Section C - Descriptions and Specifications

SPECIFCATIONS

1.0 SCOPE OF WORK

It is the intent of the US Army Corps of Engineers to award a contract to have ONE (1) 4A VBS Hatch Cover assembly, Mounting Hardware, and Support Beam supplied to McNary Dam.

2.0 FABRICATION OF VBS HATCH COVER ASSEMBLY

2.1 The Contractor shall manufacture ONE (1) 4A Hatch Cover assembly.

2.2 VBS Hatch Cover Manufacturing

2.2.1 Manufacture ONE (1) hatch cover per drawings S-401.

2.2.2 All concrete shall meet specifications 03 40 00.00 28 PRECAST CONCRETE.

2.2.3 All steel shall meet specifications 05 05 23.00 28 STRUCTURAL STEEL, METALWORK FABRICATION, AND WELDING.

2.3 VBS Structural Support Assembly

2.3.1 Manufacture ONE (1) hatch cover support assembly per drawing S-402

2.3.2 All steel shall meet specifications 05 05 23.00 28 STRUCTURAL STEEL,

2.4 VBS Hardware package

2.4.1 Supply ONE (1) set of any hardware needed for the VBS hatch cover and structural support assembly.

3.0 SUBMTTTALS

After acceptance, submittals must include approval drawings for tooling fabrication and seal assembly.

NOTE: The Government Technical Point of Contact for this requirement is Mr. Michael Timm. He can be reached at (541) 922-1347 or email to Michael.b.timm@usace.army.mil. Mr. Timm will conduct a site visit during production of the hatch cover to ensure the cover and all accessories meet our technical specifications and all requirements therein.

4.0 SHIPMENT AND DELIVERY

The seal assemblies shall be delivered as FOB Destination. The Contractor shall be responsible for packing and shipping the components in a manner that will ensure undamaged and complete arrival to McNary Lock and Dam.

Delivery of all components shall be within FOURTEEN (14) weeks of award of contract. Shipments are only allowed during normal business hours of Monday – Thursday 7:00am to 4:00pm.

All shipments shall be delivered to:

252.225-7055 REPRESENTATION REGARDING BUSINESS OPERATIONS WITH THE MADURO REGIME

(MAY 2022)

(a) Definitions. As used in this provision--

Agency or instrumentality of the government of Venezuela, business operations, government of Venezuela, and person have the meaning given in the clause 252.225-7056, Prohibition Regarding Business Operations with the Maduro Regime, of this solicitation.

(b) Prohibition. In accordance with section 890 of the National Defense Authorization Act for Fiscal Year 2020 (Pub. L. 116-92), DoD is prohibited from entering into a contract for the procurement of products or services with any person that has business operations with an authority of the government of Venezuela that is not recognized as the legitimate government of Venezuela by the U.S. Government, unless the person has a valid license to operate in Venezuela issued by the Office of Foreign Assets Control of the Department of the Treasury.

(c) Representation. By submission of its offer, the Offeror represents that the Offeror is a person that--

(1) Does not have any business operations with an authority of the Maduro regime or the government of Venezuela that is not recognized as the legitimate government of Venezuela by the U.S. Government; or

(2) Has a valid license to operate in Venezuela issued by the Office of Foreign Assets Control of the Department of the Treasury.

252.225-7056 PROHIBITION REGARDING BUSINESS OPERATIONS WITH THE MADURO REGIME (MAY 2022)

(a) Definitions. As used in this clause--

Agency or instrumentality of the government of Venezuela means an agency or instrumentality of a foreign state as defined in 28 U.S.C. 1603(b), with each reference in section 1603(b) to a foreign state deemed to be a reference to Venezuela.

Business operations means engaging in commerce in any form, including acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce.

Government of Venezuela means the government of any political subdivision of Venezuela, and any agency or instrumentality of the government of Venezuela.

Person means--

(1) A natural person, corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group;

(2) Any governmental entity or instrumentality of a government, including a multilateral development institution (as defined in section 1701(c)(3) of the International Financial Institutions Act (22 U.S.C. 262r(c)(3)); and

(3) Any successor, subunit, parent entity, or subsidiary of, or any entity under common ownership or control with, any entity described in paragraph (1) or (2) of this definition.

(b) Prohibition. In accordance with section 890 of the National Defense Authorization Act for Fiscal Year 2020 (Pub. (d) Subcontracts. The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts, including subcontracts for the acquisition of commercial items.

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (MAY 2022)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 332312.

(2) The small business size standard is 500.

(3) The small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition--

(i) Is set aside for small business and has a value above the simplified acquisition threshold;

(ii) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or

INSTRUCTIONS TO OFFERORS

US Army Corps of Engineers has a requirement for ONE (1) 4A VBS Hatch Cover assembly, Mounting Hardware, and Support Beam supplied to McNary Dam.

Registration at www.sam.gov is required. Failure to register in the SAM database will make an offeror ineligible for award. Effective 29 April 2018, the notarized letter process is now mandatory on all CURRENT registrants at SAM who have a requirement to update data on their SAM record. The notarized letter is mandatory and is required in order for the GSA Federal Service Desk (FSD) to activate the entity's registration. Both Federal Assistance entities and all non-Federal entities must mail the original, signed copy of the notarized letter to the Federal Service Desk. Submission of Price Quote – Offeror shall submit 1 copy of the following:

1. Signed and dated Standard Form 1449 (Solicitation/Contract/Order for Commercial Items)

2. Signed and dated Standard Form 30, if applicable, for any Amendments to the Solicitation

3. Completed schedule (pricing information) for all contract line item numbers

4. Completed Clause 52.212-3 and Alt I, “Offeror Representations and Certifications—Commercial Items” as noted above.

PRICES QUOTED MUST BE VALID FOR 30 DAYS. Solicitation shall result in a firm-fixed-price (FFP) contract.

All pricing shall include shipping FOB destination (include shipping cost in price).

BUSINESS HOURS: The standard business hours for the Walla Walla District, Corps of Engineers are Monday through Friday from 8:00 a.m. to 4:00 p.m., excluding federal holidays.

BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value to the government based on PRICE only. The government does not intend to have discussions with offerors so please ensure that all information required in the Technical Specifications is provided with your quote. Technical Specifications provided by you the vendor to be evaluated by a government representative that do not meet or exceed the technical specifications solicited will be determined unacceptable and will not be subject for an award.
