About this file

This is an Award Recommendation document from the Michigan Department of Natural Resources (DNR) Procurement office for Request for Quotes (RFQ) 190000000419, soliciting proposals for 22a and Breaker Run gravel for DNR Forest Resources Division's Shingleton Management Unit. The RFQ was posted on SIGMA VSS on May 3, 2019, with proposals due by May 17, 2019, representing a fourteen-calendar-day competitive bidding period. Three bidders submitted proposals: D & L Gembel and Sons, Gerou Excavating, and Zeller Excavating, with the procurement process involving evaluation by Lisa Crozier-Green (Solicitation Manager) and Avi Shalom (Forest Fire Supervisor).

The DNR recommended a split award to the three bidders based on their pricing: D & L Gembel and Sons was awarded $30,400.00, Gerou Excavating was awarded $19,635.00, and Zeller Excavating was awarded $60,510.00, totaling $110,545.00. None of the bidders were Service-Disabled Veteran Owned Businesses (SDVOB), and the procurement was for a one-time purchase of gravel for various DNR Forest Resources Division locations within the Shingleton Management Unit. The evaluation process focused on determining whether proposed prices were within the state's anticipated fair market value, with the state reserving the right to not accept the lowest price proposal and to conduct additional evaluations such as site visits, interviews, and reference checks.

Version 2 Revised: 2/2019 Version 2 Revised: 2/2019 Evaluation Synopsis I. Evaluation Process Proposals were evaluated to determine whether the price proposed for the Contract Activities is within the State’s anticipated fair market value.

The State may utilize all bidder information, without regard to a proposal’s technical score, to determine fair market value for the services sought. The State is not obligated to accept the lowest price proposal. If applicable, the State’s evaluation will include consideration of a bidder’s qualified disabled veteran (QDV) status under MCL 18.1261(8). Additional information on the QDV preference is available at: http://michigan.gov/micontractconnect/0,https://www.michigan.gov/dtmb/0,5552,7-358-82550_85746_48677-412612--,00.html,7-225-48677-123519--,00.html.

The State strongly encourages strict adherence to the Contract Terms. The State reserves the right to deem a bid non-responsive for failure to accept the Contract Terms. Nevertheless, the bidder may submit proposed changes to the Contract Terms in track changes (i.e., visible edits) with an explanation of the bidder’s need for each proposed change. Failure to include track changes with an explanation of the bidder’s need for the proposed change constitutes the bidder’s acceptance of the Contract Terms. General statements, such as that the bidder reserves the right to negotiate the terms and conditions, may be considered non-responsive.

The State may conduct an on-site visit to tour and inspect the bidder’s facilities; require an oral presentation of the bidder's proposal; conduct interviews, research, reference checks, and background checks; and request additional price concessions at any point during the evaluation process.
