Performance Work Statement

U.S. Army Corps of Engineers Baltimore District

Raystown Lake Project Wildlife Enhancement Services

1.0 Introduction. The U.S. Army Corps of Engineers at Raystown Lake is requesting wildlife enhancement services. Contractors shall be capable of providing services on Federal lands. All work will be performed on the Raystown Lake Project, Huntingdon County, Pennsylvania.

2.0 Background. Raystown is home to numerous wildlife species and it’s the Corps responsibility to manage its lands to benefit these species. The services performed as part of this contract will provide benefits to Raystown’s forest and wildlife resource for years to come.

3.0 General Requirements. The Contractor shall provide all labor, materials, equipment, equipment operators, tools, transportation, and supplies necessary to perform wildlife enhancement services on the Raystown Lake Project in accordance with the specifications contained herein. Services include seedling plantings, tree/shrub plantings, forest mowing, deer fence removal, wildlife habitat structures, vernal pond creation, and hemlock woolly adelgid treatments. There are seven (7) line items. The Contractor must provide a bid for all line items to be considered for award.

The Contractor will not perform wildlife enhancement services under any conditions where the task cannot be completed properly to obtain the Government’s goal. Raystown’s Operation Project Manager (OPM) or Technical Point of Contact (TPOC), based on independent judgment, may halt work based on inappropriate weather.

The Contractor and all Contractor employees shall be subject to the rules and regulations provided in Title 36, Code of Federal Regulations, Part 327, during the performance of this contract. Upon request a copy of these provisions can be provided by the Government.

Any work performed outside the scope of this contract must be negotiated in advance. Failure to acquire advance approval will result in the Contractor not being compensated for the work performed outside the scope.

3.1 Work Task Description. There are seven (7) line items as summarized below. The

Contractor must provide a bid for all line items to be considered for award.

3.1.1 Seedling Plantings.

The Contractor shall provide and plant six thousand five hundred (6,500) seedlings in three (3) locations across the Project. The Government reserves the right to change quantities at each location, but the overall quantity shall not change.

If a species is unavailable or has insufficient quantities, the Contractor may utilize a comparable species, pending Government approval. The Contractor shall provide the Government with a copy of their purchase receipt(s) to serve as proof that the required sizes and quantities of each species was purchased. The Contactor shall notify the Government upon receipt of seedling orders. All seedlings shall be planted within two

(2) weeks of delivery to the Contractor. The Contractor shall notify the Government prior to starting each planting day.

Seedlings shall be planted from April 1 – May 30 and/or October 1 – November 30.

Planting operations shall be performed only during periods when beneficial results can be obtained. When drought, excessive moisture, or other unsatisfactory conditions exist; work shall be stopped until favorable conditions exist. Seedlings shall be set plumb and held in position until sufficient soil has been firmly placed around the roots.

At least two inches of mineral soil should cover the first lateral root. Seedlings shall be planted by placing the root collar at the soil line or no more than 1/2 inch deep. Each seedling should be set firmly in the ground so that it passes the tug test. Soil around the roots should be packed so that there are no air pockets around or adjacent to the roots.

The seedlings shall be planted at minimum 10'x10' spacing. The roots of each seedling must be placed so that they assume a near natural position. The roots must not be twisted (corkscrew). Seedlings shall be planted with a tool capable of opening a vertical hole deep enough to allow proper placement of the roots while avoiding soil compaction. Each seedling should stand erect, perpendicular to the horizontal plane, not perpendicular to the slope of the ground. Spots which are considered unsatisfactory for planting are loose mounds of soil, rotten wood, clumps of dead vegetation, abnormal depressions, or spots in which free water appears in the planting hole.

Maps of the planting locations are in Appendix A.

3.1.2 Tree/Shrub Plantings.

The Contractor shall provide and plant ten (10) 4'-6' evergreen tree species, twenty (20) 4'-6' fruit trees, and twenty (20) – five (5) gallon fruit bearing shrubs in two (2) locations across the Project. The Government reserves the right to change quantities at each location, but the overall quantity shall not change.

