Section A - Solicitation/Contract Form
COMBINED SYNOPSIS
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes only the solicitation; proposals are being requested and a written solicitation will not be issued.
The solicitation number for this acquisition is W912DQ20T1006 and it is being issued as a Request for Quote(RFQ).
The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2020-07.
This RFP shall be competed as unrestricted and the associated North American Industry Classification System (NAICS) code is 238990 Playground equipment installationContractors and the business size standard is $16.5 Million. The Product/Service Code is J078 Definition: Maintenance, Repair, and Rebuilding of Equipment- Recreational and Athletic Equipment.
FAR 52.212-1, Instructions to Offerors – Commercial, does apply to this acquisition with no addenda to the provision.
FAR 52.212-2, Evaluation – Commercial Items, does apply to this acquisition. The specific evaluation criteria to be included are detailed in Section M of this combined synopsis/solicitation.
Offerors must include a completed copy of FAR 52.212-3, Offeror Representations and Certifications – Commercial Items, with its offer. This provision is included in Section K of this combined synopsis/solicitation.
FAR 52.212-4, Contract Terms and Conditions – Commercial Items, does apply to this acquisition with no addenda to the provision.
FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items, applies to this acquisition. The specific clauses required are detailed in Section I of this combined synopsis/solicitation.

ANTITERRORISM
Access and General Protection/Security Policy and Procedures. This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes."
Suspicious Activity Reporting Training (e.g. I WATCH, Corps Watch, or See Something, Say Something). This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. Proposed language: "The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training."
Will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas. The contractor will coordinate with the COR and/or the facility security office for access when required. (Use when security clearances are not required, i.e. facility repair or construction). Proposed language: "All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas."
Pre-screen candidates using E-Verify Program. Proposed language: "The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award." *When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

WORK DESCRIPTION
DESCRIPTION OF WORK AND GENERAL REQUIREMENTS
1. DESCRIPTION OF WORK:
1.1. Requirements:
The Contractor shall replace the existing playsystem located at the Venango Park swim beach day use area. Work includes removal of the existing system and providing and installing new system in accordance with the attached specifications.
1.2. Location: Kanopolis Project Office

1.3. Work Hours: Negotiable with Contracting Officer Representative (COR) or Operations Project Manager (OPM). Work will not be allowed on weekends unless approved in advance by the PM.
2. PRINCIPAL FEATURES: The work to be performed will include, but not be limited to, the following principal features:
2.1. General Scope:
2.1.1 Kanopolis Lake, Venango Park Swim Beach Day Use Area, Playsystem Replacement.
1. Existing Playsystem Removal. Removal and off-site disposal of existing playsystem with exception of the swing set (Swing Set will NOT be removed).
2. Contractor shall provide submittal of proposed system to be installed along with quote. Proposals must contain: Warranty detail (duration and coverage limits), site layout to include blueprints and/or schematic drawing and make/model of all proposed playsystem components. Contractor may submit multiple proposals/quotes.
Quotes must contain itemized pricing for materials, delivery and installation.

The contractor will provide a warranty that meets or exceeds the following specs.
Lifetime limited warranty on all uprights. Lifetime limited warranty on all hardware.

Proposed components and installation design shall meet the following requirements:
ADA Accessibility Guidelines for buildings and facilities, November 17, 2000 compliant, Earth tone (browns, greens, beige, etc.) only, Component manufacturer will be ISO 9001/2000 certified. Contractor shall adhere to the following requirements: provide all waste disposal containers, receive all deliveries, adhere to 60 day period of performance post contract award. Proposals will be evaluated based upon price, design and quantity/type of interactive play components. Price will be equal in importance to the combined other factors.
2.4 Submittals:
The following shall be submitted for Government Approval:
1. A general overall work plan with schematic to meet the requirements laid forth in the Paragraph 2.1.1.
2. Product data sheets for each product proposed to be used for Government review.
3. Proposed work schedule.
3. SEQUENCE OF WORK:
Contractor shall commence within 30 days after contract award. All work must be completed within 60 days after contract award:
Contractor shall coordinate scheduling changes with COR.
4. FIELD MEASUREMENTS: The Contractor shall verify all measurements at the project site and shall be responsible for all dimensions, fittings, and the proper installation of all materials and equipment specified.
5. PERMITS: The Contractor shall be responsible for obtaining any required permits.
5.1. Hot Work Permit:
The Contractor shall be liable for any fire loss to Government property attributable to negligence on the part of the Contractor, including failure to comply with fire prevention measures prescribed by terms of this contract.
6. SAFETY REQUIRMENTS:
6.1. Protection from Hazards: During progress of work, the Contractor shall protect all personnel, whether Government or civilian, from any and all safety hazards caused by the construction operations.
6.2. Traffic Control: Contractor shall provide all temporary signs and markers as necessary to maintain safety in the worksite. All signs shall conform to the latest edition of the Manual of Uniform Control Devices (MUTCD).
6.3. U.S. ARMY CORPS OF ENGINEERS SAFETY AND HEALTH REQUIREMENTS
MANUAL, EM 385-1-1 (2014)

