STATEMENT OF WORK
PART I
SECTION C
DESCRIPTION/SPECIFICATIONS/WORK STATEMENT
Greenup Locks and Dam Gate End Casting Fabrication
C-1. SCOPE. These specifications cover the furnishment of all materials and labor for the fabrication, testing, and delivery of four (4) GATE END CASTINGS and any components or hardware required for complete assembly. The GATE END CASTINGS shall be shipped only after approval has been obtained from the Government Representative. The Contractor shall also provide a pattern of the GATE END CASTING to the Government in addition to the items specified herein. The pattern shall be constructed of a material which allows it to be reusable.
C-2. GENERAL. The gate end castings, MK. 22/6-1, shall consist of CAST STEEL QQ-5-681b, CL.I. The bushings shall be fabricated out of aluminum bronze as called for on Drawing 22/6. The pattern for the gate end casting shall be constructed of a material which allows reuse.
The specifications listed in APPLICABLE PUBLICATIONS shall determine the process for casting the items described herein. The Contractor shall be responsible for providing a schedule of casting procedures which are in compliance with all associated standards publications in accordance with C-5.2.4.2 Schedule of Casting Procedures, and for ensuring all fabrication processes meet the applicable standards.
C-2.1 Shop Drawings. Completely detailed shop drawings, drawn to scale, for all components specified herein shall be submitted to the Government Representative for approval in accordance with paragraph, SHOP DRAWINGS, of SECTION H - SPECIAL CONTRACT REQUIREMENTS, prior to initiating fabrication.
Drawings shall show complete details, including tolerances. Shop drawings shall include completely detailed information on materials, including catalog cuts and type, grade, and class of materials, as appropriate.

C-4. MATERIALS. Materials shall be as hereinafter specified. Materials not specified shall be the manufacturer’s standard for the application. All equipment shall be new. The materials of construction used shall be new, manufactured within the time period not exceeding one year prior to delivery, and of kind, composition, and physical properties best adapted to its several purposes in accordance with best engineering practice. All materials and equipment proposed for use in the work shall be identified on the Contractor’s shop drawings or specifications and shall be subject to approval of the Government Representative. The Contractor shall submit evidence satisfactory to the Government Representative that such material conforms to the requirements of the specifications.
C-4.1 Protection of Materials and Equipment. The Contractor shall be responsible for the proper handling, maintenance, storage, and protection of all materials until delivered and accepted at the location shown in SECTION
F - DELIVERIES OR PERFORMANCE.
C-4.2 Quality Control The Contractor shall establish and maintain a quality control system to assure compliance with the contract requirements and shall maintain records of his quality control of all operations covered by these specifications. Quality control records shall be made available to the Government Representative upon request.
C-5. METALWORK FABRICATION, MACHINE WORK, AND MISCELLANEOUS PROVISIONS.
C-5.1 Scope. This section specifies the workmanship standards applicable to the various phases of metalwork fabrication, the general requirements for tests to insure conformance with the specifications, and miscellaneous requirements incident to the work.
C-5.2 Quality Assurance.
C-5.2.1 Tests of Materials. The Contractor shall, at his expense, perform analyses and tests to demonstrate that all materials are in conformity with the specifications. Should the Contractor desire to use stock materials not manufactured specifically for the work covered by these specifications, he shall submit evidence, satisfactory to the Government Representative that such materials conform to the requirements of the specifications. Detailed tests of these materials may not be required, if approved by the Government Representative. Tests, except where modified, shall be made as indicated in the respective detailed specifications or on the drawings and, unless otherwise authorized, in the presence of the Government Representative. Certified reports in triplicate of all required analyses and tests shall be provided to the Government Representative. The Contractor shall furnish the Government Representative, upon request, specimens and samples for independent analyses and tests. These specimens and samples shall be properly labeled and prepared for shipment.
C-5.2.1.1 Reports of Material. The Contractor shall furnish the Government Representative two certificates; one shall be a list from the fabricator's shop showing what contract items are to be made from the material ordered from the mill, and the other shall be a list from the mill stating, for each article (sheet, plate, bar, shape, etc.) to be supplied to the fabricator, the heat number, and the chemical and physical properties of the metal from which the article is to be made.
C-5.2.2 Special Test Requirements.
