SECTION C
PERFORMANCE WORK STATEMENT
MITER GATE CYLINDER REHAB
C-1. SCOPE. These Specifications cover all labor and materials necessary for rebuilding two hydraulic miter gate cylinders including disassembly, examination, replacement and fabrication of components, re-assembly, testing, painting, pickup and delivery. The hydraulic cylinder is a miter gate operating cylinder used at Winfield Locks and Dam and is to be installed by others. The cylinder dimensions are in metric units with standard units used only as reference. The cylinder bore is 450 mm (17.717”) with a 280 mm (11.024”) diameter piston rod.
The stroke is 4256 mm (13’-11.559”) with an overall rod length of 5413 mm (17’- 9.108”). Working pressure is 2000 psi and the test pressure is 3300 psi. Drawing 3-032193 Rev. 09 will be used as reference for component dimensions and assembly. The document labeled “INSTRUCTION MANUAL” provides descriptions of the parts that make up the cylinder and the part numbers coordinate with those shown on the drawing. Both the drawing and instruction manual are included as attachments to this scope of work
The following list specifies the minimum which shall be required by the contractor. Any defects that are found during, and after, disassembly will be brought to the attention of the Government representative. No work outside the initial scope will be performed until a modification and cost is agreed upon by the Government. The Government reserves the right to inspect the work at any time.
Disassemble cylinders making certain all components are marked and kept with the associated cylinder tube.
Inspect disassembled cylinder tube and components for defects Remove/Replace all seals (piston, rod gland, wipers, etc.) including piston wear bands. Seals and rod gland packing shall be Chesterton or equal.
Remove/Replace all O-ring type seals Remove/Replace all fasteners Remove/Replace pressure test fittings at each end of cylinder
Fabricate new piston rods from Stainless Steel with Chrome overlay.
The piston rods shall be ground, polished and machined from a single piece of stainless steel comparable to 17-4PH (ASTM A564, Type 630, Condition H1150). The piston rod shall be hard chrome plated to a thickness of not less than 0.003 inch after machining. The plating shall have a minimum hardness of 50 Rockwell “C”. Provisions such as the spanner wrench holes shown on the drawings shall be made to allow for holding the rod, to prevent rotation while installing or removing the eye and piston.
Fabricate clevis with new aluminum bronze bushings according to Drawing 3-032193 Rev. 09 and Drawing 023-L1A-6-22/9 (QTY. 2, One for each piston rod)
Fabricate and install new aluminum bronze bushings in trunnion according to Drawing 3-032193 Rev. 09.
Hone cylinder bore Assembly: Government representative shall be present during assembly.
Pressure Test each cylinder according to Government specifications.
Paint: Original paint coating is a three-coat epoxy system (primer coat, intermediate coat and topcoat that is epoxy/polyurethane) Name plates: Existing name plates shall remain on each cylinder. C-3. MATERIALS. Materials shall be as hereinafter specified. Materials not specified shall be the manufacturer’s standard for the application. All equipment shall be new. The materials of construction used shall be new, manufactured within the time period not exceeding one year prior to delivery, and of kind, composition, and physical properties best adapted to its several purposes in accordance with best engineering practice.
C3.1 Spare Parts. No spare parts are requested for this contract. However, a list of parts that were replaced shall be provided and include brand name, description, item or model number listed by the manufacturer, and quantity.
C-3.2 Protection of Materials and Equipment. The Contractor shall be responsible for the proper handling, maintenance, storage and protection of all materials until delivered and accepted at the location shown in SECTION
F - DELIVERIES OR PERFORMANCE.
C.4 Special Environmental Requirements. No special requirements are associated with this contract.
C-5. Quality Control The Contractor shall establish and maintain a quality control system to assure compliance with the contract requirements and shall maintain records of his quality control of all operations covered by these specifications. Quality control records shall be made available to the Contracting Officer upon request.
C-6. Protection of Finished Machined Surfaces.
C-6.1 Finished surfaces shall be thoroughly cleaned of foreign matter. Finished surfaces of large parts and other surfaces shall be protected with wooden pads or other suitable means.
