Section 00 21 16 - Instructions to Proposers

PROCEDURES FOR SUBMITTAL OF OFFERS AND PROPOSAL EVALUATION

1. Overview

1.1. This Request for Proposal (RFP) solicits work for the construction of a Reception

Barracks Complex Phase II at Fort Jackson, SC. Construction includes a reception processing center, battalion headquarters and company operations facilities (COF), trainee barracks, medical clinic, overhead protection/canopy, storage building, swing space, optical fabrication laboratory, and building information systems. A temporary swing space for the reception processing center is required during the construction.

Supporting facilities include site development, utilities and connections, perimeter security devices, lighting, paving, parking, walks, curbs and gutters, storm drainage, landscaping, fencing, and signage.

1.2. Proposal Submissions and the Best Value Trade-off Source Selection Process: This process requires offerors to submit technical and performance capability information for evaluation by the Government against the uniform requirements identified in evaluation factors. Each of the factors will be evaluated against the evaluation criteria set out in this section.

2. Submittal of Offers

2.1. Who May Submit: Any legally organized Offeror qualified and eligible to receive an award under applicable laws and regulations.

2.1.1. The Government will consider past performance of affiliates of the Offeror and those entities in a teaming agreement, whether a predecessor company, affiliated company, subsidiary (including wholly owned subsidiaries), or subcontractors, if the resources of those affiliates will have a direct impact on the performance of this contract, such that the affiliate will have meaningful involvement in contract performance.

2.1.2. Contractor Team Arrangements.

2.1.2.1. Recognition of Contractor Teams. In accordance with FAR Subpart 9.6, it is Government policy to recognize the integrity and validity of contractor team arrangements. For a teaming arrangement to be recognized for purposes of source selection evaluation and the application of non-price factors and sub-factors, there must be full disclosure of the teaming arrangement and company relationships in the team's proposal. The proposal must include a narrative that explains the major or critical aspects of the work to be performed by each team member. For joint venture teams, the proposal must also include an agreement that has been or will be executed prior to award between/among all team members. In the case of prime-sub teams, the prime contractor remains fully responsible for contract performance, regardless of any team arrangement between the prime contractor and its subcontractors.

However, regardless of whether a formal team arrangement is proposed or recognized, consistent with FAR 9.104, the Government may consider the responsibility of subcontractor team members when it may adversely affect the prospective prime contractor’s responsibility or when it is in the Government’s interest to do so.

2.1.2.2. Joint Venture Team Agreement. For joint venture offerors, a joint venture agreement that will govern he performance of the work by the joint venture must be submitted with the proposal. The agreement must address the following items: identification of team members, a delineation of roles and responsibilities of team members, the duration of the agreement, and the percentages of the participants including the controlling party. Agreements should not be subject to substantive revision because the agreement will be part of the evaluation process. The timely submission of the executed teaming agreement prior to award shall be a precondition to a finding of responsibility.

2.1.2.3. Restriction on Substitution. Regardless of any provision to the contrary in a team or subcontract agreement, any entity whose experience is submitted and attributed to the offeror for purposes of the Past Performance evaluation is required to meaningfully participate in any resulting contract as described in the offeror’s proposal. In the case of a prime-sub team arrangement where the subcontractor’s past performance is attributed to the prime for evaluation purposes, the Contracting Officer may permit the substitution of another subcontractor.

2.2. General Proposal Submission Requirements. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) solicitation at or before the exact time specified. There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement may result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will be made available for viewing at the Sam.Gov website (https://sam.gov). All Solicitation Amendments will be made available for viewing in Sam.Gov. It shall be the Offeror’s responsibility to check the website for any Solicitation Amendments.

The Contracting Officer (KO) has determined there is a reasonable probability of adequate price competition in this acquisition. Upon examination of the initial offers, the KO will review this determination and if, in the KO's opinion, adequate price competition exists, no additional cost information will be requested and certification under FAR 15.406-2 will not be required.

