to the SAFE site, notification will not be sent to the Government recipients until you verify your e-mail address. Entering an incorrect e-mail may result in the rejection of your submission for lateness. An Offeror can confirm proper submission by the ‘Drop-Off Completed” screen which generates based on proper file submission.
NOTE: It has been reported that documents are more quickly uploaded into the SAFE website when using a Chrome and Firefox web browser. The Government cannot verify that this is true and offers no guarantee that Offerors will have more success utilizing any particular browser.
TIMELINESS OF PROPOSALS: For the purposes of establishing whether a proposal submission is considered timely, the Government considers the date and time the submission is completely uploaded into the SAFE website. For proposals larger than the 2GB capacity of the SAFE website and require multiple submissions, the Government will consider the date and time the last submission is completely uploaded into the SAFE website. Do not assume that electronic communication is instantaneous. It can take several minutes or even hours in some cases.
The Government will not be responsible for proposals delivered to any location or to anyone other than those designated to receive proposals. Offerors are responsible for ensuring that proposals are submitted so as to reach the designated recipient. Offerors are responsible for allowing sufficient time for the proposals to be received in accordance with the instructions provided.
b. SF 1442 BACK (Page 2 of the Solicitation): Offerors are required to acknowledge the receipt of all amendments to the Solicitation on the Standard Form 1442 in Block 19. Offerors shall fully complete all the required areas located under the section designated as "OFFER" (refer to Items 14 through 20C).
c. BID GUARANTEE: The offerors are required to submit a Bid Guarantee for this procurement during Phase II submissions. Any offeror failing to submit an authentic Bid Guarantee will be considered non-responsive to the Solicitation and ineligible for award. The Bid Guarantee shall be in the amount of 20% of the bidder's price or $3,000,000.00, whichever is less.
d. BONDS AND INSURANCE: The Contractor will be required to furnish proof of insurance , including copies of the required endorsements , and performance and payment bonds within ten (10) calendar days following the Contractor's receipt of the contract award.
4. REQUESTS FOR INFORMATION
Technical inquiries and questions relating to this solicitation are to be submitted via Bidder Inquiry in ProjNet at (https://www.projnet.org) No Later Than (NLT) 12:00 P.M. (EST), 26MAY2022. To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment /question will receive an acknowledgement of their comment/question via email. Another email to the same address will notify the prospective vendor once the reply is available for viewing.

Specific Instructions for Future ProjNet Bid Inquiry Access:
1. For future access to ProjNet, you will not be provided any type of password. You will utilize your Secret Question and Secret Answer to log in.

PHASE I SUBMISSIONS
A. PROPOSAL SUBMISSION
1. PROPOSAL SUBMISSION REQUIREMENTS
a. Each volume shall be submitted electronically via email as the preferred method. Any portion of the proposal that is changed (as a result of negotiations or proposal revisions) should be annotated and dated. Each volume shall be clearly labeled with its Title.
b. Each paragraph should be single spaced and shall be separated by at least one blank line. A standard, 12-point minimum font size applies. Arial or New Times Roman fonts are required. Tables and illustrations may use a reduced font size no less than 8-point and may be produced in landscape mode.
c. The following volumes of material shall be submitted:

2. PROPOSAL FILES
a. Format. The submission shall be clearly indexed and logically assembled. Each volume shall be clearly identified and shall begin at the top of a page. All pages of each volume shall be appropriately numbered and identified by the complete company name, date, and Request for Proposal (RFP) number in the header and/or footer.
1) General Proposal Format. Submit documentation in Adobe Acrobat PDF format (filename extension “.pdf”), suitable for viewing in Adobe Reader. All price breakdown information to aide in the cost/price evaluation shall be submitted in Microsoft Office Excel Read/Write format and viewable in Microsoft Excel 2007 or newer. HARD COPY/PAPER PROPOSAL SUBMISSIONS WILL NOT BE CONSIDERED. Offerors’ shall bookmark and label each electronic PDF to afford easy identification from the proposal table of contents.
2) Title Page. The title page must include the offeror’s name and address, phone number and email address, title of the solicitation, solicitation number, and date of submittal.
3) Table of Contents. The proposal shall contain a detailed table of contents.
4) Font, Page Size, and Margins. Pages containing text are expected to be 8 ½ x 11 inches with at least one-inch margins at the top, bottom, and both sides. Paragraphs should be separated by at least one blank line. A standard 12-point font in either Arial or Times New Roman is required.
5) Proprietary information must be clearly marked.
(I) VOLUME I. The Volume Shall Be Organized Into The Following Factors:
FACTOR 1 PAST PERFORMANCE.
The Offeror will demonstrate past performance by submitting three (3) applicable projects.
All projects must have a construction completion date within the past six (6) years from the date the Phase 1 solicitation is issued, or be in progress meeting the guidelines below. Projects that have a date of overall work acceptance within the past six (6) years will also be considered. The information that is required to be supplied is identified on the form provided entitled “EXPERIENCE IN RELEVANT PROJECTS” (Attachment A). Offerors are not required to use the form itself as part of their proposals, but the information requested on the form must be in the Offeror’s proposals and shall be in the same format as the form. The Offeror will provide Past Performance information to substantiate the following:
• For all projects, construction must have been completed within the last 6 years from the date the Phase 1 Solicitation is issued; or for ongoing projects, either Design- Build or Design-Bid-Build, 100% of the design and approximately 75% of the major construction milestones must be completed by the date the Phase 1 Solicitation is issued.
• Offerors should demonstrate past performance in the following areas:
General experience:
a. Site Excavation
b. Electrical and Mechanical systems repair, construction, or replacement
c. Structural and foundation systems repair, construction, or replacement
Specialized experience:
d. Munitions Facility repair, construction, or replacement
e. Work on a military base with access controls
f. Design-Build Experience g.
For each of the projects submitted to demonstrate the above areas, provide a Contractor Performance Assessment Reporting System (CPARS) evaluation, and/or a completed Past Performance Questionnaire (PPQ), completed by a representative of the owner that provides the owner’s opinion of the Offeror’s past performance for the project. The Past Performance Questionnaire (Form PPQ-0) included in the RFP (Attachment B) is provided for the Offeror or its team members to submit to the owner for each project. Ensure correct phone numbers and email addresses are provided for the owner point of contact. Organize all Past Performance Information in the same order in which the Projects are submitted.
• Submit completed PPQs with your proposal. If the Offeror is unable to obtain a completed PPQ from an owner for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). At the owner's discretion, PPQs may be submitted directly to the Government's point of contact, Charles
Boswell, via email at Charles.M.Boswell@usace.army.mil prior to proposal closing date.

• Previously completed PPQs may be submitted provided that the documents do not reference any other RFP. Submitted PPQs must only reference this RFP.
• Submit copies of Federal/DoD/Navy/Army performance reviews even if they may be in the agency's databases or likely within the agency's arm's reach, i.e., Contractor's copy of CPARS evaluations for each of the projects submitted, to ensure the agency has all relevant past performance information.
• Provide the UEI number(s) and CAGE code(s) for the prime contractor and all teaming partners, e.g., design firms, key subcontractors, joint venture partners, whose experience is included in this Factor. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate, and complete past performance information rests with the Offeror.
• The Government may contact and interview the owner's representative identified on the
Past Performance Questionnaires and reserves the right to interview other individuals acting for the owner's representative; if the owner's representative is not available. In addition, the Government may review any other sources of information for evaluating past performance.
• Past performance information may be obtained from any other sources available to the
Government, to include, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases;
interviews with Owners, Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency.
• At no time during this process, or during any debriefing, or after any award, will the names of the individuals providing reference information about an Offeror's past performance be revealed to the Offerors or to any other party. If discussions are held, Offerors may be afforded the opportunity to respond to adverse comments made by references in accordance with guidelines identified in FAR Part 15.3. In this case, relevant comments will be extracted and provided to the Offeror.
FACTOR 2 MANAGEMENT APPROACH
Submit this information in the form of key personnel resumes, an organization chart, and schedule narrative. The proposal shall identify key personnel, at minimum:
• Project Manager
• Designer of Record
• Safety Manager
• Design Quality Control Manager
• Construction Quality Control Manager
This should at a minimum include each individuals qualifications for this specific project, years of experience in the position, and how they will fit into the organization chart of this specific project.
The offeror shall identify the construction portion the offeror intends to self-perform and the items to be subcontracted. Subcontractor management approach across all work elements. The narrative shall state why your team is uniquely qualified to undertake this contract, its approach to design and construction.
The offeror must discuss its scheduling capabilities and procedures to be used for this contract, which must include schedule updates, incorporating modifications into the schedule, and other steps to be taken to maintain the construction project schedule.
B. BASIS FOR AWARD (Section M)
The award will be made based on the best overall “Best Value" proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the four (4) evaluation factors: Past Performance, Management Approach, Technical Approach, and Price. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factors (to include all subfactors). Offerors will be cautioned that the award may not necessarily be made to the lowest price/cost offered. NOTE: ALL NON-PRICED FACTORS
COMBINED ARE LESS IMPORTANT THAN PRICE.
C. FACTORS TO BE EVALUATED
The following evaluation factors will be used to evaluate each proposal: Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors described below. The Government reserves the right to make award based upon the Price factor in the event that the Past Performance, Management Approach, and Technical Approach evaluation results of all the offerors’ proposals are substantially the same.

