PERFORMANCE WORK STATEMENT

Walhonding Area Specifications For

Herbicide Spraying

CONTRACT INTENT:

The Corps of Engineers Walhonding Area’s intent is to limit exposure of pesticide chemicals to Contractor Personnel, Project Personnel, Public Visitors, and the local wildlife so required Dam Safety inspections of the areas may be maintained. The Corps of Engineers has a priority interest that of environmental protection as well as personnel, while working within the considerations of available Government resources.

The Corps of Engineers requires each project to be treated only ONCE per growing season and have a continuous foliage kill for the whole season at the selected sites. The contractor shall not treat areas with more than the manufacturer’s recommendations for a single dose or season.

GENERAL INFORMATION:

These specifications are for the application of herbicide at the following Walhonding Projects located within the Muskingum Area. The following is where the project office is located:

Charles Mill Dam – 2203 St. Rt. 603 Lucas, Ohio 44843-9606 Mohawk Dam – 36007 State Route 715 Warsaw, Ohio 43844-9534 Mohicanville Dam – 2297 CR 175 Lakeville, Ohio 44638-9610 North Branch of Kokosing Dam – 18350 Waterford Rd., Fredericktown, Ohio 43019 Pleasant Hill Dam – 1041 CR 3006 Perrysville Ohio 44864-9782

Chemical Salient Features:

Pesticide #1, for the control or destruction of many herbaceous and woody plants – A non-selective broad spectrum systemic herbicide for control of annual and perennial weeds and woody plants in

- Conservation Reserve Program (CRP), rangeland, and permanent grass pastures;

- Forest sties, conifer plantations, airports, barrow ditches, communication transmission lines, electrical power and utility rights-of-way, fencerows, gravel pits, industrial sites, military lands, mining and drilling areas, non-irrigation ditch banks, oil and gas pads, ornamental sites, parking lots, petroleum tank farms, pipelines, railroads, roadsides, storage areas, storm water retention areas, substations, unimproved rough turf grasses, sod or turfgrass seed farms, vacant lots, and other non-crop residential areas;

- Natural areas (open space) for example campgrounds, parks, prairie management, trails, and trailheads, recreation areas, wildlife openings and wildlife habitat, and management areas;

- In and around seasonally dry wetlands;

- Including grazed areas on all of these listed sites.

Pesticide #2, for bare ground treatment for post-emergence – A pesticide for control of undesirable vegetation on forestry sites, pasture, rangeland, and industrial noncropland areas including railroad, utility, pipeline, highway rights of way, utility plant sites, petroleum tank farms, pumping installations, storage areas, non-agricultural fence lines, non-irrigation ditchbanks, road rights-of-ways, transmission rights-of-way, and industrial bareground areas, and for the establishment and maintenance of wildlife openings.

Pesticide #3, for broadleaf vegetation control where trees and grass are to be left unaffected. Product used will be for the control of woody plants, broadleaf weeds in range and pasture, forests and non-crop areas, including manufacturing and storage sites, rights-of-way such as electrical power lines, communication lines, pipelines, roadsides, railroads, fence rows, non-irrigation ditch banks, and around farm buildings; and applications to grazed areas, and establishment and maintenance of wildlife openings, and in Christmas tree plantations and aquatic sites.

Blue Spray Indicator, for use in herbicide and fertilizer applications, designed for marking spray solution in 1-gallon sprayers. A color mark that lasts 1-2 days and breaks down in sunlight and moisture. Product used should indicates where application has occurred, improving applicator safety, and showing areas that are skipped or overlapped.

Contractor requirements:

Contractor shall be licensed by Ohio Department of Agriculture Contractor shall be Commercial CORE and Category 5 – Licensed for minimum 5 yrs.

Contractor shall show significant equipment to successfully complete herbicide treatment in remote areas and on steep terrain.

Contractor shall show previous successful experience on projects similar to as defined in this contract.

Contractor shall sign in at Projects on each visit with arrival and departure times to include personnel on site and reason for visit.

SCOPE:

A-1 Application of herbicide: The contractor shall apply herbicide mixture to areas to be sprayed. The contractor shall spray to wet entire coverage area.

Product mix rate with 100 Gal of water which is applied to 1 Acre.

Pesticide #1 – 1 gal/ 100gal Water/ 1 Acre Pesticide #2 – 32oz / 100gal Water/ 1 Acre Pesticide #3 – 1 Gal/ 100gal Water/ 1 Acre Blue Spray Indicator Tablets– 16oz/ 100gal Water/ 1 Acre

Spraying Area A:

The Contractor shall spray pesticide #1 and blue indicator within Area A and provide full coverage.

Spraying Area B:

The Contractor shall spray Pesticide #1, Pesticide #2, and blue indicator spray within Area B and provide full coverage.

Spraying Area C:

The Contractor shall spray Pesticide #3 and blue indicator spray within Area C and provide full coverage.

