SECTION B - SUPPLIES AND SERVI
1. Indefinite-Delivery, Indefinite-Quantity, Firm Fixed Price (FFP) Services for Administrative and General Management Consulting Services, at various locations in Asia and Pacific-Rim. The quantities specified are estimates only for evaluation purposes. The Government will award a contract for a three (3) year base period.
Under FAR Clause 52.217-8, Option to Extend Services, the Government may determine it to be in the best interest to exercise option(s) under this clause up to six (6) months. The Labor Rates used for any option exercised under FAR 52.217-8 shall be the rates from Year 3 included here in Section B.
2. CONTRACT LINE ITEMS NUMBERS (CLINS): CLIN 0001.
(i) Firm Fixed Priced (FFP)
a. Overhead and any indirect costs will be built in and included in the FFP unit price for each CLIN on a Task Order.
b. Other direct costs (materials, equipment, travel, per diem, reproduction, etc.) will be negotiated in each task order.
c. An appropriate profit will be negotiated in each task order.
3. The effective dates will be filled in on pages in this section at the time of award.
4. Each task order issued under the contract will be categorized as FFP, with separate Performance Based Statement of Work.
5. If for any contract line item the Amount is not equal to the product of the unit price and the Estimated Quantity, the Unit Price will be presumed to be correct and the Amount will be adjusted to match.
6. Per Diem shall be in accordance with the Joint Travel Regulations. All other travel related costs shall be based on current competitive rates.
7. Escalation Rate shall be stated on Rate Schedules for Base Period YEARS 2 and 3.
8. Service Contract Act/Davis Bacon Act Wage Determination(s) Incorporated by Reference This contract may incorporates one or more applicable wage determination by reference, with the same force and effect as if they were given in full text. The current wage determination at the time the contract becomes fully executed shall be the determination incorporated by reference. 9. Minimum Guarantee for entire contract = $3K for up to three (3) awards.
PRICING SCHEDULE FOR BASE 3 YEAR PERIOD (YEAR 1)
Contractor shall furnish all plant, labor, material, equipment, etc., necessary to perform all work in strict accordance with the terms and conditions set forth in the contract to include all attachments thereto. The contract’s performance period shall begin upon contract award and proceed for three (3) calendar years (and if in the best interest of the Government, possible option of up to 6 months under FAR 52.217-8 – If any option month is exercised under FAR 52.217-8 the labor rates set forth for Year 3 shall apply. These are Contractually Binding Firm-Fixed Price (FFP) Fully Burdened Ceiling Hourly Rates. The contractor may propose lower rates for any task order, but shall not exceed these maximum rates in task order proposals. (Separate Rate Schedules Required for Prime and All Key Subcontractors)

Section C - Descriptions and Specifications
STATEMENT OF WORK
TITLE: INDEFINITE-DELIVERY, INDEFINITE-QUANTITY (IDIQ) MULTIPLE AWARD FIRM-FIXED
PRICE (FFP) CONTRACT FOR ADMINISTRATIVE AND GENERAL MANAGEMENT CONSULTING
SERVICES, VARIOUS LOCATIONS IN ASIA AND PACIFIC-RIM
1.0 INTRODUCTION
1.1 The objective of this IDIQ Multiple Award Task Order Contract (MATOC) for Administrative and General
Consulting Services, Asia and Pacific Rim is to provide the U.S. Army Corps of Engineers (USACE) with the capability to execute a broad range of activities for U.S. funded project development services as described in Paragraph 2 below. This is a non-personal services contract. Any work issued will be specified in the task order or directed by the Government authority solely to the Contractor Supervisor specified within the task order (TO) proposal. The contract awarded under this solicitation will support various projects for Military Work and Foreign Military Sales, Humanitarian Assistance, and other federally funded projects accommodating the needs of various Federal and local government agencies.
