PERFORMANCE WORK STATEMENT

1. GENERAL INFORMATION: This BASE YEAR + FOUR OPTION YEARS Service Contract provides water quality testing at various locations within the USACE Lucky Peak Dam & Lake boundary located in Ada and Boise Counties, ID. The Contractor shall be responsible for all costs related to performing this contract and its successful completion.

2. WORK TO BE PERFORMED: The Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to collect and test drinking and surface water as defined in this performance work statement (PWS), unless specified otherwise, at Lucky Peak Dam and Lake. The Contractor shall perform to the standards in this contract. The quantities of work are listed here:

AA. Surface water quality testing – weekly E.Coli. The contractor shall collect water samples from three shoreline access areas, Barclay Bay, Macks Creek, and Robie Creek, and have subsequent laboratory tests performed, by a state certified lab, in accordance analytical methods contained in Idaho State Code, IDAPA 58.01.02 specifically for Bacteria tests (E. Coli) in Recreation waters. These tests will be performed on a weekly basis beginning on the first week the lake elevation reaches 3050 feet above sea level until the level drops below 3050’ no later than 30 September of any year. The samples must be collected no more than seven days apart.

The contractor must submit analytical reports to the COR within 1 day of receipt to the contractor. The contractor must notify the COR within 2 hours of any violations to the thresholds of the state water quality standards.

AB. Surface water quality testing – As Needed E.Coli. When notified by the COR the contractor must perform additional surface water tests. These tests may be requested following an unusually high test result, or to provide sufficient tests to calculate a Geometric Mean Criterion as defined in IDAPA 58.01.02. These tests will be the same tests as specified Line Item AA. Tests must be performed within 24 hours of notice from the COR.

AC. Drinking water quality testing – quarterly. The contractor must collect water samples from one public drinking water system and two private wells (Macks Creek PWS ID4080078, and Barclay Bay host site and Project office), and have subsequent laboratory tests performed, by a state certified lab, in accordance with analytical methods contained in Idaho Sate Code, IDAPA

58.01.08. These tests will be performed on a quarterly basis. The Quarters are designated as follows:

1st quarter April thru June, 2nd quarter July thru September, 3rd Quarter October thru December, and 4th quarter January thru March. The contractor must submit analytical reports to the COR within 1 day of receipt to the contractor. The contractor must notify the COR within 2 hours of any violations to the thresholds of the state water quality standards. The two private wells shall be tested to the same standards as the public water system. If any sample detects the presence of Coliforms the contractor shall, at no additional cost, perform a resample and submit for testing within 24 hours. Drinking water quality tests shall also be submitted to the Idaho Department of Environmental Quality.

AD. Drinking water quality testing – yearly nitrate. The contractor must collect water samples from one public drinking water system and two private wells (Macks Creek PWS ID4080078, and Barclay Bay host site and Project office), and have subsequent laboratory tests performed, by a state certified lab, in accordance with analytical methods contained in Idaho Sate Code, IDAPA 58.01.08. Nitrate testing will be performed on a yearly basis during the 2nd quarter July thru September during same visit as the E.Coli test.

The contractor must submit analytical reports to the COR within 1 day of receipt to the contractor. The contractor must notify the COR within 2 hours of any violations to the thresholds of the state water quality standards. Drinking water quality tests shall also be submitted to the Idaho Department of Environmental Quality.

AE. Drinking water quality testing – base year nitrite. The contractor must collect water samples from one public drinking water system at Macks Creek PWS ID4080078, and have subsequent laboratory tests performed, by a state certified lab, in accordance with analytical methods contained in Idaho Sate Code, IDAPA 58.01.08. Nitrite testing will be performed during each year of the contract July thru September during same visit as the E.Coli test. The contractor must submit analytical reports to the COR within 1 day of receipt to the contractor. The contractor must notify the COR within 2 hours of any violations to the thresholds of the state water quality standards. Drinking water quality tests shall also be submitted to the Idaho Department of Environmental Quality.

AF. Drinking water quality testing – As needed. The contractor shall collect additional drinking water samples at the request of the COR at one or more of the designated areas. These tests may be requested following water system maintenance or the validation of any failed test. These tests will be the same as in line item AE. The contractor must submit analytical reports to the COR within 1 day of receipt to the contractor. The contractor must notify the COR within 2 hours of any violations to the thresholds of the state water quality standards. The two private wells shall be tested to the same standards as the public water system. If any sample detects the presence of Coliforms the contractor shall, at no additional cost, perform a resample and submit for testing within 24 hours. Drinking water quality tests shall also be submitted to the Idaho Department of Environmental Quality.