In Phase 1, Factors 1 and 2 are in descending order of importance. After all of the evaluations have been completed, the SSA will consider all factors to determine which Offerors are deemed to be the most highly qualified. The Government’s intention is to select pool of no more than the five (5) most competent and qualified Offerors to move to Phase 2. The Offerors selected to move on to Phase 2, by the SSA, will be given appropriate consideration to the relative strengths, weaknesses, and deficiencies of each proposal. In Phase 2, Offeror’s ratings for Factors 1 and 2 will advance from Phase 1. When combined, all non-technical factors are less important that price.
Factor 1: Past Performance: Each offeror’s past performance will be reviewed to determine recency, relevancy, and confidence assessment.
Factor 2: Management Approach: Each Offeror’s personnel will be reviewed to determine the qualifications and relevant experience to the acquisition.
Factor 3: Technical Approach: Each Offeror’s technical approach will be reviewed to determine the thoroughness of the approach and level of understanding of the project requirements.
Factor 4: The resulting award will be a Firm Fixed Price. Price reasonableness will be utilized in the evaluation of the Firm-Fixed Price effort.
D. EVALUATION APPROACH
All proposals shall be evaluated by the Source Selection Team (SST). The overarching evaluation approach for all factors is as follows:
a. Adequacy of Response. The proposal will be evaluated to determine whether the offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the RFP
b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.
In accordance with the Army Source Selection Supplement (AS3), Section 3.1, the Army methodology for evaluating Technical Approach and Related Risk is the Combined Technical/Risk Rating, (see Table 1 below). This methodology considers risk, in conjunction with the strengths, weaknesses, significant weaknesses, uncertainties, and deficiencies in determining technical ratings.
1. PAST PERFORMANCE
The Offerors must provide a statement that all individuals, including subcontractors, working on this project shall be US Citizens.
For purposes of the Request for Proposal (RFP), an "Offeror" may include a group of two (2) or more entities that have formed a "contractor team arrangement," as that term is defined in the Federal Acquisition Regulation, Part 9.6.
In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently proposed contractor team arrangement, will be considered as a part of the evaluation of the Offeror’s proposal.
In the case of contractor team arrangements involving a prime contractor and subcontractor(s), where the prime contractor submits the proposal in response to this solicitation, the prime contractor must have completed at least fifty percent (50%) of the total number of projects that meet the requirements for Factor 1 for consideration in response to the experience requirements of this solicitation.
An Offeror that relies upon the experience and performance history of a member, members or affiliates of a proposed contractor team arrangement must provide a teaming agreement or commitment (in the case of any affiliates) signed by all parties. The Teaming agreement/ commitment shall:
1. Identify the legal name(s) and cage code(s) of all entities.
2. Describe the nature of each entity's relationship (partnership, joint venture, prime/sub or mentor/protégé) and their role on this project as a part of their proposal. The Offeror will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP.
3. Include the estimated percentage of work to be completed by each member submitted for this RFP.
The following are to be used in determining the status of the Offeror's team for the evaluation of project submissions under Factor 1:
1. In the case of contractor team arrangements involving a Prime Contractor and Subcontractor(s), where the Prime Contractor submits the proposal in response to this RFP, the Prime Contractor is considered the "Prime Offeror".
2. In the case of joint ventures, the "Prime Offeror" experience is limited to joint venture members with signed agreements. The signed Joint Venture agreement must be submitted along with the teaming agreement.
4. In the case of mentor/protégé relationships, the relationship must be established by the two Offerors and approved by the chosen Government Agency prior to proposal submission. The "Prime Offeror" experience is limited to entities with signed agreements. The approved mentor/protégé document from the relevant Government Agency must be submitted along with the teaming agreement.
5. In the case of additional projects submitted by subcontractors, the subcontractor must submit the final cost of their portion of the project along with total project cost and all other required information.
6. In the case of Offerors that are large, multi-function firms (consisting of subsidiaries), experience must only be submitted by the segment of the firm (e.g., division, group, and unit) that is submitting a proposal in response to this RFP.
7. In the case of affiliates, Past performance of an Offeror's "affiliate," as that term is defined in FAR 2.101, will be evaluated (as described within this section) if the Offeror demonstrates a firm commitment that the affiliate will participate meaningfully in the performance of the contract. This commitment and meaningful participation shall be described in a document signed by authorized representatives of both the Offeror and its affiliate.
The contractor team agreement/commitment shall be provided at the beginning of the Offeror's proposal and will not be included in the overall page count. If a teaming agreement or commitment is not provided, the projects of any team members outside of the Prime Offeror will not be considered.
The Government will evaluate the offeror’s record of past and current performance to ascertain the probability of successfully performing the required efforts of the SOW.
a. Evaluation of past performance shall be in accordance with this plan utilizing the forms and questionnaires set forth in Appendix D.
b. The Government will focus its inquiries on the offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including cost, schedule, performance, and management of subcontractors. A significant achievement, problem, or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors will be reminded to include the most recent and relevant efforts (within the past six years) in their proposal. Absent any recent and relevant past performance history or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the offeror will be assigned a “neutral confidence rating” and its proposal will not be evaluated either favorably or unfavorably on past performance. The Government may use data provided by the offeror in its proposal and data obtained from other sources, including data in Government files or data obtained through interviews with personnel familiar with the contractor and their current and past performance under Federal, State or Local government or commercial contracts for same or similar services as compared to the NAICS 236220.
c. Offerors shall submit all Government and/or commercial contracts for the prime offeror and each major subcontractor in performance or awarded during the past 16 months, from the issue date of this RFP, which are relevant to the efforts required by this RFP. The Government may consider a wide array of information from a variety of sources but is not compelled to rely on all of the information available.
d. The past performance factor considers each offeror’s demonstrated recent and relevant record of performance in supplying products and services that meet the contract requirements. There are three aspects to the past performance evaluation: recency, relevancy, and quality.
(i) RECENCY: The first aspect is to evaluate the recency of the offeror’s past performance. Recency is generally expressed as a time period during which past performance references are considered relevant and is critical to establishing the relevancy of past performance information.
(ii) RELEVANCY: The second aspect is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. Relevancy is not separately rated;
however, the following criteria (see Table 2) will be used to establish what is relevant which shall include similarity of service/support, complexity, dollar value, contract type, and degree of subcontract/teaming.
a. Evaluation Strengths will be based on the amount of project experience that meets the General and Unique Experience outlined above.