Projects may be located in environmentally sensitive areas that necessitate context-sensitive design techniques and processes. This contract is firm-fixed price (FFP) with contractually binding key personnel labor rates and indirect rates established in Section B.
1.2 This IDIQ MATOC will support of a range of customers serviced by the USACE Alaska District, but primarily support requirements for Humanitarian Assistance Program, as well as, other initiatives undertaken by the Department of Defense (DoD) and other U.S. Government interests. Primary performance locations will be the geographic boundaries of the USACE Pacific Ocean Division which encompasses Asia and the Pacific Rim. The Pacific-Rim includes Hawaii, Japan, Korea, Guam, and Indochina. The Status of Forces Agreement (SOFA) is applicable for Korea and Japan. Task Orders (TO) will be performance-based and will be issued only as firm-fixed price (FFP).
1.3 The Service Contract Act may be applicable to this contract. Work issued under this contract will typically utilize applicable service (Service Contract Act) wage rates, and for the Key Personnel, use the binding labor rates incorporated at Section B of this contract. Depending on the scope of work, construction wage rates may be required and will be included in the individual task orders (TO) when necessary.
1.4 The requirements specified in this statement of work are intended to provide requirements for execution of the contract and a general understanding of the functions that the Contractor may be required to perform under an individual TO. Each individual TO solicitation(s) will contain each project specific work requirements. The Contractor will receive from USACE Alaska District a complete scope of work or plans and specifications for each individual TO. The Contractor shall perform all the work in accordance with the terms and conditions described in each TO performance work statement. The Contractor shall furnish all labor, equipment, materials, and transportation necessary for, or incidental to, performance of the required work. The Contractor shall provide adequate professional supervision and quality control to assure the accuracy, quality, and completeness of the required work.
2.0 DESCRIPTION OF WORK
2.1 Work anticipated under a TO may include: a broad range of activities supporting all phases of project planning, development, design and construction/execution. Final products or contributing reports may be required, however, designs will be ancillary services and the support during construction will be limited to management and reviews. Work on the contract may involve unique planning, construction, environmental, and cultural issues related to work throughout Asia and the Pacific-rim. Services may include Master Planning, facilitation, field investigations, reviews, course of action development, alternative analysis, special studies, planning, cost estimates, planning estimates, cost analysis and coordination of public involvement meetings and hearings and preparation of reports and decision making documents. Quality assurance as well as financial and management oversight of designs and construction
(construction Phase Services) could also be required. The Contractor may be requested to perform both on-site and off-site planning, fieldwork, analysis and preparation of reports and cost estimates as specified in the task orders. The investigative services to be provided may consist of site assessments and performing investigations to determine suitability, contamination, geology and groundwater conditions, hydrology, and geotechnical characteristics, as well as any other related tasks. Data collection requirements shall be established in the task orders and be usable for preparation of further investigation, feasibility study, siting, planning, design, remedy selection. The Contractor shall prepare associated reports as described in each individual task order. Design and construction services will not be required, but technical expertise could be required to review technical feasibility studies and perform due diligence for various infrastructure projects to include roads, utilities; water, water distribution, storage, and treatment; wastewater collection and treatment; power plants and power distribution systems, water resources; dams and reservoirs, and monitoring and evaluation of design and construction. The Contractor may be required to provide a wide variety of incidental engineering services to support requested Tasks. The extent of the engineering services will be described in detail in each individual task order and may include but are not limited to structural, mechanical, electrical, architectural, geotechnical, geological, civil, environmental, cost engineering, constructability reviews, and other engineering support. The Contractor shall perform all necessary planning, fieldwork, and prepare all documents identified in the Task Order. Technical documents shall be representative of industry or Government standards for drawings and specifications or by performance specifications. Professional documents produced under each task order will require a licensed Professional Engineer, Architect and/or a Registered Land Surveyor oversight.
The Contractor must have the capacity to accomplish high-quality work in the required time frame, including the ability to complete more than one task order at a time. The contractor must respond quickly to task orders, requests for proposals, and sometimes complete actions on an accelerated schedule.