However, if at any time during this competition, the KO determines that adequate price competition no longer exists; Offerors may be required to submit information to the extent necessary for the KO to determine the reasonableness and affordability of the price. The Government will evaluate all proposals pursuant to FAR 15.305(a).

Therefore, each initial offer should contain the Offeror’s best terms from a technical and price standpoint. Due to the magnitude of this procurement and in accordance with DFARS 215.306, it is the Government’s intent to conduct discussions with offerors in the competitive range following the procedures at FAR 15.306(c) and (d).

If an Offeror believes that the requirements in these instructions contain an error, omission or are otherwise unsound, the Offeror shall immediately notify the Contracting Division in writing (e-mail is the preferred method) with supporting rationale. Questions or other Requests for Information (RFI) shall be submitted via ProjNet (See Section 2.2.1).

This Request for Proposal (RFP) does not commit the Government to reimburse any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any firm submitting a proposal in response to this Solicitation. Issuance of this RFP does not constitute an award commitment on the part of the Government. Proposals must set forth full, accurate and complete information as required by this RFP, including attachments, if applicable. The penalty for making false statements is prescribed in 18 U.S.C. § 1001.

Offerors are cautioned that “parroting” of the Technical requirements with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform.

Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.

2.2.1. Inquiries. Interested parties with technical inquiries shall submit their inquiries in writing via “Bidder Inquiry” in ProjNet at www.projnet.org\projnet. The bidder inquiry key is KN78DY-AH8ATX. The Government reserves the right to decline addressing certain questions. Further, no questions, unless in the Government’s interest, will be answered any later than seven (7) calendar days prior to the stated deadline for responses to this announcement.

Questions and answers will be made via ProjNet; any changes to contract requirements will only be made through amendment(s). Official amendments to the RFP will be made on Sam.Gov. All Offerors are encouraged to register on ProjNet for alerts to stay abreast of Q&A’s that are posted in reference to this solicitation. Only self-registered users on ProjNet can submit & review inquiries.

To self-register, go to the webpage, click Register, select Agency USACE, SAC Charleston District, enter the required information, and select Register. Once registered, enter your email address and the Bidder Inquiry Key and from there you may submit and view inquiries. 2.2.2. Electronic Proposals.

The Offeror’s bid/proposal shall be submitted electronically, as described below. The Offeror’s proposal shall not contain classified data. The use of hyperlinks in proposals are prohibited. The offeror’s technical proposal is due no later than the time specified in block 13 of the SF1442. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.

6. Tab H – Factor 1 – Past Performance

6.1. Submission Requirements

6.1.1. The Offeror shall demonstrate a record of past experience on recent and relevant projects using the Past Performance Questionnaire Summary Sheet, Attachment 2, and the Past Performance Questionnaire (PPQ), Attachment 3 at the end of this section. The PPQ is provided for the Offeror to submit to the client (Point of Contact) for each relevant project submitted.

Offeror must ensure correct phone numbers and email addresses are provided for the client. Completed PPQs must be submitted with your proposal by the specified closing date and time. Offerors should follow-up with clients to ensure timely submittal of completed questionnaires. If the offeror is unable to obtain a completed PPQ from a point of contact for a project(s) before proposal closing date, the Offeror shall complete blocks 1 – 5 of the PPQ and submit it with the proposal. Please note that, at a minimum, this first page of the PPQ must contain sufficient information for the government to determine the relevancy of the project. In addition, this will provide contract and client information for the respective project(s).

The Government may call and confirm information provided by the Offeror on the PPQs with the points of contact to the extent necessary to verify the information in the PPQ or to obtain additional information. The Government reserves the right to interview other individuals with direct knowledge of the offeror’s performance. The Offeror must provide the correct phone numbers and email addresses for the client Point of Contact. If the Government is unable to verify the information provided on the PPQs with the client Point of Contact, or by other sources available (e.g., CPARS), the Government reserves the right to disregard that project when evaluating the Offeror’s past performance and experience. Similarly, it is important for the PPQs to be signed by the Point of Contact. If PPQs are not signed by the client, the Government reserves the right to disregard the past performance ratings for that particular project.