C-6.2 Finished surfaces of ferrous metals to be in bolted contact shall be washed with an approved rust inhibitor. Exposed machine finished surfaces shall be thoroughly cleaned of foreign matter. All unpainted machine finished surfaces shall be protected by a suitable rust inhibitor satisfactory to the Contracting Officer, for shipping and storage protection. Finished surfaces of ferrous metals, which will be exposed after assembly, except as noted, shall be painted as specified in paragraph C-8, PAINTING.
C-7. SHOP TEST
C-7.1 Hydraulic Oil. Prior to testing, hydraulic oil shall be added to the cylinder. Only clean oil meeting an ISO cleanliness code of 18/16/13 shall be used in the shop test. The Contractor shall take all precautions when filling the system, to keep the oil clean, free of chips, grit, water, sludge, coolants, sealing compounds, and other foreign matter. All oil shall be handled in clean containers and introduced into the system through a 10-micron absolute filter. After filling, the Contractor shall bleed all air from the system. No operating or testing shall be done until the complete hydraulic system, is completely free of air. Oil to fill the system shall be premium-quality petroleum base hydraulic oil, which shall give maximum lubrication and protection to the cylinder. The oil shall be a highly refined, stable base oil with adequate anti-wear additive, oxidation and corrosion inhibitor, vapor phase inhibitor, and foam suppressant. The oil shall have an ISO viscosity grade of 32. Hydraulic oil shall be Chevron Oil Rando AW32.
C-7.2 Hydraulic Cylinder Test. The cylinder shall be reassembled and tested in the presence of the
Contractor’s Officer’s representative following the completion of all repairs. The hydraulic cylinder, with the piston rod extended, shall be subjected to a test pressure of 3000 pounds per square inch for a period of 30 minutes and there shall be no leakage across cylinder heads. Testing of leakage across the piston seal shall be accomplished with the piston rod in the extended position for 15 minutes at a test pressure of 2,000 psi. The leakage rate across the piston shall not exceed 1.5 ounces for the test. The same two (2) tests (at 3000 and 2,000 psi) shall be repeated, with the piston rod retracted. There shall be no leakage through the rod seal packing when the cylinder is under the test pressure. The Contractor shall demonstrate that the breakaway pressure does not exceed 50 psi. The cylinder piston leakage rate tests and the breakaway pressure test as specified shall be conducted in a manner meeting the approval of the Contracting Officer. The cylinder shall be operated through 5 complete cycles at rated speed to demonstrate that it is suitable for the purpose intended. Operation shall be smooth and quiet without any vibration. The cylinder shall be 100 percent leak-proof. Detailed test procedures shall be submitted to the Contracting Officer for approval.
C-8. PAINTING.
C-8.1 General. Except as hereinafter described, all surfaces of all parts of the operating cylinder shall be finish painted in the shop with at least three coats of epoxy-polyamide paint conforming to SSPC-Paint 22. Color shall be light gray. Paint shall be applied primarily through use of conventional spray except where in areas that are difficult to apply proper coverage with spray, in which case paint shall be applied by brush. Paint shall be applied prior to final assembly, taking care to protect machined surfaces. After final assembly, a final coat of paint shall be applied. Dry film thickness per coat shall be within plus or minus 20 percent of that recommended by the manufacturer.
C-8.2 Surface Preparation and Paint Application. Surfaces to be painted shall be clean before applying paint or surface treatments. The removal of oil and grease shall, in general, be accomplished with mineral spirits or other low-toxicity solvents having a flashpoint above 100 degrees Fahrenheit before any mechanical cleaning is started. Solvent cleaning shall be done with clean cloths and clean fluids to avoid leaving a thin film of greasy residue on the surfaces being cleaned. After solvent cleaning, surfaces shall be prepared by commercial blast cleaning in accordance with SSPC-SP 6, prior to painting except as herein specified. Cleaning and painting shall be so programmed that dust or other contaminants from the cleaning process do not fall on wet, newly painted surfaces, and surfaces not intended to be painted shall be suitably protected from the effects of cleaning and painting operations. Welding of, or in the vicinity of, previously painted surfaces shall be conducted in a manner to prevent weld spatter from striking the paint and to otherwise reduce coating damage to a minimum; paint damaged by welding operations shall be restored to original condition. The cylinder shall be protected against entry of blast abrasive and dust into working parts. Surfaces to be painted that will be inaccessible after construction, erection, or installation operations are completed shall be painted before they become inaccessible. Blast cleaning of other components shall be done prior to assembly. Machine finished surfaces shall be protected during any blast cleaning processes. The cylinder shall be assembled prior to painting except as herein otherwise allowed. When bolted contact exists between surfaces of metal parts, such surfaces will not be required to be painted, but any resulting crevices shall subsequently be filled or sealed off with paint.