3.0 GENERAL CONTRACT INFORMATION
3.1 This is a MATOC IDIQ award for the work herein described and each requirement will be specifically identified in an individual TO. This contract will be effective for a base period of three (3) years after Notice of Contract Award. At the discretion of the Government, if exercised, a possibility of up to six (6) months extension of ordering period in accordance with FAR Clause 52.217-8 Option to Extend Services.
The total ordering period, base and and option period exercised in accordance with FAR 52.217-8, shall be three (3) years and 6 months. Any exercise in accordance with FAR 52.217-8 shall be at the binding rates agreed to for the Year 3 within Section B.
3.2 Delivery or performance shall be made only as authorized by each TO that is issued in accordance with contract DFARS Clause 252.216-7006, Ordering. The Contractor shall furnish to the Government, when and if ordered, work for the items specified in each individual TO. The Government may issue concurrent orders requiring delivery to multiple destinations or performance at multiple locations.
3.3 Any TO issued during the ordering period of this contract and not completed within the contract ordering period shall be completed by the Contractor within the time specified in the TO; however, no task order performance period shall extend more than five (5) years beyond the end of the IDIQ ordering period expiration. The Contract shall govern the Contractor and Government rights and obligations with respect to that TO performance period.
3.4 Unless an exception described in FAR 16.505(b)(2) applies, all awardees in the MATOC pool will be afforded fair opportunity to be considered for award of each order exceeding $3.5K in accordance with FAR 16.505(b)(1).
3.5 Commencement, Execution of Work, and General Work Requirements. The Contractor shall be required to commence the work required by a TO at the time specified on the TO, execute the work, and complete the entire project not later than the completion time specified on the TO. Each individual TO may include requirements that must be met before on-site work can commence.
Work Plan General - When requested in the Task Order Request for Proposal (RFP), the Contractor shall submit a Draft Work Plan (WP) as part of the proposal or upon award of the TO as directed in the TO RFP.
The WP describes the Contractor’s approach to accomplish the activities as outlined in the TO. The WP shall contain (when relevant) how the contractor proposes to apply resources to accomplish the outlined tasks. The WP shall demonstrate the contractor’s understanding of the scope as well as the unique issues arising from the geographic, technical, cultural or logistical aspects of the project. The WP shall be supported by a schedule outlining the requirements to complete any required fieldwork and key project milestones as well as special requirements, key personnel to be used on the project along with their roles and responsibilities; site-specific assumptions and clarifications; site control measures; and description of proposed products. The draft WP will be reviewed and commented on by the Government. The WP shall be modified to address and incorporate the Government's comments and concerns, as appropriate. The plan will be reviewed and accepted by the USACE Contracting Officer Representative (COR) or returned to the Contractor, with comments, for further revision prior to field mobilization. Acceptance of the Contractor's WP by the Government is required prior to any field mobilization. Acceptance is conditional and will be predicated on satisfactory performance during field activities. Deviations or proposed changes to the approved Work Plan must be submitted to the USACE COR for review, comment, and approval. The Government reserves the right to require the Contractor to make changes in his WP and operations as necessary to bring such into compliance with the contract and delivery order. After acceptance of the WP, the Contractor shall notify the Contracting Officer in writing of any proposed change. Proposed changes are subject to acceptance by the Contracting Officer.
Safety and Health Program (SHP) General – For each TO (when relevant), the Contractor shall perform develop and maintain a written safety and health program in compliance with the requirements of OSHA standard 29 CFR 1920.120 (b)129 CFR 1926.65(b) and EM 385-1-1 in effect at the time the task order is issued. Existing written safety and health programs are acceptable if they are modified to cover the criteria in EM 385-1-1, Table 28-1.