C-5.2.2.1 Nondestructive Testing. When doubt exists as to the soundness of any material part, such part may be subjected to any form of nondestructive testing as determined by the Government Representative. This may include ultrasonic, magnaflux, dye penetrant, x-ray, gamma ray or any other test that will thoroughly investigate the part in question. The cost of such investigation will be borne by the Government. Any defects impairing the performance or proper functioning of the operating machinery will be cause for rejection and the rejected part shall be replaced and retested at the Contractor's expense.
C-5.2.2.2 Tests. Waiving of tests, however, will not relieve the Contractor of responsibility for any fault in operation, workmanship, or material that may develop before the completion of his contract.
C-5.2.3 Workmanship.
C-5.2.3.1 General. Structural materials shall be thoroughly straightened by methods that will not impair the metal. Sharp kinks or bends in member to be straightened will be cause for rejection. Finished members shall be free from kinks, bends, or winds. Shearing shall be accurately done, and all portions of the work neatly finished. Corners shall be square and true unless otherwise shown on the drawings. Where heating is required, precautions shall be taken to avoid overheating the metal and it shall be allowed to cool in such a manner as not to destroy the original properties of the metal. Steel with welds will not be accepted, except where welding is definitely specified, called for on the drawings or otherwise approved. Break all corners and edges.
C-5.2.3.2 Dimensional Tolerances for Structural Work.
C-5.2.3.2.1 Dimensions shall be measured by means of an approved calibrated steel tape of the same temperature as the structure at the time of measurement. Unfairness of plate work shall be held to a practicable minimum.
C-5.2.3.2.2 Tolerances shall be as shown on the drawings and as specified hereinafter. Tolerances for dimensions to machined burned surfaces shall be +/- 1/16” unless otherwise shown.
C-5.2.3.3 Quality Control. The Contractor shall establish and maintain a quality control system to assure compliance with the contract requirements and shall maintain records of his quality control of all operations covered by these specifications.
C-5.2.4 Submittals. Contractor submittals shall be in accordance with the specifications and as herein specified. All submittal documents shall be submitted to the Government for approval prior to beginning fabrication. Contract work shall not commence until approval of submittal documents has been received from the Government.
C-5.2.4.1 Shop Drawings. Shop drawings shall be submitted for approval in accordance with SECTION H - SPECIAL CONTRACT REQUIREMENTS. Drawings shall include catalog cuts, templates, fabrication and assembly details, and type, grade, and class of materials, as appropriate. Elements of fabricated items inadvertently omitted on contract drawings shall be detailed by the fabricator and indicated on the shop drawings.
C-5.2.4.2 Schedule of Casting Procedures. A complete schedule of casting procedures shall be submitted to the Government Representative and approved before fabrication is commenced.
C-5.2.4.3 Certificates for material tests and examinations shall be submitted for approval as specified.
C-5.2.4.4 Non-Destructive Test Inspector Certificates. The Contractor shall furnish the certification documents for the non-destructive testing inspector which performs the testing in accordance with Section C-5.3.2.3.
C-5.2.4.5 Non-Destructive Test Results. The Contractor shall submit for approval, the results of all testing performed under these specifications. The Government reserves the right to reject any test result. In which case, the reason for rejection shall be corrected by the Contractor at no additional expense to the Government.
C-5.5 Machine Work.
C-5.5.l General. Unless otherwise shown on the drawings, all tolerances, allowances, and gages for metal fits between plain, non-threaded, cylindrical parts shall conform to ASME B4.l for "Preferred Limits and Fits for Cylindrical Parts" for the class of fit as shown or otherwise required. Where fits are not shown they shall be suitable as determined by the Government Representative. Tolerances for machine-finished surfaces designated by non-decimal dimensions shall be within 1/64 inch. Sufficient machining stock shall be allowed to insure true surfaces of solid material. Finished contact or bearing surfaces shall be true and exact to secure full contact.
C-5.5.2 Finished Surfaces
C-5.5.2.1 Where surface finishes are indicated on the drawings or specified herein the symbols used or finishes specified shall be in accordance with ASME B46.1 for "Surface Texture (Surface Roughness, Waviness, and Lay)". Values of roughness height specified are specified in micro-inches as "Arithmetical Average Deviation from the Mean Surface". Roughness specified is the maximum value and any lesser degree will be satisfactory.