C-8.3 Parts or Surfaces Not Painted. Paint shall not be applied on corrosion-resistant parts and finished machine surfaces in bolted contact. Unpainted finished machine surfaces shall be protected as specified in paragraph C-6, Protection of Finished Machined Surfaces.
C-8.4 Preparation for Shipment. After paint has been applied, the operating cylinder shall be prepared for shipment in accordance with the requirements of SECTION D - PACKAGING AND MARKING. Prior to shipment, the manufacturer shall clean and flush the cylinder and fill it to 80% of its capacity with oil meeting the requirements hereinbefore specified. If shop air is used on the cylinder, moisture shall be removed by means of a moisture trap, dryer, or other approved means to eliminate entrance of water into the cylinder.
C-9. WELDING.
C-9.1 General. Two (2) fabricated clevis assemblies for the ends of the piston rods shall be welded and machined according to Drawing 3-032193 Ref. 09. Material shall be a high strength low alloy steel or a forging equivalent conforming to ASTM A668, Class H. Welding, to include but not limited to welding equipment and materials, operations, procedures, process, qualifications, workmanship, technique, shall be in accordance with AWS D1.1.
C-9.2 Qualifications. The names of welders and proof of their AWS D1.1 qualification for the type of welding and position of welding must be submitted to the government for approval. The certification must state the type of welding and positions for which the welder is qualified, the code and procedure, the date and name and person certifying the qualification test(s).
C-9.3 Welding equipment and materials. All welding equipment, electrodes, welding wire, and fluxes must be capable of producing satisfactory welds and shall comply with requirements of AWS D1.1.
C-9.4 Welding process. Welding shall be by an electric arc welding process using a method which excludes the atmosphere from the molten metal and shall conform to applicable provisions of AWS D1.1. Welding shall be as such to minimize residual stresses, distortion and shrinkage. The electrode, electrode-flux combination and grade of weld metal shall conform to the appropriate AWS specification for the base metal and welding process being used.
Preheat and interpass temperature shall conform to requirements of AWS D1.1, section 3.5. Welding Procedure Specification (WPS) shall be submitted for approval prior to commencing welding (prequalified WPS in accordance with AWS D1.1 are sufficient). Preheat and interpass temperature shall be as required in articles 5.6 of AWS D1.1 but in no case shall be less than 70 degrees F.
C-9.5 Nondestructive Examination. The contractor shall perform 100 % ultrasonic testing on the clevis welds. The testing must be performed by an agency qualified in such NDT and must be made with applicable provisions of ASTM E165. Results of NDT testing must be submitted to the contracting officer for approval. Welds shall be considered unacceptable if shown to have defects prohibited by article 4.9 of AWS D1.1 or possess any degree of incomplete fusion, inadequate penetration, or undercutting.
C-9.6 Repairs. Defective weld metal shall be removed by air carbon arc or oxygen gouging to sound metal.
Cavities shall be rewelded in compliance with AWS D1.1, 3.7. Welds that have been repaired shall be retested by the same methods as original inspection. All costs of repairs and retesting shall be borne by the Contractor.

SECTION D
PACKAGING AND MARKING
D-1. PACKAGING AND MARKING. The cylinder shall be shipped completely assembled. The cylinder shall be shipped 80% full of oil as hereinbefore specified. The piston rod shall be in the fully retracted position and the exposed piston rod end shall be properly protected for shipping and storage. All machined surfaces shall be protected with wooden blocks, wooden pads or other suitable means as approved by the Contracting Officer.