Only standard trees shall be utilized, dwarf or semi-dwarf are not acceptable. A list of acceptable species is listed below. A mixture of these species shall be utilized. If a species is unavailable or has insufficient quantities, the Contractor may utilize a comparable species, pending Government approval. The Contractor shall provide the Government with a copy of their purchase receipt(s) to serve as proof that the required sizes and quantities of each species was purchased. The Contactor shall notify the Government upon receipt of tree/shrub orders. All trees/shrubs shall be planted within two (2) weeks of deliver to the Contractor. The Contractor shall notify the Government prior to starting each planting day.

A 24" Coco Mat shall be used for each planting. All plantings shall be fertilized using fertilizer tablets such as Forestry Suppliers’ Fertilizer Tablets 20-10-5 Planting Tablets.

Trees/shrubs shall be planted from April 1 – May 30 and/or October 1 – November 30.

Trees/shrubs shall be set plumb and held in position until sufficient soil has been firmly placed around the roots or ball. At least two inches of mineral soil should cover the first lateral root. The roots must not be twisted (corkscrew). Trees shall be planted with a tool capable of opening a vertical hole deep enough to allow deep placement of the roots while avoiding soil compaction. Each planted tree should stand erect, perpendicular to the horizontal plane not perpendicular to the slope of the ground. Spots which are considered unsatisfactory for planting are loose mounds of soil, rotten wood, clumps of dead vegetation, abnormal depressions, or spots in which free water appears in the planting hole.

A combination of evergreen trees, selected from the following list, shall be used:

A combination of fruit bearing shrubs, selected from the following list, shall be used:

All trees/shrubs shall have a 100% guarantee after one growing season. A survivability survey will be conducted by the Government during the 2024 growing season. All trees exhibiting significant decline or dead trees shall be replaced, at the Contractors expense, with new trees of the original species mixture and in accordance with contract specifications.

3.1.3 Forest Mowing.

The Contractor shall complete approximately 68.85 acres of forest mowing at fourteen

(14) locations across the Project. Forest mowing shall be completed in accordance with the following specifications and Table 3.

a) Equipment to be used for this project must be a forestry type mowing machine with suitable cutting devices such as a “hydroax”, “Fecon”, or other suitable cutting head mounted on a machine capable of negotiating forest terrain. All machines used for this project must be of at least 90hp with high flow hydraulics. The Government reserves the right to reject any piece of equipment, based on independent judgment, which will not safely and adequately complete the job.

b) Vegetation to be mowed consists of nuisance/invasive plants, shrubs, vines, and undesirable trees species under four (4) inches diameter at breast height (dbh).

Desirable tree species such as oaks, hickories, dogwood, and serviceberry may be reserved where possible.

c) Forest mowing shall occur October 1, 2024 – March 31, 2025.

d) The Contractor shall notify the Government, at least one day (24 hours) prior to beginning each unit. The Contractor shall meet with a Government representative onsite before any work begins. The meeting will involve a walkthrough of the unit and review of contract specifications.

e) The Contractor shall notify the Government, within one day (24 hours) after completion of each unit. The Contractor shall meet with a Government representative onsite after completion of each unit. The meeting will involve a walkthrough of the unit and review of contract specifications. Mowing equipment shall not be removed from the unit until work has been inspected and approved by the Government.

f) All vegetation designated for removal shall be completely severed and mulched. The maximum allowable stump height is six (6) inches above ground.

g) Care shall be taken to avoid damage to the residual stand. Preventing residual stand damage is the responsibility of the Contractor. When in the opinion of the Government, damage to the residual stand becomes excessive, the Government may deduct the assessed damage value from the Contractor’s invoice. The value will be determined by the Government.

h) All equipment will be cleaned of soil and debris before being moved onsite, between units, and offsite to prevent spread of invasive species.

i) Forest mowing within fifty feet (50′) of an existing field edge shall also include the following requirements:

a. All less desirable tree species (i.e., black locust, black birch, red maple, blackgum) 4-10″ dbh shall be felled.

b. Felled trees shall be bucked and stacked to create wildlife habitat brush piles. Brush piles shall not exceed 10′x10′x5′ and shall be located a minimum of 25′ from the field edge.

c. Unused limbs and debris shall be forest mowed.