Site Specific Safety and Health Plan (SSHP) – The Contractor shall prepare the Site Specific Safety and Health Plan (SSHP) in accordance with the requirements in Corps of Engineers manual, EM 385-1-1, Safety and Health Requirements Manual (latest edition). A SSHP shall be prepared by the Contractor as required by 29 CFR 1910.120 (b)(4) and submitted to the Contracting Officer’s Representative (COR) for review and acceptance prior to commencement of any site activities. All work shall be performed in according to the approved SSHP. The SSHP shall describe the health and safety procedures, practices, and equipment to be implemented and utilized in order to protect affected personnel from the potential hazards associated with the tasks to be performed. The level of detail provided in the SSHP shall be tailored to the type of work, complexity of operations to be accomplished, type of contaminants to be handled, and other hazards anticipated. The most important consideration throughout all aspects of the activities to be performed is the safety and health of all on-site personnel and the surrounding community. The SSHP shall include an Accident Prevention Plan (APP) and address site-specific considerations for all tasks. The Contractor shall submit written evidence (hard copy of document) of their corporate health and safety program.
Project Schedule – A Project Management Information System (PMIS) employing critical path method (CPM) scheduling may be required to develop a comprehensive schedule for an individual TO. A CPM network diagram illustrating the logical interaction among tasks may be developed using the latest version of the commercial software package Primavera and a baseline schedule may be created for the Performance Based Scope of Services to be conducted. The schedule will be approved by the PM. The status of activities in the schedule will be updated to reflect the actual status. The schedule status will be included with Monthly Progress Reports submitted under a TO. The monthly progress report will discuss target and actual completion dates for each element of activity including project completion and provide an explanation of any deviation from the milestones in the work plan schedule.
Other Submittals Applicable Per TO – The Contractor may be required to submit reports, studies, project drawings, shop drawings, manuals, catalogue cuts, and other information.
Conference Notes – The Contractor shall be responsible for taking notes and preparing the reports of all meetings or conferences. Conference notes shall be prepared in typed form and the original furnished to the
Government within seven (7) workdays for concurrence and distribution to all attendees. This report shall include the following items as a minimum: date and place the meeting or conference was held with a list of attendees; roster of attendees; comments made during the conference and decisions affecting criteria changes shall be recorded in the basic conference notes; and document any augmentation of written comments.
Annotated Comments – Written comments presented by the reviewers of the project work plans, project reports, conferences, and other similar reports shall be attached to each submittal with the action noted.
Annotated comment action shall be "A" for Concur with the comment, "B" for Non-concur with the comment, "C" for Check & Resolve with comment, “D” for a comment that has been deleted, “I” for “Information”, "E" for a comment that has been closed by reviewer, and “F” for “Await Reviewer’s Response”. In addition, brief written responses to comments shall be added where appropriate.
Confirmation Notices - The Contractor shall be required to provide, as part of its report, a record of all discussions, verbal directions, telephone conversations, and any other discussions or participation by the Contractor or his representatives on matters relative to this contract and the work. These records, entitled "Confirmation Notices" shall be numbered sequentially, fully identify participating personnel, subject discussed, and any conclusions reached. The Contractor shall forward a reproducible copy of confirmation notices to the Government Project Manager. However, if the notice deals with a change to the statement of work, cost proposal, and schedule, the notice shall be e-mailed to the Contracting Officer's Representative (COR). The Government shall distribute confirmation notices.
Technical Reports - Technical reports shall be prepared and submitted by the Contractor to the Project Manager for each project. All reports shall have a title page/header identifying the Contract and Task Order number; Contractor name; project name; location of project; report type; and date of submittal. The task order statement of work will further specify the submittals or deliverables for each project. The submittal requirements may vary with the project.
Partial Submittals – Partial submittals will not be accepted without prior approval from the Contracting Officer Representative.
Revisions and Addenda - Prior to Government approval, review comments shall be incorporated by revising and reissuing affected pages. If major revisions are necessary the entire document shall be resubmitted.
