ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Submission of Price Quote – Contractor shall submit the following in 1 copy:

BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.

PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT (PWS)

DWORSHAK SEWAGE & SANITATION SERVICES

PART 1 – GENERAL INFORMATION

1.1 General: This is a non-personal services contract to provide Portable Toilets and Sewage Pumping at U.S.

Army Corps of Engineers (USACE), Dworshak Dam & Reservoir (Dworshak Project), in and near Ahsahka, Idaho.

The Government will not exercise any supervision or control over the Contractor employees performing the services herein. Contractor employees shall be accountable solely to the Contractor, who in turn is responsible to the Government.

1.2 Background: Dworshak Project serves the public by providing recreation facilities and activities on lands and waters around and on Dworshak Reservoir. Facilities served under this contract include vault toilets at group camps, boat ramps, and shoreline recreation sites (see attachment - Vault Toilet Map), portable toilets placed near the Powerhouse and Dam, and a floating sewage barge, to be serviced from the shore at Bruce’s Eddy.

1.3 Objectives: The objective of this contract is to provide and ensure clean and sanitary toileting facilities for members of the public served on USACE lands at Dworshak Project.

1.4 Scope: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform furnishing, placement, maintenance, and removal of Portable Toilets, as well as pumping of vault toilets and sewage barges, as defined in Part 2 of this PWS. The Contractor shall be responsible for hauling the waste for appropriate and lawful disposal off Federal Government property.

1.5 General Information

1.5.1 Period of Performance. The period of performance shall be for one Base Period of 12 months and four 12-month Option Periods. The Period of Performance reads as follows:

Base Period April 7, 2022 – April 6, 2023 Option Period 1 April 7, 2023 – April 6, 2024

Option Period 2 April 7, 2024 – April 6, 2025 Option Period 3 April 7, 2025 – April 6, 2026 Option Period 3 April 7, 2026 – April 6, 2027

1.5.2 Place of Performance. The work will be performed at various locations around Dworshak Dam and Reservoir. See Part 3 of this PWS and the attachment, Vault Toilet Map, for specific locations.

1.5.3 Special Qualifications. The Contractor shall be responsible for obtaining and maintaining all necessary licenses and permits and for complying with any applicable federal, state, and local laws, codes, and regulations in connection with the performance of the work.

1.5.4 Post-award Conference. Within two weeks of contract award, the Contractor agrees to attend a post-award conference, convened by the COR, and held telephonically or in person at Dworshak Project at a time mutually agreeable to the Contractor and the COR prior to the commencement of work on this contract.

1.5.5 Contractor Quality Control. The Contractor is responsible for performing any necessary quality control activities to ensure the standards of this PWS are met. Standards for this contract are listed both in Part 2 of this PWS and in Technical Exhibit 1, Performance Requirements Summary. The Contractor’s QCP shall be available for review upon request of the Contracting Officer’s Representative.

1.5.6 Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). If services do not conform to contract requirements, the Contracting Officer’s Representative may require the Contractor to re-perform such services, at no additional expense to the Government.

1.6 Safety

1.6.1 Safety Standards. The Contractor shall comply with all applicable Occupational Safety and Health Act (OSHA) standards and the U.S. Army Corps of Engineers’ Safety and Health Requirements Manual (EM 385- 1-1) that is in effect at the time of solicitations. The Contractor shall provide all necessary personal protective equipment for its employees. A PDF version of EM 385-1-1 may be accessed at:

1.6.2 Accident Prevention Plan (APP). A qualified person must prepare a written site-specific APP in accordance with the format and requirements of USACE Safety and Health Requirements Manual, EM 385-1-1, Appendix A, and as supplemented herein. The APP must be job-specific and address any unusual or unique aspects of the project or activity for which it is written. Prospective contractors should reference the Appendix A of the document linked above and take special note of the requirements of the Safety Inspection Checklist.

Note: As part of the APP, include a site-specific COVID-19 monitoring plan which addresses, at a minimum, the following elements.

• Procedures for periodic sanitation inspections

• Procedures for disinfecting project site to include high traffic areas IAW CDC guidelines

• Site specific measures to practice social distancing while working on the project.

• Employee training on the signs, symptoms, and protection measures IAW CDC guidelines.

