CONSOLIDATION OF CONTRACT REQUIREMENTS DETERMINATION
FOR LAKE CITY ARMY AMMUNITION PLANT (LCAAP)
ROOF REPLACEMENT AND REPAIR
MULTIPLE AWARD TASK ORDER CONTRACT (MATOC)
(As prescribed by FAR 7.107-2 and AFARS 5107.107-2)
RATIONALE
1. Consolidation may provide substantial benefits to the Government. However, because of the potential impact on small business participation, before conducting an acquisition that is a consolidation of requirements with an estimated total lar value exceeding $2 million, a written determination shall be made that the consolidation is necessary and justified in accordance with 15 U.S.C. 657q, after ensuring that--
(a) Market research has been conducted;
(b) Any alternative contracting approaches that would involve a lesser degree of consolidation have been identified;
(c) The determination is coordinated with the agency's Office of Small Disadvantaged Business Utilization or the Office of Small Business Programs;
(d) Any negative impact by the acquisition strategy on contracting with small business concerns has been identified; and
(e) Steps are taken to include small business concerns in the acquisition strategy.
2. Introduction: The U.S. Army Corps of Engineers (USACE), Kansas City District (NWK) plans to solicit offers for Small Business (SB) Design-Bid-Build (DBB) and Design-Build (DB) Construction Indefinite-Delivery Indefinite-Quantity (IDIQ), Multiple Award Task Order Contract (MATOC) for Roofing Repair and Replacement projects on Lake City Army Ammunition Plant in Independence, Missouri. NWK has conducted market research that demonstrates the consolidation of this procurement to be both necessary and justified in accordance with FAR 7.107-2(b) and 13 C.F.R. 125.2(d). FAR
2.102 defines consolidation as �
(1) a solicitation for a single contract, a multiple-award contract, a task order, or a delivery order to satisfy �
(i) Two or more requirements of the Federal agency for supplies or services that have been provided to or performed for the Federal agency under two or more separate contracts, each of which was lower in cost than the total cost of the contract for which offers are solicited; or
(ii) Requirements of the Federal agency for construction projects to be performed at two or more discrete sites.
(2) �Separate contract� as used in this definition, means a contract that has been performed by any business, including small and other than small business concerns.
3. Description of the Procurement Action: The new Small Business MATOC will be used for Roofing Repair and Replacement on LCAAP.
a. Requirements defined: Lake City Army Ammunition Plant (LCAAP) is an Army Installation located on 3,945 acres in Independence, Missouri, on Highway 7, approximately seven miles north of Interstate 70 and the City of Blue Springs. The installation is a Government Owned - Contractor Operated (GOCO) facility that produces small caliber ammunition for all U.S. Armed Services.
There are 375 buildings across LCAAP, with roofing on buildings being over 35 years old and in various stages of maintenance and deterioration. Several patches and routine maintenance have extended their use beyond their service life. A base-wide roofing assessment was completed in 2017.
The proposed SB MATOC will be solicited as a total small business set-aside
, consisting of a three-year base and two (2) one-year optional ordering periods, The work will primarily be performed under the North American Industry Classification System (NAICS) Code 238160�Roofing Contractors, the associated small business size standard is $19M.
The MATOC will be used to award negotiated firm-fixed-price (FFP) task orders (TOs) for roofing repair and replacement construction on LCAAP.
Each TO will have an appointed Contracting Officer�s Representative (COR) that will ensure completed projects meet the specifications and standards outlined in the statement of work (SOW).
This contract is considered a consolidated requirement based upon the combination of requirements (roofs) that are at various buildings on LCAAP.
Requirements will be funded at the TO level using the appropriate funds for the requirement.
The scope of the proposed MATOC is only for use by LCAAP. The general scope of the requirements is to furnish all plant, labor, equipment, materials, and transportation and performing all required work in accordance with the plans and specifications for replacement and repair of asphalt shingle, built-up asphalt, styrene-butadiene-styrene modified bituminous (mod bit), ethylene-propylene-diene-monomer (EPDM), polyvinyl-chloride (PVC), thermoplastic-polyolefin (TPO), and architectural and structural metal panel roofs.
The use of an indefinite-delivery contract is appropriate IAW FAR 16.501-2(a), when exact times and/or exact quantities of future deliveries are not known at the time of award. FAR 16.504(b) indicates that the Contracting Officer may use an indefinite-quantity contract when the Government cannot predetermine, above a specified minimum quantity of supplies and services that the Government will require during the contract period, and it is inadvisable for the Government to commit itself for more than a minimum quantity. The Contracting Officer should use an indefinite-quantity only when a recurring need is anticipated.
The LCAAP Roofing MATOC synopsis will be publicly announced on the Government Point of Entry, SAM.gov, through the Procurement Integrated Enterprise
Business Programs. The DD Form 2579 Small Business Coordination Record is currently in progress and the final approved copy will be loaded in the official contract file once completed. Consolidation is necessary to meet NWK�s mission objectives to increase efficiency, streamline processes, decrease costs, provide continuity, and deliver quality performance.
The findings of the market research and the documentation provided support the decision that consolidation of requirements is both necessary and justified. None of the other approaches would allow the Government to meet the desired level of quality and timeliness needed for mission execution.
9. Summary: The consolidation approach is anticipated to provide the greatest benefit to the Government by lowering overall cost, performance risk and ensuring timely mission execution. The market research and rationale support consolidation based on current acquisition regulations and guidance. The MATOC acquisition approach provides the means to support NWK�s stakeholders and to support small business goals. This approach presents a positive opportunity for small business participation and diminishes the potential for unnecessary risks. It will enhance contracting�s ability to meet program execution timelines and allow NWK to successfully execute mission essential roofing projects to support LCAAP while minimizing PALT, ordering costs and support timely project completion. This consolidation is determined necessary and justified as the benefits of the substantially exceeds those derived from alternative contracting approaches involving less consolidation, as supported herein.
