SPECTRUM LAB TEST AND EVALUATION TO NASCTN

NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY

June 25, 2020

I. BACKGROUND

The National Institute of Standards and Technology (NIST), Communication Technology Laboratory (CTL), National Advanced Spectrum and Communication Test Network (NASCTN) supports the national need for increased spectrum sharing through accurate, reliable, and unbiased measurements and analyses.

Long Term Evolution (LTE) and 5G protocols and technology are rapidly becoming the communication technology of choice for consumers, driving a need for access to additional frequencies. As LTE and 5G is deployed in new frequency bands, care must be taken to ensure incumbent systems are not harmed.

To continue the economic gains realized by the deploying mobile broadband networks, 5G, IoT services the Federal Communication Commission (FCC) continues to auction and repurpose the low, mid, and high bands (millimeter waves). The Federal government is therefore required to complete its missions in compressed spectrum ranges. This presents a risk that a variety of commercial and federal operators will harmfully interfere with each other.

To mitigate this risk and to provide opportunities for increased spectrum sharing between Federal and commercial stakeholders, NASCTN develops the appropriate measurements to determine levels of interference and performance of spectrum sharing technologies, as well as developing a comprehensive set of scenarios to adequately represent real-world environments.

NASCTN will specifically address the characterization of LTE Time and Frequency Division Duplex (TDD and FDD) and 5G and IoT signals and groups of signals (i.e., emissions from multiple UEs transmitting simultaneously) in the frequencies of 1755 MHz to 1780 MHz, 28GHz, 24GHz, and 3.5 GHz, and their effects on federal use radars.

PAGE 7 OF 37 TIRNO99D00005/1333ND20FNB670406

II. SCOPE OF WORK

NASCTN supports the development and dissemination of independent test methodologies and provides trusted test data that can be used to evaluate spectrum-sharing technologies. NASCTN projects are requested by other agencies or companies, approved by the NASCTN Steering Committee, developed and executed according to the NASCTN 5 stage process.

Projects are being conducted at NASCTN include aggregation of emissions measurements and effects on federal use radars. Over the course of the next year, NASCTN will also develop test methodology to measure performance of the Citizen Band Radio Services (CBRS) spectrum sharing technologies during operations, and develop a testbed and methodology for 5G spectrum sharing.

The purpose of this Statement of Objects is to obtain subject matter expertise, guidance, and recommendations in the following gaps in spectrum sharing test systems:

Communications Expertise: to review and provide input to technical reports.

Systems Test Expertise: to assist NASCTN with developing novel test methods, and observation of RF and channel measurements.

Test automation: Provide automated, remotely accessible testbeds to collect, analyze, and interpret test data using an appropriate software language (e.g., Python and Pandas) to allow interface with other elements of the projects.

The end products of this effort will be deliverable reports used to produce measurement campaigns, test measurement systems with control and automation software, technical reports, presentations, and trusted data, and architectures to support common testing goals. The test data, models, and reports will be used to ensure fair, unbiased, access to spectrum by users in the commercial and federal space. NIST/CTL/NASCTN require an unbiased resource free from potential commercial conflicts of interest.

In particular,

XIII. CLAUSES

1. 52.209-11 – Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law.

As prescribed in 9.104-7(d), insert the following provision:

Representation by Corporations Regarding Delinquent Tax Liability or a Felony Conviction under any Federal Law (Feb 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

(b) The Offeror represents that—

PAGE 14 OF 37 TIRNO99D00005/1333ND20FNB670406

(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and

(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months. (End of provision)

2. 52.209-5 Certification Regarding Responsibility Matters. (Apr 2010)

As prescribed in 9.104-7(a), insert the following clause:

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that

(i) The Offeror and/or any of its Principals

(A) Are [ ] are not [ ] presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have [ ] have not [ ], within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks have, the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are [ ] are not [ ] presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;

(D) Have [ ], have not [ ], within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

PAGE 15 OF 37 TIRNO99D00005/1333ND20FNB670406

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency.

This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing.

In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159.

The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has [ ] has not [ ], within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

This Certification Concerns a Matter Within the Jurisdiction of an Agency of the United States and the Making of a False, Fictitious, or Fraudulent Certification May Render the Maker Subject to Prosecution Under Section 1001, Title 18, United States Code.

