BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.

The meet up location will be the large parking area at the stop sign where State Highway 11 dead ends at County Road 247/Browns Rock Rd in Headquarters, Idaho (approx. cords: 46.630109, -115.810740) and it is about another hour drive to the site. There is some minimal cell reception in the area (no AT&T).

There will be only one site visit offered. Offerors planning to attend must register for the site visit by sending an email to: alan.n.inglis@usace.army.mil Firms must register no later than 10:00 A.M. PST, Tuesday, 26 April 2021 (late submission will not be granted access).

Each individual must have picture identification on his/her person while at the project site. There can be no substitutions of one individual for another. DWORSHAK ELK EXCLOSURE (TEMPORARY FENCING) INSTALLATION

Part 1 – General Information

1.1 General: This is a non-personal services contract to provide installation of temporary fencing on U.S. Army Corps of Engineers (COE) lands in the Grandad Elk Mitigation Area near Dworshak Dam and Reservoir. The Government will not exercise any supervision or control over Contractor employees. Contractor employees shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.2 Objective: The objective of this contract is to install temporary fencing (Elk Exclosure) designed to exclude elk from a select area of habitat in the Grandad Elk Mitigation Area to protect forage plants from ungulate herbivory.

1.3 Background (For Information Only):

1.3.1 Dworshak Dam and Reservoir (Dworshak Project) has several congressionally authorized purposes, one of which is to develop and sustain fish and wildlife habitat. In addition, it has a federal mandate to provide elk habitat (Design Memorandum 15 “The Plan for Development of Rocky Mountain Elk Habitat”). The implementation of this plan resulted in the acquisition and development of the Grandad Elk Mitigation Area, a 6,900 acre block of land designed to meet specific winter elk habitat objectives.

1.3.2 Approximately 3,000 acres of the 6,900-acre Grandad Elk Mitigation Area was clear-cut and burned in the 1970s to promote the production of winter browse for elk. Although the efforts in the ’70s were generally successful, today some of the clear-cut and burn units have very little elk winter forage and are thought to have inadequate seed source of these plants in the ground. Both of these conditions are primarily the result of elk herbivory. Although the ’70s burns provided ample winter forage early on, years of continued elk herbivory have prevented winter forage from maturing, and harsh winters have killed many of the existing plants. Without maturing, these plants are kept from producing seed.

1.3.3 The Elk Exclosure will allow stunted plants to mature and produce seed. After several years, the fencing will be removed by the Government. The plants will have provided a new seed source to the landscape, and the mature, more vigorous plants will also be able to provide food for the elk without compromising plant survival.

1.4 Scope: The Contractor shall be required to transport fencing materials and install approximately 2,710 lineal feet of fencing, designed to exclude ungulates in moderately steep, vegetated terrain. See Part 4 – Specific Tasks, for further details.

1.5 Period of Performance:

1.5.1 General. The performance period of this contract is June 15, 2021, through September 30, 2021; however, the Offeror should note it is the Government’s intent to have this work performed as early within this timeframe as practicable, depending on road access and area conditions.

1.5.2 Coordination. Prior to commencing any work activities at the work site, the Contractor shall attend a pre-work meeting with the Contracting Officer’s Representative (COR) and the Project Technical Point of Contact (TPOC). The purpose of this meeting will be to provide technical clarifications, discuss the Contractor’s work plan, and develop the Activity Hazards Analysis (AHA). The Contractor shall coordinate their work schedule with the COR or TPOC.

1.6 Place of Performance:

1.6.1 Site Access. The Grandad Elk Mitigation Area, including the Long Creek Work Center and the installation site, are depicted in Attachment 1 - Maps. The work site location is remote (approximate coordinates 115°54'32.802"W 46°48'32.09"N). It is approximately 75 road miles (the Contractor should expect at least two hours’ drive time) from downtown Orofino. The fence line can be accessed by a full-sized vehicle on the lower side and upper sides, which occurs on the southwestern and southeastern segment of the proposed fence-line. An 8-foot right of way (ROW) has been bladed around the remaining segments of the proposed fence-line. With caution, an ATV or UTV can be driven around the entire proposed fence-line.

1.6.2 Site Condition. The area is steep and occurs as an opening within a forested landscape. The area being fenced is an old clear-cut and burn area. The primary vegetation occurring within the area being fenced is grass with a few small trees and shrubs. Offerors should expect that the soil will be rocky, and bedrock may be encountered in some areas.

1.6.3 Materials Handling. The Government-provided fencing materials will be stored at the Long Creek Work Center (LCWC), within the Grandad Mitigation Area. The Contractor will be required to transport the materials from the LCWC to the installation site. The LCWC is approximately six and a half road miles from the installation site along 5.3 miles of gravel and 1.1 miles of native surface roads.