Compliance with specified surface shall be determined by sense of feel and by visual inspection of the work compared to Standard Roughness of Specimens, in accordance with the provisions of ASME B46.1. Values of roughness width and waviness height are not specified, but shall be consistent with the general type of finish specified by roughness height. Flaws such as scratches, ridges, holes, peaks, cracks, or checks which will make the part unsuitable for the intended use will be cause for rejection.
C-5.5.2.2 Where the finish is not indicated or specified, the type of finish shall be the type which is most suitable for the surface to which it is applied and shall be consistent with the class of fit required. Surfaces to be machine finished shall be indicated on the shop drawings by symbols which conform to ASME B46.1.
C-5.5.2.3 Unfinished Surfaces. So far as practicable, all work shall be laid out to secure proper matching of adjoining unfinished surfaces. Where there is a large discrepancy between adjoining unfinished surfaces, they shall be chipped and ground smooth, or machined, to secure proper alignment. Unfinished surfaces shall be true to the lines and dimensions shown on the drawings and shall be chipped or ground free of all projections and rough spots. Depressions or holes not affecting the strength or usefulness of the parts may be filled in a manner approved by the Government Representative.
C-5.5.3 Protection of Finished Machined Surfaces.
C-5.5.3.1 Finished surfaces shall be thoroughly cleaned of foreign matter. Finished surfaces of large parts and other surfaces shall be protected with wooden pads or other suitable means.
C-5.5.3.2 Exposed machine finished surfaces shall be thoroughly cleaned of foreign matter. All unpainted machine finished surfaces shall be protected by a suitable rust inhibitor satisfactory to the Government Representative, for shipping and storage protection. Rust inhibitor requested by Government Representative is Rust Veto. If a change is needed it must be approved by Government Representative.
C-5.6 LIST OF MATERIALS. In accordance with paragraph, PURCHASE ORDERS, of SECTION H -
SPECIAL CONTRACT REQUIREMENTS, the Contractor shall furnish the Government Representative with three
(3) copies of all purchase orders, mill orders, shop orders for materials, and work orders. Where mill tests are required, the purchase orders shall contain the test site address and the number of the testing agency.
C-6. PAINTING.
C-6.1 General. These paragraphs cover the surface treatment of the finished machined surfaces to prevent rust, corrosion, or other damage to the material integrity of the gate end casting.
All exterior surfaces not in contact with other surfaces shall be coated with two (2) coats of all-purpose marine-grade epoxy paint, the color of which shall be coordinated with the Government. The epoxy coating shall have a dry film thickness of approximately 125 microns per coat and be rated for a temperature resistance of 180o F.
The surfaces must be coated with a rust inhibitor compliant with this section to prevent rusting prior to the application of the epoxy coating in accordance with ASTM
All machined surfaces which are or will be in contact with another machined surface during operation of the gate end casting shall be coated with a long-term marine grade rust inhibitor. The rust inhibitor shall be able to effectively resist rusting of machined surfaces for a minimum of three (3) years. The film thickness shall be approximately fifteen (15) microns. The process of application of the rust inhibitor shall conform to the manufacturer’s standards.
C-6.2 Surface Preparation. Surfaces shall be clean before applying surface treatments. The removal of oil and grease shall, in general, be accomplished with mineral spirits or other low-toxicity solvents having a flashpoint above 100 degrees Fahrenheit before any mechanical cleaning is started. Solvent cleaning shall be done with clean cloths and clean fluids to avoid leaving a thin film of greasy residue on the surfaces being cleaned.
C-6.6 Parts or Surfaces Not Painted. Finished machine surfaces shall be protected as specified in paragraph C-6.1, General.
C-6.7 Preparation for Shipment. After final testing and cleaning, the contractor shall prepare the gate end castings and components for shipment in accordance with the requirements of SECTION D - PACKAGING AND
MARKING.
C-7. CHANGES IN SPECIFICATIONS AND DRAWINGS. The right is reserved as the interest of the Government may require, to revise or amend the specifications and/or drawings prior to the date set for receiving of quotes. Such revisions and amendments, if any, will be announced by amendment or amendments to this solicitation. Copies of such amendments as may be issued will be furnished to all perspective offerors. If the revisions and amendments are of a nature which requires material changes in quantities or prices quote, or both, the date set for the quote may be postponed by such number of days as in the opinion of the Government Representative will enable the offerors to revise their quote. In such cases, the amendment will include an announcement of the date of closing.