Addenda sheets may make minor changes affecting only a few pages. The affected pages shall have the revision number and date of correction on the bottom-right corner of the page. Any changes to the work plan shall be submitted under a cover sheet with a list of pages that have been revised. The revised pages the Contractor issues shall cover any additions or changes to the plans or reports. The addendum for the project plan shall be issued prior to the commencement of work for that phase.
Review of Progress and Technical Adequacy - At any appropriate time, representatives of the Contracting Officer may review the progress and technical adequacy of the Contractor's work. Such review shall not relieve the Contractor from performing all contract requirements, except as may be waived by written instructions.
Distribution - The Contractor is responsible for reproduction and distribution of all documents according to the Document Submittal Register or as designated in the TO. Documents shall be mailed via regular mail, a carrier service that may provide overnight service, if needed, or they will be distributed as specified in the
TO.
3.6 Capacity to Accomplish Work. The Contractor must have the capacity to accomplish high-quality work in the required time, including the ability to complete more than one (1) task order at a time. The Contractor shall have experience with multi-discipline task order type contracts that require the ability to respond quickly to task order requests for proposals, tasks, and completion of task projects on an accelerated schedule. The Contractor shall have existing office location(s) for firm and sub-consultants in the contract geographic area and elsewhere, and the distribution of technical and production capabilities, services, and key personnel resources among office locations. The Contractor shall provide all labor, materials, facilities and equipment and perform all work identified in each individual TO. The Contractor may be required to perform work under multiple task orders at different sites simultaneously. The USACE Alaska District Contracting Officer or Contracting Officer’s Representative will provide the Contractor with any site-specific information available upon issuance of each task order. Information provided by USACE on any site will be dependent on the current status of the site. Each task order will define the performance requirements of the Contractor. The Contractor may utilize subcontractors or consultants identified in the accepted proposal or subsequently approved by the USACE Contracting Officer to perform any of the functions required within the specific task orders. The Contractor is encouraged to utilize local expertise as much as possible.
3.7 Notice of Completion of TO. The Contractor shall notify the Government in writing upon completion of each individual TO. The Contractor shall give verbal and email advance notice to the Contracting Officer’s Representative (COR) on the project of the date the work will be fully completed and ready for final inspection. Notice shall be provided at least 30 days prior to the expected completion date.
3.8 Contractor Quality Control: Contractor Quality Control (CQC) is the means by which the Contractor ensures that all work, including that of subcontractors, complies with the contract (and each TO) requirement. The control shall be adequate to cover all operations, including both on-site and off-site activities. The Contractor is responsible for quality control and shall establish an effective quality control system. The quality control system shall consist of plans, procedures, and organization necessary to produce an end product that complies with governing regulations and TO requirements acceptable to the USACE Alaska District. Each individual TO may require project-specific QC plans. Detailed CQC requirements will be specified in the TO scope of work. The Contractor shall have a Quality Control (QC) program that shows project-specific applications of a project management led organizational structure, philosophy, and approach to quality processes, procedures, and techniques within the firm(s) and its sub-consultants on multidisciplinary task orders with independent quality oversight. The Contractor's quality control program shall include inspections and tests as described in the task orders. The Contractor shall establish a strategy that will devote the necessary resources to the task of electronic data management. This proposed strategy shall be stated in detail in the Quality Assurance Project Plan (QAPP).
3.9 Contractor Personnel and Qualifications: The Contractor shall have sufficient experienced personnel to perform, or provide, a wide range of services required. The Contractor shall have personnel with professional qualifications, specialized experience and technical competence of the firm(s) and sub-consultants to perform work in Asia and throughout the Pacific-rim, and work similar to typical Humanitarian Assistance projects and those projects undertaken by U.S. and International Agencies.