By exception, the client may request submission of questionnaires directly to the Government’s point of contact (Contract Specialist), Holly Sopiak.

Request may be made via email to Holly.J.Sopiak@usace.army.mil. This request must be coordinated by the client in advance no later than five (5) business days before the proposal due date. If the PPQ fails to arrive before the closing date and time, or if the information on the PPQ is insufficient to determine the Offeror’s name and appropriate solicitation number, it will not be considered.

Offerors are cautioned that the information submitted pertaining to a project shall be limited to the PPQ form and an additional page referenced below and shall contain enough information to determine the recency and relevancy of a project.

Likewise, Project Information not submitted on the provided PPQ form will not be considered. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other solicitations. Offerors may submit PPQs submitted on other procurements provided they are on the NAVFAC/USACE Past Performance Questionnaire Form.

Offerors may attach one (1) additional single-sided page (per PPQ) to further describe how the project is relevant to the RFP requirements. The following items shall be able to be derived from either the PPQ or the additional page:

a) Project Title, Contract Number, Location, and identify the entity serving as the Prime Contractor. Provide the role of the submitting offeror if not serving as the Prime Contractor.

b) Current percentage of construction complete and when it was or will be completed. If project is not yet complete, provide a description of work remaining to be completed.

c) Scope of the project, to include purpose/use of facility.

d) Size of the project (sq ft). Differentiate square footage of new construction versus renovation if the project includes both.

e) Role of firm; provide a description of type of work performed and percentage of work self-performed.

f) Dollar value of the project. List award and final including explanations for cost increases over 10%.

g) Award date, original Construction Completion Date (CCD) and explanations for schedule growth over 10%.

i) Whether the project was design/build (indicate designer of record) or design/bid/build.

j) Customer Primary Point of Contact and alternate POC (name, relationship to project, agency/firm affiliation, city, state, current and correct phone number, and current and correct email address).

In addition to the PPQ, the Offeror’s proposal shall include the Past Performance Questionnaire Summary Sheet (Attachment 2) to provide a summary of the PPQs included and/or submitted to clients. The summary sheet shall include information for all columns.

If the offeror is a joint venture, the projects may be submitted for the joint venture itself or by members of the joint venture. Offerors are advised to submit projects wherein the Offeror, or proposed joint venture members, played a significant role and to clearly define those roles. If any Offeror has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer.

Ensure that the PPQs submitted for this Factor clearly describe the relevant characteristics of the project.

6.1.2. Submission Requirements:

6.1.2.1. The Prime / Construction Offeror shall submit a minimum of three (3), but no more than five (5), substantially complete (80% construction complete) or completed projects as the prime contractor or a major subcontractor within the last seven (7) years prior to the date of the issuance of the solicitation which are relevant to the work described in the scope of this contract. If an Offeror submits more than five (5) total project examples, only the first five

(5) in the order in which the submitted projects appear in the proposal will be evaluated. (See following paragraphs.)

6.1.2.2. Recency. All projects submitted for the Prime / Construction Offeror must be substantially completed (80% construction complete) within the last seven (7) calendar years prior to the issuance of this solicitation. An Indefinite Quantity Indefinite Delivery (IDIQ) contract may be submitted only if a single task order could be considered similar to this project. Submissions referencing the base indefinite delivery contract alone will not be considered. Task orders may not be combined in order for the project to be considered similar or to meet minimum dollar thresholds stated herein.

6.1.2.3. Relevancy. To be considered relevant, projects must meet the following criteria: Have a total project value of at least $45,000,000 at the time of award and be for new construction within the Continental United States (CONUS) that are similar in scope. Total project value includes the total value of vertical (building) construction and supporting facilities. Vertical (building) construction must represent no less than $25M of the $45M total project value.