C-8. PAYMENT. The contract price shall include all costs associated with furnishing all material and labor for fabricating, assembling, testing, assembling, protecting, and shipping the gate end castings and components. The
Contractor shall send an invoice to the Government only after all submittals and items have been received and accepted by the Government.
SECTION D
PACKAGING AND MARKING
D-1. PACKAGING AND MARKING. The gate end castings shall be packaged in a manner to ensure safe delivery by common carrier. The items shall be placed in a wooden box wrapped in plastic and secured to a wooden pallet. The wooden box shall be clearly marked for easy identification of the component. Parts damaged in handling, packaging, or shipping shall be repaired or replaced as directed by the Government Representative at no cost to the Government. Each package will be clearly marked identifying its contents.
SECTION E
INSPECTION AND ACCEPTANCE
E-1. INSPECTION. The work will be conducted under the general direction of the Government Representative and is subject to inspection by his appointed inspectors to ensure strict compliance with the terms of the contract. Materials furnished under these provisions shall be subject to inspection during and after the process of manufacture at the place of manufacture by authorized Government inspectors who shall be afforded proper facilities for determining compliance with these specifications. Any part of the equipment not in compliance with these specifications will be rejected and the Contractor shall promptly remedy or replace the defective part or parts to the satisfaction of the Government Representative, without cost to the Government. All final shop assemblies required to be performed will be witnessed by a Government appointed inspector. The Contractor shall keep the Government Representative informed as to the general progress of the work and shall notify the Government Representative in writing, three (3) days prior to the time when the components are ready for shipment. The equipment will be inspected in the presence of the Government Representative for conformance with the specifications prior to loading for shipment. The Contractor shall give one (1) week notice to the Government Representative prior to such inspection.
E-2. FINAL EXAMINATION AND ACCEPTANCE. The components shall be inspected and checked at the point of delivery for quantity and damages from transportation. Any such loss or damage will be remedied by the Contractor at no additional cost to the Government. Upon completion of satisfactory inspection at both the Contractor's plant and point of delivery, the equipment will be accepted on behalf of the Government.
E-3. INSPECTION OF STEEL CASTINGS. All gate end castings shall be inspected by the Contractor.
Immediately prior to inspection, the casting surfaces shall be grit-blasted to white metal, conforming to SSPC SP 5.
All steel castings shall conform to the requirements of ASTM A148 & ASTM A781 and the supplemental requirements contained in Paragraphs S1. “Other surface discontinuities” as mentioned in ASTM A781 shall meet the visual acceptance standards of ASTM A802/A802M, level II. The extent of the magnetic particle examination of supplementary requirement S1 shall be as indicated on the drawings, and the basis of acceptance shall be in accordance with ASTM A903 Acceptance Quality Level III. Additional Radiographic and Ultrasonic testing shall be performed to the extent indicated on the drawings. Ultrasonic inspection shall be in accordance with ASTM A609/A609M to acceptance quality level 3. Radiographic Examination shall be in accordance with ASTM E94 and ASTM E446, ASTM E186, or ASTM E280 as appropriate. All inspection reports shall be submitted to the Government for Approval. Any defect or non-permissible indication discovered as a result of these inspections in accordance with the stated acceptance criteria shall be cause for rejection. Any casting rejected at the Contractor’s expense, or at the Contractor’s expense repaired (the repair of steel castings shall meet criteria of ASTM
A488/A488M and retested to the satisfaction of the Contracting Officer or his authorized representative. The Contractor shall perform radiographic inspection of steel castings as designated and as described in the section of these specifications covering the particular item of work. The procedure for making, evaluating, and reporting the radiographic inspection shall conform to the requirements of ASTM E94.
SECTION F
DELIVERIES AND PERFORMANCE
F-1. PERFORMANCE. The Contractor will be required to commence work under this contract within ten
(10) calendar days after the day of receipt by him of Notice of Award, to prosecute said work diligently, and to complete the fabrication, assembly, testing, painting, and delivery not later than 120 days of contract award.