Maps of the forest mowing locations are in Appendix C.

3.1.4 Deer Fence Removal.

The Contractor shall remove approximately 1,207' of deer fence at two (2) locations.

Work shall include removal of all fencing materials (i.e. wire fence, wooden posts, metal posts, metal fencing staples, etc.). All fencing materials shall be properly disposed of offsite. The site is accessible by four-wheel drive vehicle or an all-terrain vehicle. Vegetation intertwined with the fence may be pruned or felled to assist in the removal process. Damage to vegetation shall be kept to a minimum.

Maps of the deer fence removal locations are in Appendix D.

3.1.5 Wildlife Habitat Structures.

The Contractor shall provide and install wildlife nesting structures, 12 bluebird boxes and 10 bat boxes, at various locations across the Project and in accordance with the following specifications:

Bluebird Boxes:

Bluebird boxes shall be made of rot resistant wood (cedar is preferred).

Boxes shall be attached to a metal post a minimum of 5′ in height from the ground.

Boxes shall not be painted or stained.

Four ⅜" diameter holes should be drilled near the top of the box on both sides for ventilation.

Four ⅜" diameter holes should be drilled in the bottom of each box for drainage.

A hinged side or roof should be designed to allow easy access for box maintenance. All metal parts should be stainless steel.

Wood screws are recommended for box construction. Galvanized nails are not permitted.

The box floorboard should be recessed at least ¼" up from the bottom of the sides.

The top of the box should be flush with the sides or be slightly overhanging, with a front overhang of at least 2".

Do not add perches to box designs.

Predator guards shall be installed. Guards should be made of 26-gauge galvanized metal.

Bat Boxes:

Bat boxes shall be ordered from Batmanagement.com, Colony Lodge - Universal 4 Chamber Bat House Green with mounting kit.

The bat box shall be mounted a minimum of 12′ in height from the ground to a wood post (pressure-treated 4" x 6" x 16') cemented a minimum 2' in the ground.

Predator guards shall be installed. Guards should be made of 26-gauge galvanized metal.

The nesting/habitat structures may be installed anytime during the period of performance. Exact locations for installation shall be determined on-site in conjunction with Raystown staff. It shall be the responsibility of the Contractor to coordinate a PA One Call prior to digging to ensure no impact to underground utilities.

Maps of the approximate locations are in Appendix E.

3.1.6 Vernal Pool Construction.

The Contractor shall construct three (3) 30' x 40' x 24" vernal pools in three (3) locations across the Project.

1) Use a dozer to dig a shallow depression in the soil. Make the depression 6 - 8" deeper than the desired water depth so that soil can later be placed over the liner. A small dam may need to be built along the low end of the site to make the outer edge of the vernal pond level.

2) Place a geo-textile pad in the depression. The geo-textile pad protects the liner from puncture by sharp rocks or sticks.

3) Place the synthetic liner on top of the geo-textile pad. Liners must be “fish grade” or “aquatic safe” that do not contain toxic chemicals that kill aquatic life. Liners made of EPDM (ethylene propylene monomer) that is 45 mils thick, or PCV (polyvinyl chloride) that is 30 mils thick will be acceptable.

4) Place another geo-textile pad on top of the synthetic liner.

5) Anchor the top edges of the synthetic liner and geo-textile fabric pads with wire stakes or large nails with washers placed approximately 24" apart. The stakes keep the liner from being pushed down into the depression when it is being covered with soil.

6) Use the dozer to cover the liner with 6 - 8" of soil. The dozer will not harm the liner if it rides on top of the soil that it is pushing over the liner. Avoid turning the dozer while on top of the liner (turns will tear the liner).

7) Seed the exposed area with FACW Wetland Meadow Mix. This seed mix is available through Ernst Conservation Seeds item number ERNMX-122. Mulch the exposed soil to reduce erosion.

Vernal pool construction may occur anytime during the period of performance.