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification

SPECTRUM SHARING LAB ORATORY TEST AND EVALUATION

The National Institute of Standards and Technology (NIST)/National Advanced Spectrum and Communications Test Network (NASCTN)

31 July 2020

I. BACKGROUND

The National Institute of Standards and Technology (NIST), Communication Technology Laboratory (CTL), National Advanced Spectrum and Communication Test Network (NASCTN) supports the national need for increased spectrum sharing through accurate, reliable, and unbiased measurements and analyses.

Long Term Evolution (LTE) and 5G protocols and technology are rapidly becoming the communication technology of choice for commercial stakeholders, driving a need for access to additional frequency bands. As LTE is deployed in new frequency bands, care must be taken to ensure incumbent system performance is not adversely affected.

The Federal government is recently required to operate in compressed spectrum ranges and sharing others due to past and pending Federal Communication Commission (FCC) auctions, such as Advanced Wireless Services – 3 (AWS-3), Citizens Broadband Radio Service (CBRS), and Spectrum Frontiers. The use of these frequencies by wireless network operators will support a variety of commercial wireless services, such as long-term evolution (LTE), fifth generation (5G) cellular, and Internet of Things (IoT). These on-going plans present a risk that a variety of commercial and federal operators will harmfully interfere with each other.

To mitigate this risk and to provide opportunities for increased spectrum sharing between Federal and commercial stakeholders, NASCTN plans and conducts spectrum sharing tests that develop the appropriate measurements to determine levels of interference as well as develop scenarios to adequately represent real-world environments.

NASCTN will specifically address the characterization of LTE Frequency Division Duplex (FDD) and Time Division Duplex (TDD), 5G, and IoT signals and groups of signals (i.e., emissions from multiple devices transmitting simultaneously) in the current

and planned sharing frequencies, such as 1695-1710 MHz, 1755-1780 MHz, 3.5 GHz, millimeter wave bands to measure and analyze commercial emission effects on federal communication and radar systems and vice versa.

The MITRE Corporation is a not-for-profit Federally Funded Research Corporation (FFRDC) operating in the public interest. The MITRE corporation has had an active LTE laboratory program since 2010 and has extensive knowledge of the LTE standards, as well as wide-ranging experience performing laboratory related experimentation related to LTE in its interaction with DoD systems. MITRE is also actively involved in standard development and testing of 5G and IoT technologies. MITRE sponsors for such work include, but are not limited to, the Defense Spectrum Office (DSO), the Missile Defense Agency (MDA), the Defense Advanced Research Projects Agency (DARPA) and services such as ARMY, Air Force, and Marine Corps.

MITRE is therefore well-positioned to assist NASCTN in their pursuit of an unbiased laboratory evaluation of LTE, 5G, and IoT.

II. SCOPE OF WORK

NASCTN supports test request screening, the development and dissemination of independent test methodologies, lab infrastructure improvements, and trusted test data that can be used to evaluate spectrum-sharing technologies. Projects conducted at NASCTN Boulder Labs include in-band and adjacent band emissions measurements of new entrants and incumbent spectrum users.

Over the course of this period of performance, NASCTN with MITRE assistance will execute, analyze, and document a test methodology to measure spectrum as new users enter the 3.5 GHz band and continue testing in the AWS-3 LTE uplink bands. NASCTN will characterize the emissions of Cellular Base Stations and User Equipment (UE) to empirically estimate parameters, sensitivity, and uncertainty of the variables influencing the level of potential interference to Federal systems. These efforts are applicable to deployments of modern communications systems in the AWS-3, CBRS, and 5G bands.

As developed and executed according to NASCTN’s five-stage process, NASCTN test requests delivered by other organizations/agencies, require screening and approval by the NASCTN Steering Committee.

The purpose of this task order is to provide subject matter expertise, guidance, and recommendations in the following gaps in spectrum sharing test systems:

• Cellular Communications Expertise: Review and provide input to technical reports regarding commercial cellular communications, in particular LTE.

• Systems Test Expertise: Assist NASCTN with test expertise in the development and observation of RF and channel measurements.

