About this file

This is an award letter and synopsis from the State of Michigan's Department of Technology, Management, & Budget - Financial Services office for solicitation #190000000253. The contract is for MPSCS Nokia Backhaul Repair services, awarded to Tempest Telecom Solutions. The RFP was posted on SIGMA VSS on November 9, 2018, with proposals due by November 27, 2018. The contract term is three years with up to two one-year renewal options.

The contract was awarded for $450,000.00 to Tempest Telecom Solutions, pending State Administrative Board approval. Only one vendor submitted a bid, and they were not classified as a Service-Disabled Veteran Owned Business (SDVOB). The state evaluation process considered responsible and responsive vendors, fair market value, and qualified disabled veteran status under MCL 18.1261(8), though price was not the sole determining factor in the award decision.

Evaluation Synopsis I. Evaluation Process A Responsible Vendor is a vendor that demonstrates it has the ability to successfully perform the duties identified by the solicitation. A Responsive proposal is one that is submitted in accordance with the solicitation instructions and meets all mandatory requirements identified in the solicitation.

The State may utilize all bidder information, without regard to a proposal’s technical score, to determine fair market value for goods or services sought. The State is not obligated to accept the lowest price proposal. If applicable, the State’s evaluation will include consideration of a bidder’s qualified disabled veteran (QDV) status under MCL 18.1261(8). Additional information on the QDV preference is available at: https://www.michigan.gov/dtmb/0,5552,7-358-82550_85746_48677-412612--,00.html.

The State strongly encourages strict adherence to the Contract Terms. The State reserves the right to deem a bid non-responsive for failure to accept the Contract Terms. Nevertheless, the bidder may submit proposed changes to the Contract Terms in track changes (i.e., visible edits) with an explanation of the bidder’s need for each proposed change. Failure to include track changes with an explanation of the bidder’s need for the proposed change constitutes the bidder’s acceptance of the Contract Terms. General statements, such as that the bidder reserves the right to negotiate the terms and conditions, may be considered non-responsive.

The State may conduct an on-site visit to tour and inspect the bidder’s facilities; require an oral presentation of the bidder's proposal; conduct interviews, research, reference checks, and background checks; and request additional price concessions at any point during the evaluation process.