Construction shall be done in accordance with the specifications contained herein and instructions in Appendix F. Exact locations shall be determined on-site in conjunction with Raystown staff. All equipment will be cleaned of soil and debris before being moved onsite, between units, and offsite to prevent spread of invasive species. It shall be the responsibility of the Contractor to coordinate a PA One Call prior to digging to ensure no impact to underground utilities. It shall be the responsibility of the Contractor to conduct a wetland determination to make sure area is not a wetland.

Maps of the approximate locations are in Appendix F.

3.1.7 Hemlock Woolly Adelgid (HWA) Treatments.

Insecticide tablets containing the active ingredient imidacloprid (e.g., CoreTect, which also contains fertilizer) shall be used to treat 1,500 eastern hemlock trees for HWA.

Insecticide tablets are convenient, effective, and protect hemlock trees for up to five years. Release of the active ingredient from the tablet is dependent on adequate soil moisture. Applications can occur when soils are dry in summer, but imidacloprid release requires tablets to be moistened. If soils are dry at the time of application, watering following treatment is required. Do not apply tablets to saturated soils.

Tablets shall be placed 2 - 5" below the soil surface and spaced evenly around the tree within 6 - 24" of the trunk and along the dripline of infested trees at a rate of two to three tablets per inch of DBH. Once placed, the tablets must be completely covered with soil. Do not apply more than 450 tablets per acre per calendar year (0.5-pound imidacloprid). All treated trees shall be marked with a 2″ paint band around the entire bole of the tree at DBH. The Contractor shall use Nelson Aero Spot Marking Paint, Orange-Glo. Trees marked with a pink band were treated in 2023 and shall not be treated as part of the required 1,500 trees.

All treatments shall be performed in accordance with the chemical label and safety data sheet. Treatments shall focus on hemlock stands 3a, 5a, 6, 7, 8, 10, 16, 23, and 26.

Additional stands are available if additional trees are needed to fulfill this contract requirement.

Post treatment the Contractor shall submit a report of all treatments conducted. The report, at a minimum, shall contain tree number, diameter at breast height (dbh) for each treated tree, number of tablets used per tree, and total number of trees treated within each stand.

All treatments shall occur July 1 – October 31, 2023. Treatments shall be performed in accordance with the specifications contained herein.

Maps of treatment locations are in Appendix H.

3.2 Period of Performance. Services provided under this Contract must occur during designated time periods. The period of performance for this contract shall run from date of award – May 2, 2025. The Contractor may complete work tasks from 6:00AM - 6:00PM, Monday through Friday, excluding holidays, unless prior approval is given by the OPM or their representative.

The Contractor shall be prepared to commence activities within fourteen (14) days following approval of all deliverables by the OPM. The Contractor shall not start work until after acceptance of all deliverables listed in 3.5. Actual on-ground activity will be coordinated between the Government and the Contractor.

3.3 Compliance. All work conducted under this contract shall be performed in compliance with all County, State, and Federal laws, and regulations.

3.4 Pre-Bid Tour. Contractors are encouraged to attend a pre-bid tour. The pre-bid tour will be coordinated with the Contracting Specialist and set for 10:00am at the Raystown Lake Visitor Center. POC for the pre-bid tour is Forester, Glenn Werner. Mr. Werner can be reached by phone at (814) 658-6807 or by e-mail at glenn.e.werner@usace.army.mil.

3.5 Pre-Work Conference. The Contractor is required to attend a pre-work conference before commencement of work. The meeting will be held at Raystown at a time that is mutually agreeable to the Contractor and the Government.

The Contractor shall provide the following deliverables, within fourteen (14) days of contract award:

Work Schedule (see Section 4.1) Quality Control Plan (see Section 4.2) Accident Prevention Plan (see Section 6.0) Pre-Screen Candidate E-Verify Program (see section 7.7) Proof of Insurance (see Section 10.0)

All documents must be approved by the Government before work commences.

4 Performance Requirements. The Contractor shall meet requirements established in the PWS, specifically Technical Exhibit 1, Performance Requirements Summary and within the timeframes required in Technical Exhibit 2, Deliverables Summary.