6.1.2.3.1. Projects completed outside the Continental United States

(OCONUS) may also be considered if the Offeror can demonstrate that the project(s) was completed using similar construction techniques and standards as CONUS projects, i.e., U.S.

Government installations. “Similar” construction can be defined as of the same type building(s) and complexity to that of the Reception Barracks Complex Phase II.

6.1.2.3.2. Specifically projects considered similar in scope to this requirement include new construction of Administrative/Office Facilities, Medical Facilities, Barracks/Dormitory Facilities. Renovation of facilities will not be considered similar in scope.

6.1.2.3.3. Other elements of relevancy that will result in additional consideration for a higher relevancy rating:

i. projects that are LEED Silver certified. Actual LEED certification rather than simply the incorporation of LEED or sustainable features.

ii. performance among dispersed multiple sites, buildings, and/or facilities, i.e., projects that are part of a campus, industrial park, etc.

iii. performance that involves construction of buildings greater than 50,000 SF

iv. performance that involves construction of projects which includes significant site work including utility infrastructure, storm drainage, site grading, paving, and parking, and/or landscaping.

v. Projects that involve phasing of construction, i.e., buildings or other significant elements of work completed prior to continuing construction,

6.2. Other Sources. In addition to the above, the Government may review any other sources of available information other than those provided by the Offeror for evaluating past performance. These other sources may include but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/UEI numbers identified in the proposal on the Proposal Data Sheet, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

If a CPARS evaluation exists for a submitted project, it will be considered.

While the Government may elect to consider data from other sources, the offeror must provide detailed, current, accurate and complete past performance information for evaluation by the Government.

6.3. Evaluation Criteria

6.3.1. Past Performance Evaluation: The past performance and experience evaluation results in an assessment of the Government’s confidence in the ability of the Offeror to meet the solicitation requirements. The past performance evaluation considers each Offeror’s demonstrated record of performance and experience on recent and relevant projects that involve a similar scope and magnitude of effort and complexities as this solicitation requires. One performance confidence assessment rating is assigned for each Offeror after evaluating the Offeror’s recent past performance and experience, focusing on performance and experience that is relevant to the contract requirements.

6.3.2. Recency and Relevancy Evaluation: Projects must meet the minimum criteria in sections 6.1. (and subsections) to be considered recent and relevant. If minimum criteria are met, projects will then be evaluated against the requirements of the RFP. Projects will be evaluated for relevancy based on the description of the project.

TABLE 1 - Past Performance Relevancy Ratings

Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

6.3.3. Confidence Assessment:

6.3.3.1. The SSEB may have a higher level of confidence in an Offeror’s past performance if its proposal demonstrates successful performance in a wide variety of the similar work types as described in section 6.1.3.1. 2 of this RFP.

Conversely, the SSEB may have a decreased level of confidence in Offerors whose past performance is limited amongst the project types described in this RFP.

6.3.3.2. The Government will evaluate the Offeror's past performance and experience using the sources available to it including but not limited to: the example projects identified by the Offeror and submitted on the PPQs and any additional information received from references and CPARS or other sources.

Offerors may be provided an opportunity to address any negative past performance information, through clarifications, which the Offeror has not previously had an opportunity to respond if such information is determined to impact the rating to be assessed.

6.3.3.3. The Government will consider the recency of the performance, the relevancy including the context of the data, and the quality of the performance and general trends in performance and source of the information to reach a confidence assessment rating using Past Performance Confidence Ratings.

6.3.3.4. If no recent/relevant performance record is available or the Offeror’s performance record and experience is so sparse that no meaningful confidence assessment rating can be reasonably assigned this factor will be assigned a rating of “Unknown Confidence” (Neutral).

TABLE 2 - Performance Confidence Assessments

Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will successfully perform the required effort.

