About this file

This document is a Justification Review Document for increasing capacity on a Single Award Task Order Contract (SATOC) for the U.S. Army Corps of Engineers, Baltimore District. The contract supports Washington Headquarters Services (WHS) and the Raven Rock Mountain Complex (RRMC), with a $15 million capacity increase from $100M to $115M. The contract covers highly specialized construction and design services, including facility design, site clearing, utilities, HVAC upgrades, security infrastructure, and work in sensitive, secure locations with challenging terrain in Maryland and Pennsylvania.

The contract was originally awarded to Grunley Construction on 17 August 2022 with a five-year ordering period through 16 August 2027. The capacity increase is necessary to award a new task order for construction of a Security Operations and Pedestrian Access Facility, with the contract requiring a Top Secret Level of Facility Security Clearance. A market research notice was issued on 6 December 2024 seeking potential sources, but no responses were received. The contractor has an approved Subcontracting Plan and has already exceeded small business and socioeconomic subcontracting goals.

Control Number: NAB-25-005166 impacts, and the political climate. In this situation, it would not be uncommon for the contractor to increase costs to mitigate risk.

b. Justification. In accordance with (IAW) FAR 6.302-1(a)(2)(iii)(B), services may be deemed to be available from only one or a limited number of responsible sources in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to another source would result in unacceptable delays in fulfilling the agencys requirements.

The subject SATOC is for highly specialized services; the Contractor requires Top Secret Level of Facility Security Clearance (TS FCL) and experience with secure facilities design and construction. The Contracting Officer determined the Contractor provided a fair and reasonable proposal and that market trends in increased labor costs are the primary reason for the significant increase above the IGE.

Multiple courses of action were considered by the project delivery team, including seeking a full and open bid, rather than using the SATOC. However, there would be significant schedule delays.

Further, there are a limited number of sub-contractors who are cleared and willing to work at RRMC, hence the likelihood that all contractors would utilize the same subcontractors, as well as experiencing the same market and other price pressures, is high and could result in further delays from different prime contractors conflicting priorities. The RRMC sites require contractors and subcontractors experienced with secure and special access areas, classified documentation control, rough and rocky terrain, hazardous weather conditions all of which can require lengthy proposal receipt requirement, contributing to schedule delays for the Stakeholder. The SATOC Contractor was selected based on this specialized criteria.