Professional qualifications and specialized experience for key personnel in providing services similar to those listed above and including the disciplines listed herein, shall be provided by the Contractor: project management, architecture; master planning; civil; sanitary (water and wastewater treatment); environmental (International standards); mechanical; fire protection; electrical; structural; cost engineering; soils engineering; surveying; agriculture; economics and social science. The Contractor shall employ, either directly or through subcontract, personnel adequate in numbers, skill, and qualifications to accomplish the work required in conformance with the Scope of Work and the schedule of each TO. The Contractor selected for this Contract shall have the experienced personnel to perform, or provide a wide range of services. The number of personnel and individual requirements for on-site and off-site personnel may differ for each TO.
4.0 APPLICABLE DOCUMENTS
4.1 The Contractor shall comply with all applicable federal and local regulations, instructions, manuals, handbooks, regulations, guidance, policy letters, and rules including all changes and amendments in effect on the date of issuance of each task order. The Contractor shall be responsible for acquiring the latest version of applicable regulatory or Agency guidance, including but not limited to the referenced documents cited in this statement of work and/or subsequent task orders issued after award of the Contract, unless otherwise specified. It is the Contractor's responsibility to identify all applicable Federal and local regulations, instructions, manuals, handbooks, regulations, guidance, policy letters, and rules for all work performed and apply the procedures and protocols required. Project-specific documents shall be identified in each task order. The Contractor shall be cognizant of all appropriate laws, regulations, and guidance during the performance of each TO. The Contractor shall ensure that all work activities performed by his personnel, subcontractors and suppliers are executed as required by these laws and regulations. Any incident of noncompliance noted by the Contractor shall immediately be brought to the attention of the Contracting Officer (CO) and/or the Contracting Officer's Representative (COR) by written notice. Nothing in this contract shall relieve the Contractor of his responsibility to comply with these laws and regulations.
Any conflicts between laws/regulations and contract/task order requirements shall be brought to the attention of the CO and/or COR within a reasonable amount of time.
5.0 KEY PERSONNEL
5.1 Key Management Personnel: The key personnel and subcontractors identified in the Contractor’s technical proposal are considered essential to the successful completion of the work. The contractor shall accomplish all work using personnel and sub-consultants with the professional qualifications, specialized experience and technical competence appropriate to perform work in Asia and throughout the Pacific-rim.
Experience in compliance with international laws, standards, regulations, user criteria, or other critical project criteria as related to project management, planning, design and construction. Professional qualifications and specialized experience in providing services similar to those listed above of the team members (including consultants) in the following disciplines: project management, architecture; master planning; civil; sanitary (water and wastewater treatment); environmental (International standards);
mechanical; fire protection; electrical; structural; cost engineering; soils engineering; surveying;
agriculture; economics and social science. The Contractor shall employ, either directly or through subcontract, personnel adequate in numbers, skill, and qualifications to accomplish the work required in conformance with the Scope of Work and the schedule of each task order. The Contractor shall have the experienced personnel to perform a wide range of services. The number of personnel and individual requirements for on-site and off-site personnel may differ for each Task Order.
The key contractor and subcontractor personnel identified below are considered essential to the successful completion of the work. Once approved, the Contractor shall not substitute any identified personnel or subcontractor without prior approval of the Contracting Officer. All proposed substitute personnel or subcontractors must be equal or better than those they are proposed to replace. The Contractor has the burden of providing sufficient information to enable the Contracting Officer to make a determination as to the qualifications of the substitute personnel or subcontractor.
The Contracting Officer will approve all Replacement Key Personnel. Resumes of these individuals may be required as part of task order proposals or whenever a change in personnel is to occur, in order to verify the replacement meets the qualifications of the solicitation. The resumes will be evaluated to determine whether the individuals meet the minimum qualifications and experience necessary to perform their roles and responsibilities under this contract and subsequent Task Orders. The Contractor must identify other key personnel to be assigned to the Contract by name, position, and firm (if other than prime Contractor with address (city/state) where the firm is located) in the organization chart. The resumes will be evaluated to determine whether the individuals meet the minimum qualifications and experience necessary to perform their roles and responsibilities under this contract. The key management personnel include:
5.2 Program Manager – The performance aspects of the entire program shall be under the direct control of a
Program Manager. The Program Manager’s qualifications, experience and performance history shall be satisfactory to the Contracting Officer (KO) and shall, at a minimum, have the following qualifications: A college degree in engineering, construction management, geology, chemistry, or related field. A minimum five (5) years of program/project management experience on US Government program(s)/project(s).