The Contractor shall be responsible for complying with the current edition and all changes posted on the web as of the effective date of this solicitation.

8.1. The Contractor shall not be on site without prior notification to the Corps of Engineers COR or otherwise designated person(s).
8.2. Contractor personnel shall have valid civilian ID's and Contractor vehicles shall have a valid registration.
8.4 ANTITERRORISM/OPERATION SECURITY REQUIREMENTS
All contractor and all associated sub‐contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
All contractor and all associated sub‐contractors employees will receive a CORPS Watch information paper (provided by the authorized government representative) and provide a written acknowledgement to the COR, no later than 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract.
The Contractor must pre‐screen candidates using the E‐verify Program (http://www.dhs.gov/E‐ Verify) website to meet the established employment eligibility requirements. The vendor must ensure that the candidate has two valid forms of government issued identification to ensure the correct information is entered into the E‐verify system. An initial list of verified/eligible candidates must be provided to the COR no later than 3 business days after the initial contract award.
Per the E-Verify Website the following exemptions apply:
Employers whose contracts are exempt from the E-Verify federal contractor rule are not required to enroll in E-Verify. A contract is considered exempt if any one of the following applies: (1) It is for fewer than 120 days. (2) It is valued at less than $150,000, the simplified acquisition threshold (Source: http://www.uscis.gov/e-verify/federal-contractors/exemptions-and-exceptions).
All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.
9. APPLICABLE PUBLICATIONS: The publications referenced herein shall be the most recent at the time of solicitation.
10. WORKSITE HOUSEKEEPING:
10.1. The Contractor shall remove all trash and disposal material from the worksite before the end of each day; to the extent it is consistent with standard construction practices on Government work sites. The Contractor shall take all possible precautions to maintain the work site, at all times, in a condition that will prevent damage or injury to person or property, Government or otherwise. The above precautions shall include protection from weather conditions. The Contractor shall be responsible for all damages caused by the negligent acts or omissions of his employees, sub-contractors, or agents during Contract performance.
11. RESPONSIBLITY FOR DAMAGE
11.1. Damage to Personal Property: The Contractor shall be solely responsible for all damage to Government and occupant personal property, to include adjacent vegetation, caused by the Contractors' personnel, subcontractors, his agents, or by the performance of his work.
11.2. Damage by Negligence: Damage resulting in gas leaks, electrical outages, loss of heat during cold weather, water leaks, unsecured facilities, weather damage, or oil/hazardous waste spills shall be responded to by the Contractor within 2 hours and repaired within one workday. If the Contractor fails to comply with these requirements, the Government reserves the right to repair the damage and charge the cost to the Contractor. Contractor shall protect all areas through which he will be transporting demolition debris or construction materials. Any damaged turf, sidewalks, roads, vegetation, site amenities, etc, shall be replaced or repaired by the Contractor prior to final Contract closeout.
12. DISPOSAL OF MATERIALS: All materials removed and not reused or designated as salvage material in this project shall become the property of the Contractor, unless otherwise specified, and shall be the Contractor's responsibility for lawful disposal.
12.1. All other wastes generated during Contractor operations shall be disposed of by the Contractor at his/her expense.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--

The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