The contractor shall incorporate blue spray indicator tablets as a temporary colorant that will leave an obvious indication of completed coverage of treated areas or indications of spillage. The Contractor shall follow mixture process and procedures set forth by the manufacturer. Mixture and application rates shall not exceed the manufactures maximum application labels. The contractor shall always follow the more restrictive manufacturers label when making an application involving tank-mixes. All colorant treated herbicide solutions will be applied in a uniform and accurate manner according to the manufacturer’s instructions and the laws of the State of Ohio. No herbicide solution will be applied to any water surface or sprayed across streams to the opposite bank.

A-2. Mixing shall take place off of U.S. Government property or in those areas on U.S. Government property specifically designated by the Project Staff. Rinsing or cleaning of contractor’s equipment shall not be permitted on U.S. Government property. Transport of the pesticide or pesticide mix shall be done in a manner to reduce the probability of spills. All chemicals are to be mixed, handled, applied, and disposed of in accordance with all manufacturer’s instructions and applicable State, Local and Federal laws by a contractor possessing a valid Public Operators License for General Industrial Vegetation Application issued by the State of Ohio Department of Agriculture. Proof of this license must always be in possession of the contractor and the applicator while on the project and presented, upon request, to any employee, agent, or representative of the Corps of Engineers, the State of Ohio, or other agencies having jurisdiction in these matters.

A-3. Contractor shall provide mix ratio and chemicals to be used upon arrival at the project site prior to application.

Upon completion of herbicide treatment, the contractor shall provide ORD Form 1031 or a State approved form before departure from site and provided to Project personnel. All spraying must be performed in accordance with specimen label directions, manufacturer, and federal and state laws. The amount of spray per acre shall be sufficient to achieve a total kill of undesirable vegetation, but not excessive to the point of runoff or overspray. The contractor shall apply product only during periods when there is very little to no hazard from spray drift (windy conditions), and during periods when there are minimal chances for chemical to be washed into rivers or lakes. A photocopy of the valid applicator’s license in the State of Ohio and proof of insurance shall be provided to the Project Staff on the date of application.

A-4. Contractor shall guarantee total eradication of vegetation within 30 days of application and eradication of future pest growth during the season of treatment unless conditions exist that limits uptake of herbicides. The contractor shall return to the project site in 30 days for a Quality Control inspection. Quality Control Inspection shall be scheduled with Project Staff during established business hours. Area B spraying, current growth or regrowth shall be the contractor responsibility for the entire growing season. Any missed or regrowth areas shall be re-treated at no additional expense to the Government. The Contractor shall sign in at each project each day they are on site. This will include the contractor personnel, the time in and out, and reason for visit to project.

A-5. The contractor shall be responsible for traffic control of vehicles on public roadways adjacent to treatment areas with the use of warning devices and flagger as needed. Flaggers must have high visibility safety vests and other appropriate equipment for traffic control. Since some of the spraying may be along railroad beds, the contractor shall be required to contact the railroad for permission to be on or adjacent to the railroad tracks. All treatment areas within or adjacent to public recreation sites shall be posted appropriately for a minimum of 48 hours during and following treatment to notify users of the presence of the herbicides. Spraying and inspections will not take place on weekends unless approved by the Facility Manager or COR of the Area where the project is located.

This approval shall be in writing prior to work.

A-6. Contractor Abbreviated Accident Prevention Plan (AAPP). The Contractor shall prepare a site-specific Abbreviated Accident Prevention Plan as outlined in EM 385-1-1 (30 November 2014), Appendix A beginning with subparagraph 3.k on page A-10. Contractor must address each element/sub-element in the order they appear in the outline. Any element the contractor feels is not applicable to work under this contract must be listed and a brief explanation provided. Plan must be accepted by the Contracting Officer prior to commencement of any work.

(Attached for your information and use is CESO Checklist A-01. This checklist was developed to assist you in the development of a site-specific Abbreviated Accident Prevention Plan. This checklist is provided as a tool only.)

Contractor Risk Management Process. Contractor may use Job Safety analyses (JSAs), Job Hazard Analyses (JHAs) or Activity Hazard Analysis (AHA) for the purpose of risk assessment. Before beginning each work activity Contractor performing that work activity shall prepare an initial assessment (AHA/JSA/JHA) listing each job step, anticipated hazards, site conditions, equipment, materials, personnel and control measures to be implemented. A Risk Assessment Code (RAC) shall be assigned to each step assessing the level of risk remaining after implementation of controls. Once this process is complete a RAC will be assigned to the activity as a whole (cannot be lower than the highest step RAC). Residual risk must be communicated to the proper authority for acceptance in order to proceed. It is the Contractor's responsibility to prepare the AHA/JSA/JHA. Analysis with RAC shall be accepted by the GDA and discussed with al engaged in the activity including Contractor, subcontractor(s), and on-site government representative prior to commencement of work. Names of Competent Person(s) and Qualified Person(s) required for a particular activity (e.g., excavation, scaffolding, fall protection, or other activities specified by OSHA and/or EM 385-1-1) shall be identified and included in the AHA/JSA/JHA and proof of their competency/qualification.

