Section A: General Contract Information

Section B: Description of the Supplies/Services Required

This acquisition is for the M.I.C. Industries "Building in a Box" that provides all necessary building material required for the construction of a K-Span building. The contract will also cover a technician from M.I.C. Industries on site for technical support and machine calibration.

Section C: Justification for Soliciting from a Single Source or Brand Name

10 U.S.C. 2304(c)(1), the property or services needed by the agency are available from only one responsible source or from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency, as implemented by FAR 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, required by FAR 6.303-2(b)(4).

(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

(ii) Supplies may be deemed to be available only from the original source in the case of a follow-on contract for the continued development or production of a major system or highly specialized equipment, including major components thereof, when it is likely that award to any other source would result in --

(A) Substantial duplication of cost to the Government that is not expected to be recovered through competition, or

(B) Unacceptable delays in fulfilling the agency's requirements. (See 10 U.S.C. 2304(d)(1)(B).

Currently, the 819th Red Horse Squadron uses the "Ultimate Building Machine" (UBM) to complete all of their K-Span projects.

The UBM is manufactured solely by M.I.C. Industries. The "Building in a Box" is guaranteed to arrive compatible with the UBM and customized to the exact specifications of the required engineered design of the K-Span. If materials for the K-Span were to be procured separately and by different vendors, it is not guaranteed that these vendor's will have any familiarity with the UBM or that their products will come compatible with the UBM. There is a greater risk of improper use of and damage to the UBM if using incompatible products ultimately leading to significant repair costs and delays to the project. Furthermore, M.I.C.

Industries is the sole source for any technical support required for both the UBM and the "Building in a Box," enabling streamlining of troubleshooting and preventing overall project errors and delays.

Section D: Efforts to Obtain Competition

The Government is unable to compete this requirement because M.I.C. Industries is the sole source of the "Ultimate Building Machine" (UBM) that the 819th Red Horse Squadron currently uses for their K-Span projects and the materials in the "Building in a Box" are the only source of materials to build a K-Span building guaranteed to be compatible with the UBM and arrive customized to the exact specifications of the engineered design of the desired K-Span.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

There are no steps to preclude future single source of this acquisition due to the fact that M.I.C. Industries is the sole source for the UBM, Building in a Box, and any technical support required for these products.
