10 U.S.C. 2304(c)(1). Application for brand name description FAR 6.302-1(c).
NSWC PCD has been utilizing Sonardyne, Inc Mini Ranger or equivalent Sonardyne, Inc systems for over the past 15 years to service customers internal and external to NSWC PCD and provide accurate target deployment and recovery missions in support of major programs and test events.
Current systems at NSWC PCD include the Mini-Ranger 2 system which are used in support of deployment and recovery of over 600 target shapes annually, requiring over 600 uses of transponders per calendar year. All target deployment and recovery vessels at NSWC PCD including the PSC-08, PSC-12, M/V PATRIOT, and M/V SEEWEE have been outfitted with custom fabricated Sonardyne deployment and recovery equipment and electrical upgrades to support missions, and if required to utilize a different system would require costly fabrication and installation of a differing system onboard all vessels at NSWC PCD. All current IT systems owned by NSWC PCD already support the functionality required by the Sonardyne suite of equipment, and if changed would have to be modified across the suite resulting in costly IT purchases and upgrades. Additionally 7 of the Coastal Test Range personnel have already received costly in-person training from Sonardyne over the past 5 years of which switching to a new system would require another costly training package.
As such, the Government does not expect significant savings through competition and does expect significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Governments’ best interest to acquire Sonardyne, Inc.
A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
This requirement will be synopsized on the Commercial Opportunities website at beta.sam.gov per FAR 5.2. No additional market research was conducted for the reasons specified in paragraph 4 above, Sonardyne, Inc. is the only brand that can meet the Government’s needs.
Any other facts supporting the justification.
None.
A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Sonardyne, Inc. is the only brand that can meet this requirement.