5.3 Contracts Manager – The Contracts Manager shall be responsible for all contractual issues of the program including, but not limited to, contract terms and conditions, invoicing, payment, cost accounting systems, statutory, labor related issues, and subcontracting issues. The Contracts Manager shall have legal authority to represent and obligate the contractor. The Contracts Manager shall possess at least five (5) years of contract management experience on US Government contracts.
5.4 Project Manager (PM) – For each TO issued, the Contractor shall designate a Project Manager (PM); the
Project Manager’s qualifications, experience and performance history shall be satisfactory to the CO before issuance of the Task Order. The PM shall serve as the single point of contact for the Task Order, and shall be responsible for the management of work, approved plans, and all applicable rules and regulations. The PM shall also maintain close communication and coordination with USACE for the duration of the project, including monthly progress and detailed cost reporting. The Project Manager should have the following qualifications: A college degree in engineering, construction management, geology, chemistry, or related field. A minimum of five (5) years of project management experience and with a minimum of three (3) years in work directly related to the Task Order.
5.5 Safety and Health Officer (SSHO) – The SSHO shall ensure that all elements of the approved SSHP are implemented and enforced on-site. The qualifications of the SSHO should include: Authority to shut down the site work when Health and Safety becomes an issue is required.
5.6 Other Personnel – The Contractor will utilize personnel that possess the education, experience, certification and licenses appropriate to successfully complete the project. Task Orders may specify minimum qualifications for positions in addition to those listed in the base contract. The Contracting Officer may request the resumes of any of these personnel to verify that they meet the minimum requirements set forth in this Section C before task order award. Note that resumes of some personnel may be required to be submitted when submitting a proposal for an individual task order.
5.7 Personnel Registration and Training Costs: Any registration, certification and training costs required to perform TO work under this contract shall be the responsibility of the Contractor. This includes any training costs necessary to perform in compliance with this Section C and with any work specified in a TO performance work statement (PWS). The Contractor shall obtain all necessary professional registration, certification, and training, when applicable for where work is to be performed, as specified in each TO prior to the start of work.
6.0 GOVERNMENT FURNISHED FACILITES AND PROPERTY
Government facilities will not be furnished to the Contractor in support of this IDIQ MATOC. Any Government furnished materials will be identified in an individual TO. Unless otherwise specified in the TO, the Contractor shall provide all equipment and supplies. Equipment/non-disposal supplies purchased under the contract shall become the property of the Government at the end of the contract.
7.0 LOGISTICAL SUPPORT
Work could include support to military contingency operations for infrastructure and facility improvements. The Contractor will normally be responsible for all required logistics support. For work in foreign countries, the Contractor will be provided letters of entry indicating work is for the U.S.
Government. The Contractor will be responsible for obtaining Visas and all necessary entry permits. In some instances, the Contractor may be part of a Government team to provide specialized expertise and will be furnished logistics in these situations.
8.0 ENVIRONMENTAL PROTECTION REQUIREMENTS
The Contractor shall perform all work in a manner that minimizes the pollution of air, water or land and develop contingency measures for cleanup of any spills that may occur during performance of this contract.
The allowable correction costs of spills incurred by the Contractor shall be determined by the contract clauses "Allowable Cost and Payment", "Insurance - Liability to Third Persons" and any other applicable clauses. The Contractor shall control noise and dust within reasonable limits or limits established by applicable federal, state, and local laws and regulations. A site survey may be required to identify any wetlands, endangered species, special habitat or other protected areas. Task Orders may include specific environmental protection requirements.