NOTES:

Work crews of two or more must have two people holding currently qualifications in First Aid and CPR from the American Red Cross, American Heart Association or a licensed physician. Training must include a hands-on element and the contractor must maintain appropriate First Aid kit on site. Single individuals working alone must have current certification in First Aid as a minimum.

Contractor shall employ a minimum of one Competent Person at each worksite to function as the Site Safety and Health Officer (SSHO). The SSHO as a minimum must have completed the 30-hour OSHA Construction or General Industry Safety class or its equivalent as specified in EM 385-1-1 Section 01.A.17.b and have a minimum of 5 years’ experience relative to the work being completed. The SSHO must be on-site at all times work is being performed. SSHO responsibilities may be collateral duty. (Note: SSHO qualification requirements may be waived at the discretion of the USACE District Safety & Occupational Health Office for extremely low risk operations.)

Accident/Mishap Reporting: The Contractor shall report all recordable mishaps to the GDA within 24-hours in accordance with EM 385-1-1 Section 01.D. Accidents shall be investigated to determine causal factors and corrective actions shall be implemented. Accidents resulting in: days away injuries, days away illnesses, restricted/transfer injuries, property damage of $5,000.00 or more shall be investigated and reported to the GDA using the USACE Accident Investigation Report Form ENG 3394 within 24 hours of the occurrence.

(1) Immediate notification to the GDA is required for all serious accidents:

a. Fatal Injury/illness;

b. Permanent totally disabling injury/illness;

c. Permanent partial disabling injury/illness;

d. One (1) or more persons hospitalized as inpatients as a result of a single occurrence;

e. $500,000 or greater accidental property damage;

f. Three (3) or more individuals become ill or have a medical condition suspected to be related to a site condition, or a hazardous or toxic agent on the site;

g. USACE aircraft destroyed or missing;

The Contractor shall maintain an OSHA Log of Work Related Injuries and Illnesses, OSHA Form 300 and comply with all accident reporting and recordkeeping requirements specified in 29 CFR 1904.39.

(2) In addition to the above, any mishap occurring in any of the following high hazard areas shall be reported immediately to the GDA, investigated and corrective actions implemented.

a. Electrical (includes Arc Flash, electrical shock, etc.);

b. Uncontrolled Release of Hazardous Energy (includes electrical and non-electrical);

c. Load Handling Equipment (LHE) or Rigging;

d. Fall-from-Height (any level or other than same surface);

e. Underwater Diving

A-7. A site inspection by the offeror prior to the submission of offers is strongly recommended. All acreage amounts are estimated and offerors should inspect the site for specific areas, and special conditions. Appointments for site inspections should be made with the Facility Manager for the Project. Phone numbers for the Facility Manager can be found on the attached specification sheets.

A-8. Payments: The contractor shall submit an invoice for 75% of the total amount of each job upon completion of the initial treatment (treatment No. 1) and an invoice for 25% of the total amount of each job upon completion of any required re-spraying (treatment No. 2) provided that satisfactory results are achieved.

A-9. At the option of the Government this contract may be renewed for four (4) one year periods from 01 Jan 2023 thru 31 Dec 2023, 01 Jan 2024 thru 31 Dec 2024 and 01 Jan 2025 thru 31 Dec 2025, 01 Jan 2026 thru 31 Dec 2026.

Dates for treatments to begin shall be decided during the option years at the discretion of the Facility Manager. Type and concentration of Herbicide may change at the discretion of the Government.

NOTE: Site visits are highly recommended so that accurate estimates of application areas can be determined by potential offerors. Also, once on site the contractor shall contact the project office and a representative will point out the areas to be sprayed. Square foot and acreage estimates are approximations of total areas where treatment will occur and are NOT representative of the total amount of spraying that may occur.

Hours of Operation

A. Working Hours: 0730-1600 hours Monday through Friday. Work may continue outside these times with permission from the on-site government representative. All work shall be performed during daylight hours.

Delay of work may occur during excessive rainfall or wet periods due to access to the site.

Federal Holidays: When one of the designated holidays falls on a Sunday the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work that interferes with other ongoing functions at the project shall be scheduled around normal working hours to be approved by Project Maintenance Mechanic. Work shall be scheduled around the above listed Federal holidays unless approved in advance.

2. Access and General Protection/Security Policy and Procedures. This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language:

"All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes."

4. Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something). This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training."

15. Pre-screen candidates using E-Verify Program. Proposed language: "The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. 52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (NOV 2021)

(a) Definitions. As used in this clause--

Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).

Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).

Safeguarding means measures or controls that are prescribed to protect information systems.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.

(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.

(xii) Identify, report, and correct information and information system flaws in a timely manner.

(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.

(xiv) Update malicious code protection mechanisms when new releases are available.

(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