3. PERIOD OF PERFORMANCE: This contract consists of a Base Year and four Option Years. The Government may elect to exercise each Option Year.

a) Base Year (CLIN 0001) will be from 1 July 2021 through 31 March 2022.

b) Option Year 1 (CLIN 1001) will be from 1 April 2022 through 31 March 2023.

c) Option Year 2 (CLIN 2001) will be from 1 April 2023 through 31 March 2024.

d) Option Year 3 (CLIN 3001) will be from 1 April 2024 through 31 March 2025.

e) Option Year 4 (CLIN 4001) will be from 1 April 2025 through 31 March 2026.

4. CONTRACT MANAGER: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person, and an alternate or alternates, who shall act for the Contractor when the manager is absent, shall be designated in writing to the Contracting Officer.

a. The Contract Manager or alternate(s) shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract.

b. The Contract Manager or alternate(s) shall be available during normal duty hours within 4 hours to discuss problem areas.

c. The Contractor Manager and alternate(s) shall be able to read, write, speak, and understand English.

5. CONTRACTOR EMPLOYEES: The Contractor shall not employ persons for work on this contract if such employees are considered by the Contracting Officer to be a potential threat to the health, safety, security, general well-being, or operational mission.

a. The Contractor’s personnel shall present a neat appearance and be easily recognized as contractor employees.

b. The Contractor shall make sure employees have current and valid professional certifications necessary before starting work under this contract. Commercial driver’s licenses are required as determined by state and local regulations.

c. The Contractor shall not employ any person who is an employee of the U.S. Government if employing that person would create a conflict of interest.

6. CONTRACTOR QUALITY CONTROL PROGRAM: The Quality Control Program is the means by which the Contractor assures himself and the Contracting Officer’s Representative (COR) that adequate inspections of work performance are being conducted so that all work meets contract specifications. The Contractor’s Quality Control Program shall be established and maintained for all services included in the contract and shall include the surveillance required to meet all contract specifications regarding schedule compliance, proper equipment, materials, and work performance. The Contractor shall be responsible for controlling work quality through an effective quality control program involving management, training, and sufficient inspections of all work items to ensure compliance with all contract requirements.

7. QUALITY ASSURANCE: For tasks listed on the PRS (Section 9), the COR will follow the methods or surveillance specified in this contract. Government personnel will record all surveillance observations. When an observation indicated defective performance, the COR will require the Contract Manager or representative at the site to initial the observation. The initialing of the observation does not necessarily constitute concurrence with the observation, only acknowledgement that he or she has been made aware of the defective performance. Any action taken by the Contracting Officer as a result of surveillance will be in accordance with the terms of this contract.

8. ANTITERRORISM/OPERATION SECURITY (AT/OPSEC)

8.1 SUSPICIOUS ACTIVITY REPORTING TRAINING: The contractor and all associated sub- contractors shall receive a brief/training on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.

8.2 PRE-SCREEN CANDIDATES USING E-VERIFY: The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

9.1. SURVEILLANCE: Surveillance will be accomplished using the following Performance Criteria Analysis. If performance is not satisfactory to the percentage listed in the AQL, the COR will notify the contractor’s site manager, with a telephone call, as soon as practicable and ask the contractor to correct the problem.

If a safety issue arises from the Contractor’s unacceptable performance, the Contractor will be given notification and 4 hours to correct the unacceptable performance. The COR may approve additional time if needed. If it is not a safety issue the contractor will have three days to correct any deficiencies. The COR will notate on the Performance Criteria Analysis the date, time, and location of the deficiency and send a copy to the Contractor to sign and return to the COR within 3 business days.

10. PRE-WORK MEETING: The Contractor will meet with the Contracting Officer Representative at least five days prior to commencement of work to discuss contract requirements and provide proof of meeting the following requirements: (1) General park orientation; (2) Valid Idaho Driver’s License; (3) General Liability Insurance; (4) Automobile Liability Insurance; (5) Worker’s Compensation Insurance (if you have employees); (6) Submittal of required licenses and/or administrative materials; (7) Safety and first-aid responsibilities; (8) Contract scope of work and compliance; (9) Acceptable performance standards; and (10) Billing procedures.

11. CALL-OUT NUMBER: The Contractor will maintain a telephone number(s) and means of contact 24 hours a day, every day. The contact will be a person, answering service or machine. Once the Corps has notified this contact, the Contractor will be considered officially notified when called for problems or other work-related items.