4.1 Work Schedule. The Contractor shall establish a work schedule outlining the order of all work performed under this contract, including dates and estimated times, for the OPM’s approval within 14 days of award. Variations from the schedule more than three days must be approved before work can continue. The schedule shall be resubmitted when variations of more than five days occur. This schedule will be used in part to provide a fair and accurate inspection of work. All schedules, or subsequent revisions, must be approved by the Government before work commences.

4.2 Quality Control Plan. The Contractor shall establish a quality control plan for the performance requirements of this contract and shall provide for the OPM's approval a written detailed copy within 14 days of award. The contractor shall maintain the quality control plan throughout the contract and submit to the government if any changes are made for concurrence. The Contractor shall provide a signed letter to the OPM designating the name(s) of the Contractor’s QC(s) who will be physically present on site with authority and power to conduct all overall management, coordination, and supervision whenever work specified herein is being performed. This letter shall also include the QC(s) schedule(s) of work and contact information. All plans, or subsequent revisions, must be approved by the Government before work commences.

5 Government Provided Materials.

5.1 EM 385-1-1. Upon request by the Contractor, the Government shall provide a “Safety and

Occupational Health Requirements”.

5.2 Keys. Keys will be provided to the Contractor by the Government for executing the duties of this contract per Section 7.

5.3 GIS/Maps Files. Upon request by the Contractor the Government will provide maps and/or GIS files for all line items. In addition, other shapefiles such as aerial photography, topography, project boundary, project gates, project roads, trail systems, etc. can be provided.

6 Safety. The Contractor and Contract employees shall meet all applicable requirements of U.S.

Army Corps of Engineers Manual EM 385-1-1 dated 15 March 2024 entitled Safety and Occupational Health Requirements (https://www.usace.army.mil/SafetyandOccupationalHealth/SafetyandHealthRequirements Manual.aspx), OSHA Regulations, and all State and Local safety codes while in performance of this contract.

6.1 Accident Prevention Plan. The Contractor shall develop and submit a written detailed

Accident Prevention Plan in accordance with EM 385 1-1, specifically Chapter 2, Safety and Occupational Health Program for Contractors. The APP shall document site-specific policies, responsibilities, and plan and program requirements. A signed letter of certification which references the contract and current year and states if the original plan remains current (or lists changes if applicable) is acceptable following the base year. All plans, or subsequent revisions, must be approved by the Government before work commences.

6.2 Site Safety and Health Officer. The Contractor shall designate a SSHO. The SSHO is a contractor employee that is responsible for overseeing and ensuring implementation of the prime contractor’s SOH program according to the contract, this manual, applicable federal, state, and local requirements.

6.3 Reporting. The Contractor shall maintain an accurate record of, and report to the OPM exposure data. All accidents resulting in death, traumatic injury, occupational disease, and damage to property, materials, supplies and equipment incident to work performed under this contract will be documented utilizing ENG Form 3394.

6.4 The Contractor shall observe all speed limits and other posted traffic signs in the operation of vehicles and equipment. Trucks or other vehicles will be operated in a safe manner and will not be parked in unsafe positions.

7 Security. The Contractor and Contractor employees will ensure all gates and other areas will be secured, in the way they were encountered, upon vacating the area.

7.1 Keys. If deemed necessary, a key will be provided to the Contractor to access areas exclusively for the performance of this contract. The key shall be returned to Government after all work tasks have been completed. If the key is not returned to the Government $300 will be deducted from the Contractor’s final invoice.

7.2 Restrictions. Any use of Government keys other than for the performance of this contract is strictly prohibited. Making or being in the possession of duplicate keys is prohibited.

Misuse of keys is grounds for dismissal of Contract employees or termination of the contract.

7.3 Loss. Any loss of keys will be reported to the Government within 24 hours. Any loss of the keys and/or failure to report the loss may result in the forfeiture of the key deposit and accepting the burden of reestablishing the integrity of the project lock and key system.

7.4 Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce shall comply with all personal identity verification requirements as directed by DOD/HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

7.5 Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something). The Contractor shall receive a briefing/training (provided by the OPM) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the Project manager or his/her authorized representative. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the OPM NLT five calendar days after the completion of the training.

7.6 Escorts. The Contractor shall coordinate with the OPM and/or the facility security office for access when required. All contract employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

7.7 Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the OPM within 14 days of award.

