FAR Part 16 Exception to Fair Opportunity Justification
Under Multiple Award Indefinite Delivery Contracts
For Actions Exceeding the Simplified Acquisition Threshold (SAT)
1. Contracting Activity
The Contracting activity responsible for this action is the U.S. Army Medical Research Acquisition Activity
(USAMRAA) in support of the Armed Forces Medical Examiner System’s (AFMES).
2. Description of Action
AFMES request a firm fixed price contract to procure Dell/EMC Brand Name only software and hardware support and maintenance to ensure the Dell DD6800 data servers are updated and have continued maintenance coverage over the course of a five (5) year period. Funding is being provided by using funds.
Anticipated award is September 2020.
☒ An acquisition plan is not required because this procurement does not meet the threshold at Defense
Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services
The Armed Forces Medical Examiner System (AFMES) currently possesses two identical Dell DD6800 data deduplication servers for network drive storage with a recent modification of increasing additional storage. It is an
Authority to Operate (ATO) requirement to ensure all equipment has maintenance and technical support. This deduplication backup system and software enables concurrent backups, restores, replication and cleaning processes without the need for a maintenance window and can accommodate the backup and recovery of 90 terabytes (TB) of usable online storage per system and 120TB RAW for both lab and production environments.
AFMES is seeking a contract that includes a base year and four (1) one year option periods as follows:
Base Period: 09/29/2020_ to 09/28/2021_ or Value:
Option Period I: 09/29/2021_ to 09/28/2022_ or Value:

Option Period III: 09/29/2023_ to 09/28/2024_ or Value:

4. Authority Cited
FAR 16.505(a)(4) – Restricting consideration to an item peculiar to one manufacturer (e.g., a particular brand-name, product, or a feature of a product that is peculiar to one manufacturer.
5. Reason for Authority Cited
Maintenance and support is necessary to maintain and hold AFMES’ three (3) year authority to operate (ATO). This device differs from other security appliances by using application signatures in addition to port management as a basis for access control policies. This requirement is to maintain software and hardware support and maintenance to ensure the Dell DD6800 data servers are updated and have maintenance if needed The Data Domain is a disk based data backup solution which provides data deduplication. Deduplication means that if multiple users have the same file stored on a server the Data Domain will only store one "backup copy" of the file which helps to greatly reduce the disk space needed for backup. The procurement of a new system could potentially not synchronize with our current software configurations. Without the data domains in place, the risk becomes running out of disk space necessary to back-up the mission essential records of AFMES.
Only Dell and Dell authorized resellers can provide the level of service required due to the proprietary configurations.
6. Actions to Increase Competition
There are no efforts to overcome barriers to proprietary software and systems other than offering the requirement to certified partners. Device is both on the DoD Unified Capabilities Approved Product List and has been certified for interoperability on DoD networks by the Joint Interoperability Test Command (JITC).

7. Market Research
In accordance with FAR Part 10, market research was conducted in December 2019. AFMES submitted a request for information (RFI) via Solutions for Enterprise-Wide Procurement (SEWP). Several vendors indicated they are re-sellers and can provide the required maintenance and support. Market research validated there are multiple re-sellers within industry that can provide maintenance and support to support the Dell/EMC Brand Name justification.
AFMES is continuously researching options regarding maintenance and support for the current Dell/EMC system to determine the best technical solution at the lowest cost.