• Automation: Collect, analyze, and interpret test data using an appropriate software language (e.g., Python and Pandas) to allow interface with other elements of the projects.

PAGE 21 OF 37 TIRNO99D00005/1333ND20FNB670406

Use or disclosure of data contained on this sheet is subject to the restrictions on the title page of this proposal or quotation.

• Data Science: Parse, process, and create test data visualizations.

• Test Infrastructure: Improve laboratory capabilities to include automated multi-

UE capabilities.

The product of these efforts will be deliverables used to produce and execute measurement campaigns, test measurement systems with control and automation software, trusted data, data analysis, and technical reports. The deliverables will support NIST/CTL/NASCTN’s efforts to support fair, predictable, assured access to spectrum by users in the commercial and federal space. MITRE provides an unbiased resource free from potential commercial conflicts of interest to support these goals.

III. DESCRIPTION OF TASKS

The following describes MITRE’s technical approach to meeting the NIST’s objectives for this effort. MITRE will provide technical expertise on Long Term Evolution (LTE) Systems, 5G, and IoT, including test and measurement expertise, technical data collection and reduction, and laboratory-based experimentation.

MITRE will review, evaluate, and build planned test setups at a MITRE laboratory in Bedford, MA, McLean, VA, or in a prototype environment to support on-going and future NASCTN projects as stated above. MITRE will assemble test equipment, develop automation code, conduct experiment designs, and collect measurement data consistent with the requirements of the NASCTN Technical Lead. MITRE will support experiment designs as written in the NASCTN-developed test plans to maintain strict test execution, configuration control, and quality control that ensure scientific rigor and repeatability of the tests. MITRE will coordinate deviations to the test plans with the NASCTN Technical Lead.

Task 1: Technical Program Management

MITRE will perform all activities related to the day-to-day management and administration of this Task Order. As part of this task, MITRE will ensure that the Government Task Manager (GTM) is properly informed of task order financial monitoring, timing of tasks, Task Order Work Plan (Work Plan) creation/updates, and Monthly Progress Reports.

The Work Plan will identify key activities, assumptions, constraints, resources required, work products to be delivered, and planned start and completion dates of major activities.

The initial Work Plan is due 30 days after the task award and is subject to GTM review and written approval. The GTM will approve the Work Plan or provide comments for revision within ten (10) government workdays of receipt.

To accommodate changing priorities and work activities, the Work Plan may be revised as needed throughout the period of performance. Updates to the Work Plan will be authorized by the Government COR and then the Work Plan will be modified accordingly on a schedule mutually agreed upon by the Government COR and the MITRE Project Leader (PL). The updated Work Plan will be reviewed and approved by

PAGE 22 OF 37 TIRNO99D00005/1333ND20FNB670406

the Government COR (or COR provides comments for revision) within ten (10) Federal government workdays of receipt. Until revisions to the Work Plan are approved by the Government COR (and a revised schedule agreed upon), work will proceed as described in the latest approved version of the Work Plan. Updates to the Work Plan will be made as mutually agreed between the GTM and MITRE’s PL. If updates to the Work Plan result in an adjustment, upward or downward, in the estimated resources to perform the work, the FFRDC will advise the Contracting Officer’s Representative (COR) and GTM of such impact at the time the plan is submitted.

MITRE’s formal Monthly Progress Reports will ensure expenditure of resources is consistent with and focused on the successful completion of task activities within the projected cost and schedule limitations. Monthly Progress Reports will describe accomplishments for the month, any risks or issues identified during the month, recommended actions to resolve identified problems, and financial status.

MITRE will perform the following activities in support of the management of this task:

• Conduct kickoff meeting with stakeholders, within five days after task award, to discuss the task order approach and assumptions for input to the task order Work Plan

• Develop the initial Work Plan and provide updates based on changes in task priorities, funding, and scope of work

• Manage the task staffing, work, deliverables, and finances

• Develop Monthly Progress Reports including task progress, risks, and challenges In addition, MITRE will keep NIST apprised of progress and results on a regular basis through engagement with NIST Executive(s) overseeing the task to enable NIST decision-making before formal assessment work products are delivered.