8 Personnel.

8.1 Contractor Personnel. A list of all employees required to satisfactorily perform the requirements of this contract shall be furnished by the Contractor. The Contractor shall provide adequate supervision of his/her employees to ensure compliance with contract specifications.

8.2 Requirements. All Contract employees must meet the following requirements prior to starting and during the performance of this Contract.

U.S. CITIZEN: Contract employees must be citizens of the United States of America, be an alien under lawful admittance for permanent residence as evidenced by an Alien Registration Receipt Card (Form 1-151) or be able to present other INS evidence that employment will not affect his/her immigration status.

AGE: Contract employees must be at least 18 years of age.

DRIVERS LICENSE: Contract employees must possess a current driver’s license valid in the Commonwealth of Pennsylvania.

GENERAL: Contract employees must be in good health. The Contractor shall insure on-site representative(s) ability to communicate in the English language.

8.3 Misconduct. The Government reserves the right to dismiss Contract employees or terminate the contract for failure (single or repetitive) to meet any of the requirements and standards contained herein; or which causes discredit to the Government or Contractor, as determined by the OPM.

8.4 Behavior. The Contractor and Contract employees will hold themselves to the standard of acceptable behavior expected of the public and to all rules and regulations for Government property and facilities, while on project lands and/or in performance of Contract duties.

The OPM reserves the right to deem any behavior not addressed herein as unacceptable.

8.5 Drugs and Alcohol. Contract employees shall not use or be under the influence of drugs or alcohol at any time while in the performance of the contract.

8.6 Government Personnel. Government employees may be in close proximity to the Contractor’s designated area of work. The Contractor shall cooperate fully with all Government employees and shall not impede the work of others in any way.

9 Quality Assurance. The Government Quality Assurance Surveillance Plan (QASP) is subject to change during the life of this contract and the Contractor will be made aware of any changes. The quality assurance plan referenced below is included for information purposes only.

9.1 Inspections. The Government will inspect the Contractor’s services to assure the requirements of the contract are provided as specified, with deficiencies brought to the attention of the Contractor. The Government has the right to inspect and test all services called for by the contract, to the extent practicable, and places during the term of the contract. The Government will perform inspections and tests in a manner that will not unduly delay the work.

9.2 Re-Inspection. Should it become necessary for the QA to perform re-inspections of defective work that was required to be redone and was not performed (due to failure of the

Quality Control system), the Government may withhold payment for the service that was not performed and document the Contractor’s performance as unsatisfactory.

9.3 Methods. The Government will monitor the Contractor’s services using the planned sampling method. The frequency of inspection will vary from not less than 25% of the work accomplished to 100%.

10 Insurance Requirements.

10.1 Required Insurance. Contractor shall provide insurance pursuant to the contract clause entitled, 52.228-5, Insurance – Work on a Government Installation. The Contractor shall procure and maintain the required insurance during the entire period of performance under the contract, following minimum insurance:

10.2 Documentation. Prior to the commencement of work, the Contractor shall furnish to the OPM a current certificate or written statement of insurance requirements of the contract.

Policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in policies adversely affecting the interests of the Government in such insurance shall not be effective for such period as may be prescribed by the Laws of the State in which this contract is to be performed and in no event less than thirty (30) days after written notice thereof to the Contracting Officer. Additionally, said policies shall list the Government as additionally insured.

11 Inspections, Deductions, and Default.

11.1 Inspections. All work shall be performed in an orderly fashion consistent with the specifications as outlined in this PWS. During the execution of the contract the OPM’s representative will conduct inspections of all wildlife enhancement services to determine applicable performance requirements, as outlined in Section 9, are being met. The Contractor will provide a letter stating that all work tasks have been completed in accordance with the contract requirements. Once the OPM receives this letter a final inspection of will be documented and an evaluation of timeliness and efficiency will be performed at this time.

11.2 Deficiencies. If any of the services, in any measure, do not conform with contract requirements the Government may require the Contractor to perform the services again in conformity with contract requirements, at no increase in contract amount. When defects in services cannot be corrected by re-performance, the Government may require the Contractor to take necessary action to ensure that future performance conforms to contract requirements, at no increase in contract amount.