(iii) QUALITY ASSESSMENT: The third aspect assesses the overall quality of the offeror’s past performance. Documented results from Past Performance Questionnaires, interviews, CPARS, and other sources form the support and basis for this assessment.
e. Performance Confidence Assessment: Utilize the Performance Confidence Assessment to select the most appropriate confidence level for each Offeror. Ensure the rationale for the conclusions reached are included.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
3. MANAGEMENT APPROACH
a. The offeror will submit the qualifications for personnel identified for the: Project Manager, Designer of Record, Safety Manager, Design Quality Control Manager, and Construction Quality Control Manager roles in this project. This can include but is not limited to work experience, special training, past performance, etc. that is relevant to this project. The more personnel that demonstrate experience required the lower the perceived risk.
b. The offeror will submit an organization chart identifying the proposed team that will execute this project.
The proposed organizational chart should identify at a minimum the members identified for these roles (Project Manager Design/Construction Integrator, Designer of Record, Safety Manager, Design Quality Control Manager, and Construction Quality Control Manager) and show the lines of authority and communication for members of the design and construction entities. The clearer the roles and lines of communication are the lower the perceived risk.
c. The offeror must discuss its scheduling capabilities and procedures to be used for this contract, which must include schedule updates, incorporating modifications into the schedule, and other steps to be taken to maintain the construction project schedule. The more capabilities and procedures to handle change orders, supply chain delays, etc. the lower the perceived risk.
d. For the Management Approach the evaluation team will use Technical Risk Rating. Assessment of technical risk, which is manifested by the identification of weakness(es), considers potential for disruption of schedule, increased costs, degradation of performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance.

Low Proposal may contain weakness(es) which have little potential to cause disruption of schedule, increased cost, or degradation of performance. Normal contractor effort and normal Government monitoring will likely be able to overcome any difficulties.

High Proposal contains a significant weakness or combination of weaknesses which is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.
Unacceptable Proposal contains a material failure or a combination of significant weaknesses that increase the risk of unsuccessful performance to an unacceptable level.

For the purpose of this form, a foreign interest is defined as any of the following:
1. A foreign government or foreign government agency;
2. Any form of business enterprise or legal entity organized, chartered or incorporated under the laws of any country other than the United States or its possessions;
3. Any individual who is not a U.S. citizen; or
4. Any form of business enterprise organized or incorporated under the laws of the U.S., or a State or other jurisdiction within the U.S. that is owned, controlled or influenced by one of the entities described in 1, 2 or 3, above.

6. Does your organization, whether as borrower, surety, and guarantor or otherwise, have any indebtedness, liabilities or obligations to a foreign interest?
