INSTRUCTIONS TO OFFERORS
This is a request for quote to provide solid waste removal, including recycling, at vehicle accessible facilities at various locations within the USACE Lucky Peak Dam and Lake boundary located in Ada and Boise Counties, Idaho, in accordance with the performance work statement for the U.S. Army Corps of Engineers, Walla Walla District, at Lucky Peak Dam and Lake, Boise, ID.
Registration at www.beta.sam.gov is required. Failure to register in the SAM database will make an offeror ineligible for award. Effective 29 April 2018, the notarized letter process is now mandatory on all CURRENT registrants at SAM who have a requirement to update data on their SAM record. The notarized letter is mandatory and is required in order for the GSA Federal Service Desk (FSD) to activate the entity's registration. Both Federal Assistance entities and all non-Federal entities must mail the original, signed copy of the notarized letter to the Federal Service Desk. Failure to do so within 30 days of activation may result in the registration no longer being active. Mail the completed, signed, notarized letter to:

ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS
Submission of Price Quote – Offeror shall submit 1 copy of the following:
1. Signed and dated Standard Form 1449 (Solicitation/Contract/Order for Commercial Items)
2. Signed and dated Standard Form 30, if applicable, for any Amendments to the Solicitation
3. Completed schedule (pricing information) for all contract line item numbers
4. Completed Clause 52.212-3 and Alt I, “Offeror Representations and Certifications—Commercial Items” as noted above.
PRICES QUOTED MUST BE VALID FOR 30 DAYS. Solicitation shall result in a firm-fixed-price contract.
All pricing shall include shipping FOB destination (include shipping cost in price).
BUSINESS HOURS: The standard business hours for the Walla Walla District, Corps of Engineers are Monday through Friday from 8:00 a.m. to 4:00 p.m., excluding federal holidays.
BASIS FOR AWARD
The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.
Bidder Inquiry:
All inquiries regarding this solicitation are to be submitted via Bidder Inquiry. Telephone and email inquiries will not be accepted. Bidder Inquiry is a web-site that allows bidders to post questions regarding the solicitation and view all questions by other bidders and responses by USACE. Bidder Inquiry can be accessed through ProjNet at (https://www.projnet.org)
To submit and review inquiry items, prospective vendors will need to use the Bidder Inquiry Key presented below and follow the instructions listed below the key for access. A prospective vendor who submits a comment /question will receive an acknowledgement of their comment/question via email. Another email to the same address will notify the prospective vendor once the reply is available for viewing.
TIMING OF BIDDER INQUIRIES: Bidders are encouraged to submit their bidder inquiries promptly. The Government will make every effort to answer all bidder inquiries; however, the closer to the bid or proposal due date an inquiry is received, the less likely it is that a timely response can be provided.

Specific Instructions for ProjNet Bid Inquiry Access:
1. From the ProjNet home page linked above, click on Quick Add on the upper right side of the screen.
2. Identify the Agency. This should be marked as USACE.
3. Key. Enter the Bidder Inquiry Key listed above.
4. Email. Enter the email address you would like to use for communication.
5. Click Continue. A page will then open saying that a user account was not found and will ask you to create one using the provided form.
6. Enter your First Name, Last Name, Company, City, State, Phone, Email, Secret Question, Secret Answer, and Time Zone. Make sure to remember your Secret Question and Answer as they will be used from this point on to access the ProjNet system.
7. Click Add User. Once this is completed you are now registered within ProjNet and are currently logged into the system.

PERFORMANCE WORK STATEMENT
GENERAL
This will be a firm fixed price service contract with (1) base year and four (4) option years to provide solid waste removal, including recycling, at vehicle accessible facilities at various locations within the USACE Lucky Peak Dam & Lake boundary located in Ada and Boise Counties, ID. The Contractor shall be responsible for all costs related to performing this contract and its successful completion.
1. DESCRIPTION OF SERVICES - The contractor shall provide all management, refuse containers, tools, supplies, equipment and labor necessary to ensure that waste and refuse disposal services are performed at, Lucky Peak Project Office, Barclay Bay, Turner Gulch, Spring Shores Marina, and Macks Creek. The containers will be emptied once each week unless otherwise noted.
1.1. BASIC SERVICES FOR REFUSE CONTAINERS - The contractor shall provide refuse container
(dumpster) rental units to be delivered, placed, secured, serviced, and removed, as specified by the Government. Quantities and sizes of containers and duration of rental shall be as specified in the contract.