1.7 Pre-screen candidates using E-Verify Program: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 30 business days after the initial contract award, or prior to start of work on the ground, whichever is earlier.

1.8 Safety: All work at the site shall be performed in accordance with applicable Occupational Safety and Health Act (OSHA) Standards and the U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM-385-1-1, 2014 edition. The manual is available online at:

Some, but not all, required safety submittals are described in the following paragraphs:

1.8.1 Accident Prevention Plan (APP). The Contractor shall prepare an APP in accordance with EM 385-1-1, Appendix A. The APP must be job-specific and shall include plans for emergency communications and transportation from the location.

*Note: As part of the APP include a site-specific COVID-19 monitoring plan, which addresses at a minimum the following elements:

Procedures for periodic sanitation inspections, Procedures for disinfecting project site/shared vehicles/shared equipment in accordance with CDC guidelines, Site-specific measures to practice social distancing while working on the project, Employee training on the signs, symptoms, and protection measures, in accordance with CDC guidelines.

1.8.2 Activity Hazards Analysis (AHA). The Contractor shall prepare an AHA to address potential hazards that may be present during the performance of the work. The plan shall identify the sequence of work, the specific hazards anticipated during each phase of work, and control measures to be implemented to eliminate the hazard or reduce the risk to an acceptable level, and shall include training required and equipment to be used. Work shall not proceed until the AHA has been reviewed and accepted by the Government.

1.8.3 Accident Reporting. The Contractor shall immediately notify the COR/TPOC, by the quickest means available, of any accident, which does or may result in injuries to the Contractor’s employees or visitors to the work area, damage to the Contractor’s property if the loss exceeds $1,000, and/or damage to Government property, regardless of amount.

1.9 Quality of Work:

1.9.1 Quality Control. The Contractor is responsible for quality control throughout the performance of the contract to ensure work is performed in accordance with, and meeting the standards of, this Performance Work Statement. A written Quality Control Plan will not be required initially but may be required if significant defects are found during periodic inspections.

1.9.2 Quality Assurance. The Government will evaluate the Contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards.

It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.9.3 Warranty. The temporary fence installation shall be covered by a minimum one-year warranty on all labor and workmanship.

Part 2 – Government Furnished Materials

The Government will provide the following materials required for installing the fence. These materials available for pickup at the Long Creek Work Center within the Grandad Mitigation Area. The Contractor will transport all listed materials from the LCWC to the worksite. The Government will retain any materials not utilized for the installation.

6,000 Feet Welded Wire Fencing, 48-inch wide, PVC coated, in 100-foot rolls 95 Corner and Brace Posts, 10-foot lengths, wooden 250 Studded Metal “T” Posts, 10-foot lengths, #1.33 20 Studded Metal “T” Posts, approximately 5-foot lengths, #1.25 or #1.33

Part 3 – Contractor Furnished Materials

3.1 General: The Contractor shall provide all labor, transportation, equipment, tools, and supervision, as well as any materials needed to transport Government-provided materials from the LCWC to the worksite and to install the temporary fencing in accordance with the specification in Part 4 below and in accordance with all applicable safety requirements.

3.2 Materials: The Contractor shall provide all hardware and other materials not identified in Part 2 above that may be required to complete the fence installation. Depending on installation technique, such materials may include:

1½-inch galvanized fence staples 12.5-gauge high tensile wire Fence clips 12.5-gauge ½-inch hog rings 4-inch deck screws Wooden doweling for tightening wire cross bracing

3.3 Sanitation: The work is located at a remote site, which has no electricity or sanitation facilities. The Government will not provide temporary sanitation facilities for the Contractor’s crews at the site.

Part 4 – Specific Tasks

4.1 Transporting Materials: All Government-provided fencing materials shall be safely transported from the LCWC to the installation site in such a manner as to not damage the materials or the road.

4.2 Fencing: The finished fence shall be 7½ feet high to prevent ungulates (elk and deer) from entering the exclosure area.

4.2.1 Assembly Requirements. To achieve this height, the Contractor shall leave a 6-inch gap opening at the bottom and overlap two 48-inch wide welded wire fencing by 12 inches at the center of the fence. Fencing material shall be stretched taut and securely attached to wooden posts, using a minimum of ten 1½-inch galvanized fence staples, and attached to in-line metal posts using a minimum five fence clips. Three hog rings per 10 fence segment will be used to secure the bottom fencing to the upper fencing.