Parts damaged in handling, packaging, loading, shipping or loading shall be repaired or replaced as directed by the Contracting Officer at no additional cost to the Government.
SECTION E
INSPECTION AND ACCEPTANCE
E-1. INSPECTION. The work will be conducted under the general direction of the Contracting Officer and is subject to inspection by his appointed inspectors to ensure strict compliance with the terms of the contract.
Materials furnished under these provisions shall be subject to inspection during and after the process of manufacture at the place of manufacture by authorized Government inspectors who shall be afforded proper facilities for determining compliance with these specifications. Any part of the repairs not in compliance with these specifications will be rejected and the Contractor shall promptly remedy or replace the defective part or parts to the satisfaction of the Contracting Officer. All final shop assemblies required to be performed will be witnessed by a Government appointed inspector. The Contractor shall keep the Contracting Officer informed as to the general progress of the work and shall notify the Contracting Officer in writing, five (5) calendar days prior to the time when the miter gate cylinder is ready for final assembly and testing. The miter gate cylinder shall be inspected for conformance with the specifications prior to loading for shipment.
E-2. FINAL EXAMINATION AND ACCEPTANCE. The equipment will be inspected and checked at the point of delivery for quantity and damages from transportation. Any such loss or damage will be remedied by the Contractor at no additional cost to the Government. Upon completion of satisfactory inspection at both the Contractor's plant and point of delivery, the equipment will be accepted on behalf of the Government.
SECTION F
DELIVERIES OR PERFORMANCE
F-1. PERFORMANCE. The Contractor will be required to complete work under this contract within fifty
(50) calendar days after the day of receipt by him of Notice of Award. The Contractor will provide equipment and labor suitable for unloading the cylinder at Winfield Locks and Dam. The Contractor shall coordinate his pickup/delivery plans as indicated in F-2, to ensure Government furnished loading handling equipment is available.
F-2. DELIVERY. The Contractor is responsible for transporting the cylinder to/from Winfield Locks and Dam 170 Lock Rd. Redhouse, WV 25168 to the contractor’s facility. Pickup/Delivery dates need to be coordinated with USACE (Scott Kinzel 304-399-6973 or Robert.S.Kinzel@usace.army.mil). The Contractor shall give ten (10) calendar days notification before pickup/shipment of the cylinder to allow coordination of loading/unloading equipment at the site.
F-3 LOADING/UNLOADING. The Contractor is responsible for the loading/unloading equipment that will be used to load/unload the cylinder at Winfield L/D and at their facility. The contractor is responsible for securing the cylinder for shipment both to/from facilities (see D-1). The contractor shall place the rebuilt cylinder on the storage racks upon delivery. (See photograph of storage rack)
Weight of the Cylinder is approximately 16,000 lbs. with clevis attached to the piston rod. Clevis weighs approximately 1000 lbs.
Government Furnished Property. The Contractor will be provided cylinders to repair for the USACE, and will be held responsible for losses due to its negligence and for the replacement of such items. The Contractor shall ensure Government furnished cylinders are utilized only for contract purposes, and that the Contractor shall be responsible for their security. Upon completion (including any extensions of contract term) or termination of the contract for any reason, the Contractor shall return all Government cylinders in the same condition as received. Any discrepancies in the inventory shall be chargeable against the Contractor. The Contractor shall be required to sign a Property Control Receipt, ENG 4900 or 4866, for all Government equipment when furnished. Property is to be furnished in an “as-is” condition, and will be inspected upon pick-up and then inspected again upon delivery. This inspection should be signed off on by the Government and Contractor. See also GFP Attachment.

SECURITY REQUIREMENTS
All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) personal information to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee’s suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results of the background investigation provided by the Huntington District Security Management Office. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.
FOR ALL CONTRACTS 1-YEAR AND SUBSEQUENT OPTION YEARS:
Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities.
The Contractor must also provide the following: (1) Name of the Contract Specialist with whom he/she is working,
(2) Project Name, (3) Contract Number (4) Task Order Number when applicable, and (5) Security Information sheet on each employee working on site must be submitted directly to the Huntington District Security Office.