F-2. DELIVERY. The Contractor shall coordinate his delivery plans with Tyler Lester (304)563-0152 to ensure Government furnished unloading equipment is suitable for performance of the unloading operation. Delivery shall be made F.O.B. destination to Jason Hall, Meldahl Locks & Dam, 2443 U.S. 52 Felicity, Oh 45120. Deliveries are accepted between 0730 and 1600 excluding weekends and Federal holidays. The Contractor shall give three (3) calendar days notification before shipment.
SECTION H
SPECIAL CONTRACT REQUIREMENTS
H-1. CONTRACT DRAWINGS AND SPECIFICATIONS.
H-1.1 Contract drawings and specification will be furnished to the Contractor in electronic form. Upon request three (3) sets of half scale contract drawings and specifications will be furnished to the Contractor without charge, except applicable publications incorporated into the Technical Provisions by reference. At the request of the Contractor, full scale sets of drawings will be substituted for half scale sets of drawings, up to a maximum of three
(3) sets. Additional sets will be furnished on request at the cost of reproduction. For all modifications, the Contractor will be furnished three (3) prints of appropriate scale or at his option, one (1) reproducible and one (1) print of the appropriate scale, of all revised drawings. The work shall conform to the following contract drawings, which form a part of these specifications and are available in the Office of the District Engineer, Department of the Army, Huntington District, Corps of Engineers, 502 Eighth Street, Huntington, West Virginia 25701.

H-1.2 Omissions from the drawings or specifications or the misdescription of details of work which are manifestly necessary to carry out the intent of the drawings and specifications, or which are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work but they shall be performed as if fully and correctly set forth and described in the drawings and specifications.
H-1.3 The Contractor shall check all drawings furnished him immediately upon their receipt and shall promptly notify the Government Representative of any discrepancies. Figures marked on drawings shall in general be followed in preference to scale measurements. The Contractor shall compare all drawings and verify the figures before laying out the work and shall be responsible for any errors which might have been avoided thereby.
H-2. SHOP DRAWINGS.
H-2.1 General. The Contractor shall prepare and submit for approval, four (4) copies of all shop drawings and one electronic copy as called for under the various sections of these specifications. These drawings shall be complete and detailed. It shall be the responsibility of the Contractor to check and coordinate shop drawings of his subcontractors and suppliers prior to submitting them. With each submittal of shop drawings, the Contractor shall certify that he has reviewed the shop drawings in detail and that they are correct and in strict conformance with the contract drawings and specifications except as otherwise explicitly stated. Upon completion of review by the Government Representative, if approved, each copy of the drawings will be identified as having received such approval by being so stamped and dated. The Contractor shall make any corrections required. If the Contractor considers any correction indicated to constitute a change to the contract drawings or specifications, notice as required under the contract clause, "Changes" shall be given to the Government Representative. Three (3) sets of all shop drawings will be retained and one set will be returned to the Contractor. The approval of the drawings shall not be construed as a complete check, but will indicate only that the general method of construction and detailing is satisfactory. Approval of such drawings will not relieve the Contractor of the responsibility for any error which may exist as the Contractor shall be responsible for the dimensions and design of adequate connections, details, and satisfactory construction of all work. Shop drawings shall be transmitted on ENG Form 4025. A letter of transmittal will not be required. The Government Representative will furnish a supply of forms for this purpose. All transmittals shall be in accordance with the instructions on the reverse side of ENG Form 4025 and each drawing submitted for approval shall be listed on a separate line of the form. The drawings shall be of a size that presents all details in a legible fashion. Each drawing shall be provided, in the lower right hand corner, with the name of the project, the contract number, a drawing number, and a white space 3x4 inches in which the action taken can be indicated. One (1) copy of ENG Form 4025 indicating approval or corrective action required will be enclosed with the print returned to the Contractor. Promptly after approval and after all corrections have been made, four (4) additional sets of prints of all shop drawings made on durable, permanent paper, shall be furnished for distribution.
All prints or shop drawings submitted for approval shall be clearly legible. Assembly of the affected items will not be permitted prior to receipt of these distribution copies of the shop drawings, unless such assembly is specifically authorized in writing.