4.2.2 Splicing. Up to three 100-foot rolls of fencing may be spliced together to obtain a greater fence length between stretch-points (attachment to corner, gate, and in-line stretch post assemblies). Splicing must include wrapping all horizontal wire strands from either end of the fencing to the other. Typically, this process includes removing the last vertical wires (stays) from the end of each fence roll (leaving approximately four inches of bare horizontal wire), lining up the two remaining end vertical wires, then tightly wrapping the bare wire from each roll onto the corresponding horizontal wires of the opposing rolls (similarly as depicted in Attachment 2, Figure 3).

4.3 Vertical Posts:

All vertical posts shall be set or driven into the ground approximately 30 inches deep, except single wooden In-line Support Posts shall be placed or driven approximately 36 inches deep.

All vertical posts shall be sturdy and plumb.

Wooden posts may be shaped to a point and mechanically driven into the ground.

Wooden posts set in the ground (not mechanically driven) shall have the backfilled soil tamped down in 6-inch lifts to strengthen posts.

4.4 Post Assemblies: Corner, gate, and stretch posts, and their supporting posts and braces, shall be constructed with wooden posts. The site map, in Attachment 1, indicates the intended fence line and estimated locations of corner, gate, and in-line stretch post assemblies braces. The Contractor shall notch all round wooden posts to allow for a flat attaching surface for all horizontal cross braces. All post assemblies shall have wire cross bracing. Double loops of 12.5-gauge wire will be installed as a figure-8 between corner posts and twisted taut (similarly as depicted in Attachment 2, Figure 2).

4.4.1 Corner Post Assemblies. Approximately five corner braces shall be installed, each with three posts and two horizontal braces (similarly as depicted in Attachment 2, Figure 1). Each post shall be set approximately 10 feet apart to accommodate a 10-foot cross brace.

4.4.2 Gate Post Assemblies. Two in-line gates shall be installed, each approximately 10 feet wide. Exact location of the gates will be determined by the COR or TPOC after contract award.

One side of the gate shall be the end post of either a corner post or an in-line stretch post.

The other side shall be a stand-alone gate post assembly consisting of two posts and one horizontal brace (as depicted in Attachment 2, Figure 2).

One end of the fencing shall be attached directly to a wooden post (swing post).

The other end shall be wired to the opposite gate post (lock post), so that the gate is taut when closed.

The finished gate fencing must act as one unit; that is, the overlap of top and bottom sections of fencing must be lashed together securely, and the edge of the “free” end of the fence secured straight for easy attachment/detachment from lock post.

4.4.3 In-line Stretch Post Assemblies. In-line stretch post assemblies will be required where there are significant directional or gradient changes and as needed to support the end of each spliced or un-spliced fence length. Approximately 16 in-line stretch braces shall be installed, each with two posts and one horizontal brace (similarly as depicted in Attachment 2, Figure 2); Fencing shall be overlapped and attached to the far support post. Each post shall be set approximately 10 feet apart to accommodate a 10-foot cross brace.

4.5 In-line Support Posts: In-line Support Posts shall be installed between Post Assemblies at approximately 10-foot intervals.

Single wooden In-line Support Posts shall be installed such that no length of fence over 100 feet is without a wooden post for support. These support posts should be spaced fairly evenly between Post Assemblies.

Remaining In-line Support Posts shall utilize 10-foot metal studded “T” posts.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (OCT 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [] will, [] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

It [] does, [] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.

(e) Disclosures.

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(B) If not associated with maintenance, the PSC of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(2) of this provision.

52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

2020)

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

(1) The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

(2) After conducting a reasonable inquiry for purposes of this representation, the offeror represents that it [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services.

52.209-2 PROHIBITION ON CONTRACTING WITH INVERTED DOMESTIC CORPORATIONS--

REPRESENTATION (NOV 2015)

(a) Definitions. Inverted domestic corporation and subsidiary have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).

(b) Government agencies are not permitted to use appropriated (or otherwise made available) funds for contracts with either an inverted domestic corporation, or a subsidiary of an inverted domestic corporation, unless the exception at 9.108-2(b) applies or the requirement is waived in accordance with the procedures at 9.108-4.

(c) Representation. The Offeror represents that--

(1) It [ ___ ] is, [ ___ ] is not an inverted domestic corporation; and

(2) It [ ___ ] is, [ ___ ] is not a subsidiary of an inverted domestic corporation.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (FEB 2021)

ALTERNATE I (OCT 2014)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision--

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

"Highest-level owner" means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

"Immediate owner" means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

"Inverted domestic corporation," means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

"Manufactured end product" means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

"Place of manufacture" means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

"Reasonable inquiry" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

"Restricted business operations" means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of…