1.1.1. REFUSE CONTAINER SPECIFICATIONS – The contractor shall supply refuse containers in good operational condition with closeable covers or lids that can be secured in case of an air ambulance landing.
1.1.2. PROVIDE REFUSE REMOVAL AND DISPOSAL SERVICES - The contractor shall empty containers and haul all waste and refuse to an approved landfill for disposal.
1.1.3. PROVIDE MAINTENANCE AND REPAIR SERVICES - The contractor shall be responsible for all repairs of containers and hardware associated with it. All repairs should be completed within seventy-two hours after it was reported by the Government. The contractor shall provide maintenance and repair services to containers, to include furnishing replacement parts as needed.
Replacement parts shall include but not limited to; wheels, covers or lids, and any attachment hardware that facilitates the dumping of the unit into the truck for removal. If the container must be removed for repairs, contractor shall provide a replacement container at the time it removes the container needing repairs.
1.1.4. UNFORESEEN VANDALISM – In the case of extensive vandalism the contractor shall request an equitable adjustment which will be evaluated by the Government.
1.2. GENERAL INFORMATION
1.2.1. Period of Performance. The period of performance shall be for one Base Period of 10 months and four 12-month Option Periods. The Period of Performance reads as follows:
Base Period July 1, 2021 – April 30, 2022 Option Period 1 May 1, 2022 – April 30, 2023
Option Period 2 May 1, 2023 - April 30, 2024 Option Period 3 May 1, 2024 - April 30, 2025 Option Period 4 May 1, 2025 - April 30, 2026
2. SERVICE DELIVERY SUMMARY.
The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.

4. QUALITY ASSURANCE - The Government will evaluate the contractor’s performance by appointing a representative(s) to monitor performance to ensure services are received. The Government representative will evaluate the contractor’s performance through on-site inspections and receipt of complaints from base personnel. The Government will receive and investigate complaints from various customer/users. The Government representative shall make final determination of the validity of customer/user complaints.
4.1. CONTRACTOR QUALITY CONTROL PROGRAM - The quality control program is the means by which the Contractor assures themselves and the Government representative that adequate inspections of work performance are being conducted so that all work meets contract specifications. The Contractor's Quality Control Program shall be established and maintained for all services included in this contract.
4.2. GOVERNMENT QUALITY ASSURANCE
4.2.1. INSPECTIONS - The Government will evaluate performance under this contract for those tasks listed on the PWS. The Government representative will follow the methods of surveillance specified. Government personnel will record all QA inspections, and the Government representative will retain such records.
4.2.2. QUALITY ASSURANCE - The Government will evaluate the contractor’s performance by appointing a representative to monitor performance to ensure services are received. The Government representative will evaluate the contractor’s performance through random inspections and receipt of complaints from project personnel or the public. The Government will receive and investigate complaints from various customers/users. The Government representative shall make final determination of the validity of the customer/users complaints.
4.2.3. DEFICENCIES - If the services do not conform to contract requirements, the Government representative may require the contractor to re-perform the services to achieve compliance at no additional expense to the Government. An oral or written notice of deficiencies to be corrected and whether the work can be re-performed will be given to the contractor or designated representative. After notification, for every day the work is not completed, 1/30th of the unit price will be deducted for the unit/line item in question.
4.2.4. PRE-WORK MEETING. The contractor shall meet with the COR at Lucky Peak Dam and Lake, 9723 East Highway 21, Boise, ID 83716, within ten (10) working days of award of the contract and prior to the beginning of work, at a time mutually agreeable to the contractor and the COR.