H-2.2 Submission. Shop drawings shall be submitted as specified above to:

H-3. SUBMITTAL CONTROL DOCUMENT. Within 10 days after receipt of award, the Contractor shall complete and submit to the Government Representative, in duplicate, SUBMITTAL REGISTER, ENG Form 4288, listing all submittals and dates. In addition to those items listed on ENG Form 4288, the Contractor will furnish submittals for any deviation from the plans or specifications. The scheduled need dates must be recorded on the document for each item for control purposes. In preparing the document, adequate time (minimum of 15 days) will be allowed for review and approval and possible resubmittal. Scheduling shall be coordinated with the approved progress schedule. The Contractor's Quality Control representative shall review the listing at least every 15 days and take appropriate action to maintain an effective system. Copies of updated or corrected listing shall be submitted to the Government Representative at least every 30 days in the quantity specified. Payment will not be made for any material or equipment which does not comply with contract requirements.
Attached at the end of these Special Provisions is the submittal listing, in tabular form, of technical items the Contractor shall submit to the Government Representative, as indicated in the various sections of these specifications. The submittal listing may not be complete and additional items may be required as determined by the Government Representative.
Sample of the TRANSMITTAL OF SHOP DRAWINGS, EQUIPMENT DATA, MATERIAL SAMPLES, OR MANUFACTURER’S CERTIFICATES OF COMPLIANCE ENG 4025, is attached at the end of these Special
Provisions.
H-4. PURCHASE ORDERS. The Contractor shall furnish three (3) copies of all purchase orders for material to be permanently incorporated in the construction work showing firm name and address, contract number, and promised delivery date. Such purchase orders shall be so worded or marked that each item, piece or member can be definitely identified in the specifications or on drawings. Purchased prices are not necessary and may be obliterated from the copies of the purchase orders furnished.
H-5. CERTIFICATES OF COMPLIANCE (1969 MAY OCE). In addition to the certificates of compliance that may be required by the Technical Provisions of these specifications, certificates for demonstrating proof of compliance of materials with specification requirements shall be furnished for all other material and shall be executed in three (3) copies. Each certificate shall be signed by an official authorized to certify in behalf of the manufacturing company and shall contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates shall contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall not be construed as relieving the Contractor from furnishing satisfactory material, if, after tests are performed on specific samples, the material is found not to meet the specific requirements.
H-6. FINAL PLANS. Before final payment is made, the Contractor shall furnish the Government Representative all approved shop drawings on a compact disk(s) in Portable Document Format (PDF). The drawings from which the PDF files are made shall reflect the “as built” condition of all parts and components. All parts shown on the drawings shall be referenced and numbered in order to facilitate identification of the various parts. Each drawing from which the files are made shall have a title in the lower right hand corner containing the name of the Contractor, title of drawing and the date. The files shall be legible when printed at their original full size. Any of the approved shop drawings that are products of Computer Aided Drawing (CAD) shall also be copied to the compact disk in their native format. This is in addition to the PDF files of those drawings. Two (2) copies of the compact disk(s) shall be furnished. The compact disk and case liner shall be labeled with the project name, contract number, and Contractor name. In addition, the case liner shall have a description of each file which will include for drawings the drawing name and date.

52.204-21 BASIC SAFEGUARDING OF COVERED CONTRACTOR INFORMATION SYSTEMS (NOV 2021)
(a) Definitions. As used in this clause--
Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.
Information means any communication or representation of knowledge such as facts, data, or opinions, in any medium or form, including textual, numerical, graphic, cartographic, narrative, or audiovisual (Committee on National Security Systems Instruction (CNSSI) 4009).
Information system means a discrete set of information resources organized for the collection, processing, maintenance, use, sharing, dissemination, or disposition of information (44 U.S.C. 3502).
Safeguarding means measures or controls that are prescribed to protect information systems.
(b) Safeguarding requirements and procedures.
(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.
(v) Identify information system users, processes acting on behalf of users, or devices.
(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.
(vii) Sanitize or destroy information system media containing Federal Contract Information before disposal or release for reuse.
(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.
(ix) Escort visitors and monitor visitor activity; maintain audit logs of physical access; and control and manage physical access devices.
(x) Monitor, control, and protect organizational communications (i.e., information transmitted or received by organizational information systems) at the external boundaries and key internal boundaries of the information systems.
(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.
(2) Other requirements. This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial products or commercial services, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
It [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided;…
