MEMORANDUM

SUBJ: BRAND NAME JUSTIFICATION MEMORANDUM TO ACQUIRE FOR OUTLAND REMOTELY OPERATED VEHICLES (ROV) (PR1300928530)

Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a brand specific justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

Nature and/or description of the action being approved.

This action will award a firm fixed price order on a brand name basis to the lowest price offeror that can provide the required Remotely Operated Vehicles (ROV) and associated equipment required to operate these vehicles from Outland Technology, Inc.

A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This requirement is to purchase thefollowing:

The purchase will include 2 ROVs, 920 FT of ROV cabling, cable reels, jaws, manipulators, thrusters, bearings, pins, dummy connectors, bottles, cameras, and navigation module assemblies all required to operate the ROVs for underwater usage for mission essential programs at NSWC PCD.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of $250,000.00. All hardware will be delivered no later than thirty

(30) days after award of the order. The purchase will be funded with FY 2021 Research, Development, Test and Evaluation (RDT&E) funds.

Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1 The status of NSWC PCD Gulf Test Range Outland ROV systems is that one is out of commission and cannot be repaired due to exceeding its service life. The Outland Technologies, Inc. Outland 2500 ROV is proprietary and is nearly identical to the current systems owned by NSWC PCD including modifications unique to target deployment and recovery with two function manipulators and interlocking jaws, and wire rope cutters specialized for NSWC PCD operations. The fleet of vessels at NSWC PCD including the PSC-8, PSC-12, MK-V, and M/V Patriot have already been outfitted to accept the unique power and winching requirements of the Outland 2500 suite of ROV systems and utilizing another brand of ROV would require major electrical rework or new install of winches on the NSWC PCD fleet to accommodate ROV operations. Outland Technologies Inc. sells through an authorized list of distributors as shown at http://www.outlandtech.com/distributors#north- america. As such, the Government does not expect significant savings through competition and it is more advantageous to the Government to award on a brand specific basis for the ROVs and associated equipment to successfully continue NSWC PCD target deployment and recovery operations.

A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

This requirement will be synopsized on the Contract Opportunities website at beta.SAM.gov per FAR 5.2. No additional market research was conducted for the reasons stated in paragraph 4 above.

Any other facts supporting the justification. None

A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services ismade.

As stated in paragraph 4 above, the specified brand is the only product that can meet the requirement.