Unknown Confidence (Neutral) No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

7. Tab I – Factor 2: Management Approach Narrative

7.1. Submission Requirements:

7.1.1. Project Organization Chart. The offeror shall submit a Project Organization Chart including all team members and key subcontractors identified in the proposal and depicting each Key Personnel position intended to perform on the contract. The organizational chart must identify and integrate the positions of different team members and subcontractors and show lines of authority. The Project Organization Chart must be specific to this procurement, and not a generic document. The Organization Chart is limited to one-page NTE 11” x 17” in size.

7.1.2. Organization Narrative. The offeror shall submit a narrative consistent with the Project Organization Chart that describes what firms will be used, their roles and responsibilities and any contractual arrangements that have been established.

Recognized contractor team arrangements must meet the requirements of Section 2.1.2., above. List the major work elements to be self-performed by the Offeror’s in-house workforce(s), the major work elements to be performed by each key subcontractor, and any significant work items for which a subcontractor has not been identified. The Team Organization narrative is limited to three 8-1/2” x 11” pages.

7.1.3. Management Plan. The Offeror shall provide a Management Plan developed specifically for this project. The information should make it clear that the Offeror has the ability to deliver a quality product and effectively manage all team members and subcontractors, as well as the ability to coordinate all work throughout construction. As a minimum, the plan should address the following:

Quality Control Procedures: Describe the Offeror’s quality control approach and capabilities to maintain quality control throughout construction. The discussion should address the offeror’s understanding of, familiarity with, and intended use of the U.S. Army Corps of Engineers specific procedures and automated information management/tracking systems related to quality control. Describe the proposed quality control organization, including the staffing plan required by Section 01 45 00.10.

Subcontractor Management: Describe how the Offeror will coordinate and control all subcontractors to be utilized on the project. Discuss methods to be employed to avoid conflict between subcontractors.

Scheduling and Phasing: Describe the time control capabilities and systems to be used to plan the work and how the schedule will be used to manage construction. The narrative shall demonstrate a clear understanding of the project phasing and sequencing of construction required by the RFP.

Preparation and Submission of As-Built Documents: Describe how the Offeror will maintain an accurate set of as-builts throughout the project, including the method that will be used to capture mark-ups on the construction drawings and how will this information be disseminated to the Government at close out.

Contract close out: Describe the Offeror’s intended procedure to be used for close out of the project.

The Management Plan may include narrative and/or graphics and is limited to seven 8- 1/2” x 11” pages. Although a standard format is not specified, each of the items of information should be presented in essentially the same order as discussed below.

7.2. Evaluation Criteria:

7.2.1. Management Evaluation: The Government will evaluate the adequacy and feasibility of the Offeror's Management Approach. The Government will evaluate completeness, reasonableness, risk, and logic of each of the proposals’ Project Organization Chart, Organization Narrative, and Management Plan. A proposal lacking any one of these three items will be rated Unacceptable. The Project Organization Chart must integrate all team members/positions and key subcontractors, and show lines of authority.

Omission of entities or individuals, the failure to depict lines of authority, or the submission of a generic organization chart may result in a rating of Unacceptable. The Organization Narrative must be consistent with the Project Organization Chart, and include a discussion of roles, responsibilities, contractual arrangements, and major work items that is logical, and includes a viable approach to perform the work. Omission of one or more of these items may result in a rating of Unacceptable. The Management Plan will be evaluated to ensure that it includes distinct sections describing Quality Control Procedures, Subcontractor Management, Scheduling and Phasing, Preparation and Submission of As-Built Documents, and Contract close out.

Omission of adequate descriptions specific to this project for any area of the Management Plan may result in a rating of Unacceptable.

7.2.2. The Government will evaluate the strengths, weaknesses, and any deficiencies in the submission, as defined above (See Section 3 above).

Based on the submission provided, the Government will evaluate the Offeror’s overall management narrative, and its understanding and capability to execute an awarded contract. For this factor, Offerors will be assigned a combined risk rating from the following table, based on the evaluation of the Offeror’s proposal in accordance with the requirements of the solicitation.

TABLE 3 - Combined Technical/Risk Ratings

Adjectival Rating Definition Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is very low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low.

Acceptable

Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful contract performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus…