The Contractor must provide a full legal name, complete SSN#, Date of Birth, Place of Birth (City and State) and Driver’s license number if available. It is the Contractor’s responsibility to ensure the above information is accurate and legible, otherwise delays may occur.
Contractors shall have background checks completed for their employees annually in the case of Contracts with option periods. For instance, if the employee was cleared in May of 2018, they shall be cleared again in May of 2019. It is the Contractor’s responsibility to ensure that each employee’s security is up to date. Failure to comply may lead to possible removal from the project/jobsite.
The Contractor must ensure if new employees are brought in to work on an existing Contract with the U.S. Army Corps of Engineers (USACE), they must process the employee through the Huntington District USACE Security Management Office for background purposes.
FOR CONTRACTORS REQUIRING DOD COMMON ACCESS CARDS (CAC)
The documents listed below are required:
SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form). FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management Office).
Contractor shall report any changes in personnel, or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.
Following submission of paperwork, the Huntington District Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, the Huntington District Security Management Office will make recommendations to the PCO or their Designated Representative. The Huntington District Security Management Office cannot give approval due to unfavorable report(s). The Huntington District Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise the Contractor of the decision.
FOREIGN NATIONALS
The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters staff to complete. All Foreign Nationals must comply with the following paragraph:
In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following: a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.
In order to assure forms are properly completed, and to minimize time delays, the Contractor is encouraged to work closely with the Huntington District Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.
Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

AT-OPSEC Requirements
General security requirements and guidance: The security requirements described below apply to all contract personnel (including employees of the prime Contractor (“Contractor”) and all subcontractor employees) supporting the performance requirements of this contract. The Contractor is responsible for compliance with these security requirements. Questions regarding security matters shall be addressed to the designated Government representative (e.g., Contracting Officer Representative (COR), Requiring Activity (RA) representative, or Contracting Officer (if a COR or other RA representative is not appointed)). Contract personnel are critical to the overall security and safety of US Army Corps of Engineers (USACE) installations, facilities and activities, and security awareness training contributes to those efforts. The Department of Defense (DoD) and Army security training requirements specified below, if applicable, are performance requirements; all applicable contract personnel shall complete initial training within 30 days of contract award or the date new contract personnel begin performance on the contract. Within five business days from the completion of training, the Contractor shall provide written documentation (e.g., email or memorandum) to the Government representative. The documentation shall include the names of contract personnel trained and which training they completed; the Contractor shall maintain training records as part of their contract files and be prepared to provide copies of training certificates to the Government representative. Contractor personnel and vehicles are subject to search when entering federal installations. Additionally, all contract personnel shall comply with Force Protection Condition (FPCON) measures, Random Antiterrorism Measures (commonly referred to as “RAMs”), and Health Protection Condition (HPCON) measures. The Contractor is responsible for meeting performance requirements during elevated FPCON and/or HPCON levels in accordance with applicable RA plans and procedures --this includes identifying mission essential and non-mission essential personnel. In addition to the changes otherwise authorized by the changes clause of this contract, should the FPCON or HPCON levels at any individual facility or installation change, the Government may implement security changes that affect contract personnel. The Contractor shall ensure all contract personnel are aware of their security responsibilities, including any site-specific requirements identified in local policies or procedures.
Suspicious Activity Reporting training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): All contract personnel shall receive initial and annual refresher training from the RA representative on the local suspicious activity reporting program. This locally developed training provides contract personnel with general information on suspicious behavior, and guidance on reporting suspicious activity to the project manager, security representative or law enforcement entity.
Pre-screen candidates using E-Verify Program: Contractors shall comply with the requirements set forth in FAR clause 52.222-54 Employment Eligibility Verification and FAR Subpart 22.18 in using the E-Verify Program at (https://www.e-verify.gov/) (website subject to change) to meet the contract employment eligibility requirements.
Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102-1(i). An initial list of verified/eligible candidates shall be provided to the COR no later than three business days after the initial contract award. When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, and submit it to the Contracting Officer to become part of the official contract file.

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (NOV 2021)
(a) Definitions. As used in this clause--
Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
Safeguarding means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.
(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