1.6.3 Accident Reporting. The Contractor shall notify the COR immediately of damage to Government or private property and injury to any person resulting from its operations under this contract. In the event that an accident or injury occurs on Government lands, the Contractor shall first notify the appropriate local emergency service organization, and then the COR, as soon as practicable.

1.7 Security: Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 30 business days after the initial contract award.

1.8 Protection of Government Resources

1.8.1 Environmental Protection. The Contractor shall comply with all applicable federal, state, and local laws and regulations concerning prevention, control, and abatement of environmental pollution. Environmental pollution is defined as the presence of chemicals, physical or biological elements, or other agents which adversely affect human health and welfare, unfavorably alter ecological balances, affect other species, or degrade the utility of the environment for aesthetic and recreational purposes.

1.8.2 Disposal of Waste Materials. The Contractor shall remove all wastes from Project property and dispose of it in a safe and legal manner. Disposal of any materials, wastes, effluents, trash, garbage, chemicals, etc., in areas adjacent to drainage ditches, ponds, or lakes shall not be permitted. If any waste material is dumped in unauthorized areas, the Contractor shall remove the material and restore the area to its original condition.

1.8.3 Water Pumping. The Contractor may draw water for charging clean toilet vaults in remote areas from Dworshak Reservoir, if practicable. The Contractor’s pumping equipment must have fish screens in place on any intake.

PART 2 – SPECIFIC TASKS

2.1 Portable Toilets

2.1.1 Provide Portable Toilets. The Contractor shall provide Portable Toilets, standard for the industry in type, function, and style. Each toilet shall be in good serviceable condition and shall be fully stocked at time of placement. Both standard and ADA-compliant units must be available. Routine placement shall be:

2.1.2 Service Portable Toilets. Each Portable Toilet placed by the Contractor shall be serviced not less than weekly. Service shall include cleaning/sanitizing, pumping, and re-stocking consumables. The Contractor shall provide toilet paper and air fresheners/deodorizers for Portable Toilets in amounts sufficient to ensure availability to users and clean-smelling units for the period in between weekly servicing. The Contractor shall provide all necessary chemical additives for Portable Toilet reservoirs. The Contractor shall also provide any needed maintenance of units and up-righting of tipped units within one working day of report of tipping.

Damaged or stolen equipment will be repaired or replaced at the Contractor’s expense.

2.2 Vault Toilet Maintenance

2.2.1 Vault Toilet Inventory. The following Vault Toilets shall be serviced under this contract:

Service between April 1 and May 15 Merry’s Bay: 1 each 1,000 gallon vault Canyon Creek Boat Ramp: 1 each, 1,000 gallon vault Canyon Creek Campground: 2 each, 1,000 gallon vault (price per vault) Dent Group Camp – upper: 2 each 500-gallon side-by-side vaults (price per vault) Dent Group Camp – lower: 1 each, 1,000-gallon vault

Service between May 1 and June 15

Grandad Campground: 2 each, 1,000 gallon vault (price per vault)

Upon Request Only Little Meadow Creek (LMC): 1 each, 1,000-gallon vault.

The Government makes no guarantee, express or implied, that service at LMC will be requested nor that service will be scheduled in conjunction with the Grandad Campground service. The Contractor must price accordingly in its Additional Services table.

2.2.2 Pumping & Re-Charging Service. The Contractor shall pump out the contents of vault toilets and re-charge them according to the schedule guideline above. The Contractor shall provide all necessary chemical for re-charge treatment of vaults. The Contractor shall provide a description of the process to be used for cleaning and recharging the vault toilets, as well as a copy of the SDS for each chemical to be used, prior to providing the vault pumping service.

2.3 Pump Sewage Handling Barge: The Contractor shall pump all solid and liquid waste from a 1200-gallon floating sewage handling barge located at Bruce’s Eddy Marina, not to exceed six times in a Period of Performance.

The number of times and exact dates on which services will be required cannot be predetermined and will be upon request by the COR or by alternate POC(s) named by the COR. Any pumping required in excess of six in one Period of Performance will be covered under Optional Additional Services, as described in the next section.

2.4 Additional Services: The Contractor shall provide the additional services listed below upon request by the COR or by alternate POC(s) named by the COR. Such services shall meet the same performance standards of the routine services described above. The Government makes no guarantee, express or implied, that all or any of these services will be requested in any given Period of Performance. The Contractor is requested to provide unit pricing for each item listed below in case it should be requested.