12. KEYS: The Contractor will be responsible for all keys issued. Keys are for the exclusive use of the Contractor and authorized employees while performing the specified services and will be returned to the Lake Office within 48 hours of the completion of services. The Contractor will be liable for any costs involved in changing locks due to lost keys. Key loss will be reported immediately.

13. CERTIFICATION: The Contractor will hold all licenses and certifications required by the State of Idaho, Ada County and Boise County as needed and will provide proof of such certification before the start of work. The Contractor will be responsible for any permits required to perform services.

14. EQUIPMENT: Employees will utilize necessary safety equipment which may include but not be limited to safety shoes, safety glasses, face shields, hard hats, hearing protection, work gloves and/or other additional personal safety equipment required for specific work duties. Vehicle use will be restricted to pavement, dirt, or gravel roadways. Off-road operation of Contractor vehicles will be prohibited unless provided specific exception by the Contracting Officer Representative. The equipment used by the Contractor for the specified service will be in satisfactory operating condition and will be maintained in this condition. The Government reserves the right to require the Contractor to discontinue the use of unsatisfactory equipment and to require that such equipment be replaced with acceptable equipment to maintain contract compliance. The decision of the Contracting Officer as to serviceability of the equipment will be final. Equipment will meet current Federal, State and local safety requirements and all applicable requirements of the Corps of Engineers Safety Manual, EM 385-1-1.

15. PROTECTION OF GOVERNMENT FACILITIES: The Contractor will be responsible for restoring any Government facilities or property damaged as a result of Contractor's operations, including natural features.

Reasonable care will be used to avoid damage to existing structures, equipment, facilities, and vegetation in the areas serviced. Any damage will be repaired, or the items replaced at no cost to the Government. If the Contractor will not make such repair or replacement, the cost thereof will be deducted from normal contract payments.

16. ABILITY TO PERFORM: The Contractor will have sufficient equipment and labor to perform services prescribed. If for any reason the Contractor will be unable to perform any service as scheduled, the Contracting Officer Representative will be notified in advance.

17. SERVICE & PAYMENTS: Invoices will be submitted in arrears to USACE Lucky Peak Lake, 9723 E HWY 21, Boise ID 83716. Invoices will be verified by the Contracting Officer’s Representative before payment can be authorized.

18. ACTIVITY HAZARD ANALYSIS: The Contractor shall submit an Activity Hazard Analysis on all phases of the work to be performed prior to the start of service. 19. INSURANCE: A submittal showing a certificate of liability insurance shall be submitted to the COR prior to the commencement of work.

20. SAFETY EXPOSURE REPORT: The Contractor shall submit a Safety Exposure Report to the Park Manager with each invoice documenting work-hours accrued, work-related injuries, illnesses and fatalities sustained by Contractor employees while providing services at Lucky Peak Dam & Lake over the invoice period. Failure to submit a Safety Exposure Report with the invoice will delay payment for services performed.

21. SAFETY AND HEALTH CODES: The Contractor will comply with all pertinent provisions of the Corps of Engineers Manual, EM 385-1-1, Safety and Health Requirement Manual, the Idaho State Health Code, OSHA, and Ada, Boise County Codes.

22. UNSAFE CONDITIONS: Work will be halted by the Contracting Officer or his representative if an unsafe condition exists or will develop if work continues. The Contractor will have no basis for compensation should such a work stoppage cost the Contractor damages. Work will not resume until the condition is corrected.

ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Submission of Price Quote – Offeror shall submit 1 copy of the following:

1. Signed and dated Standard Form 1449 (Solicitation/Contract/Order for Commercial Items)

2. Signed and dated Standard Form 30, if applicable, for any Amendments to the Solicitation

3. Completed schedule (pricing information) for all contract line item numbers

4. Completed Clause 52.212-3 and Alt I, “Offeror Representations and Certifications—Commercial Items” as noted above.

PRICES QUOTED MUST BE VALID FOR 30 DAYS. Solicitation shall result in a firm-fixed-price contract.

All pricing shall include shipping FOB destination (include shipping cost in price).

BUSINESS HOURS: The standard business hours for the Walla Walla District, Corps of Engineers are Monday through Friday from 8:00 a.m. to 4:00 p.m., excluding federal holidays.

BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.

Bidder Inquiry:

All inquiries regarding this solicitation are to be submitted via Bidder Inquiry. Telephone and email inquiries will not be accepted. Bidder Inquiry is a web-site that allows bidders to post questions regarding the solicitation and view all questions by other bidders and responses by USACE. 52.204-26 COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES--REPRESENTATION (OCT

2020)

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

(1) The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.