11.3 Deductions. If the Contractor fails to correct defects by re-performance and/or take the necessary action to ensure future performance in conformity with contract requirements in a timely fashion the Government may, by contract or otherwise, perform the services and charge to the Contractor any cost incurred by the Government that is directly related to the performance of such service. These charges will be deducted from the Contractor’s next invoice (FAR52.246-4). The Contractor shall be provided an itemized breakdown of each deduction made.

11.3.1 The Contractor shall be responsible for repairing or replacing damaged property to the satisfaction of the OPM due to Contractor negligence.

Repairs or replacement of damaged property must be made within seven days or less of the incident. The Government will make all necessary repairs or replacement of damaged property and all costs associated with said repairs or replacement will be deducted from the next invoice received from the Contractor.

11.3.2 Default of the contract shall be considered for various reasons relating to nonperformance of the contractual specifications. Following is a partial listing of reasons for which default may be considered:

Repetitive failure to adhere to contract specifications Repetitive deductions for non-performance Repetitive safety violations Repeated abuse of key privileges Excessive cases of damage to Government or private property Excessive cases of substantiated public complaint

12 Invoices and Payment.

12.1 Invoices. For line items 1 and 3 – 7, the Contractor shall submit an itemized invoice after completion of the line item. For line item 2, the Contractor shall submit an itemized invoice for 75% of the bid price after completion of the line item. The Contractor may invoice for the remaining 25% of the bid price pending 100% survivability at contract end date of May 2, 2025.

Invoices shall accurately reflect work completed. Each invoice, at a minimum, shall contain the following information:

• Contractor name and address (exactly as it appears on the contract)

• Contract number

• Date of invoice submission

• Invoice number

• Line Item (wildlife enhancement task completed)

• Invoice total

12.2 Corrections.

Incorrect invoices will be returned to the Contractor for correction before processing payment. Corrected invoices shall be re-dated to reflect the new submission date

12.3 Remittance.

Invoices shall be submitted via post-mail and/or electronic mail to the following addresses for payment. Should changes occur to the mailing addresses the Contractor shall be notified.

Technical Exhibit 1 - Performance Requirements Summary

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

The Government will perform a 100% review of the Accident Prevention Plan, including review by USACE Safety Officer, to ensure it meets the requirements set forth in

EM 385-1-1.

PRS#4

The contractor shall comply with all safety requirements set forth in the Accident Prevention Plan.

The contractor shall follow the standard established in PWS Section 6 and EM 385-1-1.

The maximum quantity of safety violations is 3 violations during the period of performance.

The Government will document all safety violations. The Government reserves the right to halt work when the performance threshold is exceeded.

PRS #5

The contractor shall not abuse key privileges.

The contractor shall follow the standard established in PWS Section 7.

The maximum quantity of key violations is 3 violations during the period of performance.

The Government will document findings and report abused key privileges. The Government reserves the right to halt work when the performance threshold is exceeded.

PRS #6

The contractor shall procure and maintain insurance.

The contractor shall follow the standard established in PWS Section 10.

Submission shall be within 14 days from the award date and any discrepancies shall be corrected within 3 business days, with no work being accomplished until the Insurance is approved by the Government.

The Government will perform a 100% review of Insurance to ensure it meets the requirements set forth in PWS Section 10.0.

PRS#7

The contractor shall not damage Government property.

The contractor shall follow the standard established in PWS Section 11.

The maximum quantity of damages to Government property is 3 violations during the period of performance.

The Government will document all damages to Government property and requests for corrective action.

The Government reserves the right to halt work when the performance threshold is exceeded.

PRS #8

The contractor shall adhere to all contract specifications.

The contractor shall follow the standard established throughout the PWS.

The maximum quantity of failure to adhere to all contact specifications is 3 violations during the period of performance.

The Government will document all deficiencies and requests for corrective action.

Failure to adhere to specifications may result in non-payments, partial payments, and/or documented unsatisfactory performance. The Government reserves the right to halt work when the performance threshold is exceeded.