5. PROTECTION OF GOVERNMENT RESOURCES
5.1. GENERAL - For the purpose of this specification, protection of resources is defined as the retention of the natural environment and manmade structures in their present state to the greatest possible extent.
5.2. DISPOSAL OF WASTE MATERIALS - Disposal of any materials, wastes, effluents, trash, garbage, chemicals, etc., in areas adjacent to drainage ditches, ponds, or lakes shall not be permitted. If any waste material is dumped in unauthorized areas, the Contractor will remove the material and restore the area to its original condition.
5.3. ENVIRONMENTAL PROTECTION - This paragraph prescribes actions required for the prevention of environmental pollution during and as the result of operations under this contract. For the purpose of this specification, environmental pollution is defined as the presence of chemicals, physical or biological elements, or other agents which adversely affect human health or welfare, unfavorably alter ecological balances, affect other species, or degrade the utility of the environment for aesthetic and recreational purposes. In order to prevent and to provide for abatement and control of any environmental pollution arising from activities in performance of this contract, the Contractor shall comply with all applicable Federal, State, and local laws and regulations concerning environmental pollution control and abatement.
6. SAFETY
6.1. SAFETY STANDARDS - The Contractor shall comply with all applicable Occupational Safety and Health Act (OSHA) Standards, Washington State Industrial Safety Standards, and the Corps of Engineers' Safety requirements manual EM 385-1-1, dated 3 September 1996, as amended. A copy of the Corps of Engineers Safety manual can be viewed online at http://www.usace.army.mil/inet/usace-docs/eng-manuals/em385-1-1. The Safety Standards are subject to change and such changes may affect the Contractor in their performance under the contract. It is the Contractor's responsibility to know such changes and to take immediate action to implement those changes. Any potentially hazardous condition will be corrected and a fixture posted with an appropriate sign such as; “Closed” or “Out of Service”.
6.2. ACCIDENTS - The Contractor shall notify the Government representative immediately of damage to
Government or private property and injury to any person resulting from their operations. In the event that an accident or injury should occur on Government lands, the Contractor shall first notify the appropriate local emergency service organization and then the Government representative. See Section 2 of EM 385- 1-1.
6.3. PROTECTION FROM COMMUNICABLE DISEASES - The Contractor shall be responsible for any and all information and protective devices necessary for employees to work in and around jobs requiring cleaning and/or removal of human wastes or body fluids. Typical protection will be approved rubber gloves, disposable cover-alls, etc. It will be the Contractor's responsibility to assure that all employees follow proper hygienic, disposal and cleanliness practices.
7. CONTRACTOR'S OPERATIONS
7.1. LICENSES AND PERMITS- The contractor shall, without additional expense to the Government, obtain all necessary licenses and permits for complying with any applicable Federal, State, and local laws, codes, and regulations in connection with the performance of work. A submittal showing a certificate of liability insurance shall be submitted to the Park Manager prior to the commencement of work.
7.2. CONTRACTOR PERSONNEL - The contractor shall perform all work under this contract with their own forces unless otherwise approved by the Government representative. Employees who perform this work shall be qualified persons on the Contractor's own payroll. Contractor shall provide information to the Government representative to include all employees full name. Any changes in the contract employee’s staff will be provided to the Government representative within three (3) working days. All work under this contract shall be performed in a skillful and workmanlike manner. All contractor personnel shall be subject to all current regulations and policies governing the public use of the lands and waters of the project except those that are specially waived under this contract.
7.3. VEHICLES AND EQUIPMENT - All vehicles must be equipped and operated in compliance with all applicable State laws governing safety, pollution control, licensing, and operation. Contractor vehicles shall travel at posted speeds on roadways within the contract area and shall yield to pedestrians, bicycles, and emergency vehicles. Existing access roads will be kept open to traffic at all times.
7.4. SPILLAGE ON ROADS - Spillage of foreign material on project, State, or County roads from Contractor vehicles shall not be permitted.
8. GENERAL INFORMATION
8.1. HOURS OF OPERATION - Work under this contract is normally performed 7:30 A.M. through 4:00
P.M., Monday through Friday. Additionally the contractor may be required to perform services after duty hours and weekends as required.
8.2. HOLIDAYS - Normally work is not required on the following days unless otherwise required.

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(c) Representation. The Offeror represents that it [ ___ ] does, [ ___ ] does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.

(a) Definitions. Inverted domestic corporation and subsidiary have the meaning given in the clause of this contract entitled Prohibition on Contracting with Inverted Domestic Corporations (52.209-10).