9.0 PUBLIC RELATIONS
The Contractor shall have personnel qualified to provide public relations support, if required. In the event of the need to provide such support the task order will be modified to compensate the Contractor for the additional services required. All public relations shall be coordinated through the Project Manager.
10.0 SECURITY
The Contractor shall provide site security (e.g. fencing or guard service) as required by each individual TO.
However, at a minimum, the Contractor shall maintain the site and all other Contractor controlled areas in such a manner as to minimize the risk of injury or accident to site personnel or others who may be in the area. When work is performed at a military installation the Contractor shall comply with all security requirements of that installation. Any TO in remote locations with austere conditions will be coordinated with the U.S. State Department and host nation for security guidance. The safety of Contractor employees is of paramount importance. In areas where access is restricted the services required could be subcontracted to local firms.
11.0 RELEASE OF INFORMATION
The information developed, gathered, and assembled in fulfillment of the contract required as defined in or related to the Scope of Work shall not be released by the Contractor, his/her consultants, his/her subcontractors or their associates without prior coordination and approval by the Contracting Officer.
12.0 USE OF INFORMATION
The information developed, gathered, and assembled in fulfillment of the contract requirements as defined or related to the Scope of Work will become the property of the Government and shall not be used by the Contractor for other purposes at any time without the written consent of the Contracting Officer.
13.0 GOVERNMENT OBSERVATION
A Government quality assurance team from U.S. Army Corps of Engineers and the Contracting Officer may visit the job site without notification.
14.0 WORK SCHEDULE
The Contractor shall submit work procedures with a timetable and the work progress schedule (WP & WPS) to the Contracting Officer (CO) at least one (1) calendar week before the work starts. The CO will notify the Contractor to start the assessment services no less than three calendar days before the required date. The Contractor shall start the services from the required date.
15.0 POST CONSTRUCTION CLEANUP
The Contractor shall clean up all areas used for temporary construction and operation of equipment. The Contractor shall, unless otherwise instructed in writing by the Contracting Officer, remove all signs of temporary construction facilities, work area, and other debris generated by the Contractor. All disturbed areas shall be graded, filled and the entire area seeded otherwise indicated.
16.0 CONTRACTOR MANPOWER REPORTING
16.1 (Only Applicable to Military Funded Task Orders) The Contractor shall report ALL contractor and subcontractor labor hours required for performance of services provided under this contract via the DoD Electronic Contractor Manpower Reporting Application (eCMRA) website. The Contractor is required to completely fill in all required data fields using the following web address: http://www.ecmra.mil/ (2020 and reporting thereafter required to be completed at SAM.Gov). Information regarding changes to the reporting process, when data should be entered, general police information, how data is protected, and how to enter certain data can be found under the Frequently Asked Questions (FAQ) section at the eCMRA website. The Contractors shall fill in the required information on the website, fields are shown below:

Contractor Manpower Reporting Period: Reporting period will be the period of performance not to exceed 12 months ending September 30 of each Government fiscal year (FY) end, beginning with FY2020.
CMRA must be reported by 31 October of each calendar year. Contractors may direct technical questions to the help desk at http://www.ecmra.mil. (will be www.SAM.Gov for FY20 and beyond). Reporting will be at the TO level and inputs will be for the labor executed during the appropriate Government FY period.
Contractor Manpower Reporting Contract Line Item (CLIN): The Contractor shall include a FFP proposal for the cost to comply with this reporting requirement in their TO price proposal. If the CMRA is funded by a DoD Military Funding Line, and if CMRA requirement is proposed as being covered under indirect costs of the Contractor) within the Task Order Proposal Schedule for Contractor, there will be a separate FFP CLIN (or Not-Separately-Priced (NSP) CLIN) on the TO.
