About this file

This document is a Justification for Exception to Fair Opportunity (JEFO) under FAR Subpart 16.5 for a firm-fixed-price task order award to Amazon Web Services, LLC. The requirement is for AWS cloud computing capabilities to conduct a Zero Trust Pilot project to reengineer the Pentagon Force Protection Agency's (PFPA) Virtual Private Cloud environment to meet DoD Zero Trust requirements. The period of performance is a 12-month base period with four 12-month option periods, for an estimated total value of . AWS is the only vendor that can complete this pilot due to PFPA's exclusive use of the AWS platform and the proprietary nature of the required modifications. The task order will be awarded under the Joint Warfighting Cloud Capability (JWCC) IDIQ contract vehicle. PFPA is researching alternative cloud-based hazard prediction modeling systems that could be hosted by any cloud service provider to remove barriers to competition for future requirements.

Control No. 2024-WHS-1408-JA

JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

UNDER FEDERAL ACQUISITION REGULATION SUBPART 16.5

1. AGENCY AND CONTRACTING ACTIVITY: The Contracting Activity is the Department of

Defense (DoD), Washington Headquarters Services (WHS), Acquisition Directorate (AD), and Enterprise Security Services Directorate (ESSD). The Requiring Agency is the Pentagon Force Protection Agency (PFPA).

2. DESCRIPTION OF ACTION: This action requests Amazon Web Services (AWS) cloud computing capabilities to conduct a Zero Trust Pilot project to reengineer Pentagon Force Protection Agency’s (PFPA) Virtual Private Cloud (VPC) environment to meet the DoD CIO’s Trust Activities (Target & Advanced Levels) as outlined in the DoD Zero Trust Strategy. The outcome of this pilot will serve as the standard architecture, network protocols and associated licenses for PFPA and other DoD agencies looking to migrate their AWS cloud systems to a DoD Zero Trust compliant architecture. The Meteorological Modeling System (MMS) 3.0 software that was specifically developed for PFPA will be used as the test software for this Zero Trust pilot due to its use of compute resources that span multiple cloud impact levels. The MMS software that was developed and optimized to run only on the AWS platform. This action is to issue a firm-fixed-price task order (TO) directly to AWS using the Joint Warfighting Cloud Capability (JWCC) Indefinite Delivery/Indefinite Quantity Contract.

3. DESCRIPTION OF SUPPLIES/SERVICES: PFPA requires the procurement of an Amazon Web

Services (AWS) Virtual Private Cloud (VPC) to provide the capability for PFPA to conduct a Zero Trust pilot project funded by the DoD CIO Zero Trust Portfolio Management Office (PfMO). The anticipated period of performance (PoP) is for a 12-month base period and four 12-month option periods with an estimated value of . The base period estimate includes the services to conduct the Zero Trust pilot project, while the option period is just for the AWS cloud services.

Accordingly:

Performance Periods Performance Periods dates Amount

Base Period 9/30/2024 to 9/29/2025 Option Year 1 9/30/2025 to 9/29/2026 Option Year 2 9/30/2026 to 9/29/2027 Option Year 3 9/30/2027 to 9/29/2028 Option Year 4 9/30/2028 to 9/29/2029 6-Month Extension IAW 52.217-8 9/30/2029 to 3/29/2030 Base + All Options

4. EXCEPTION TO THE FAIR OPPORTUNITY: FAR 16.505(b)(2)(i)(B), Only one source can provide the services required at the level of quality required because the services are unique and highly specialized. AWS is the only vendor that can complete this Zero Trust Pilot because PFPA only uses the AWS platform for its entire cloud computing infrastructure. Due to this complete integration with AWS, AWS is the only vendor that can make modifications to add the Zero Trust compliant software to its AWS GovCloud platform due to proprietary restrictions. The DoD CIO needs a system already hosted in AWS to perform the work necessary to ensure the supporting network architecture can be transformed into a Zero Trust compliant landing zone capable of supporting a High-Performance Compute (HPC) environment. Therefore, AWS is the only vendor that can satisfy this requirement without mission failure to PFPA's CBRN hazard warning and notification requirements.

5. FAIR AND REASONABLE COST DETERMINATION: I determine that the anticipated price for this order will be fair and reasonable. The techniques identified in FAR 15.404-1(b)(2) will ensure that the award will be at fair and reasonable prices. Certified Cost and Pricing Data will not be obtained.

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION: The previous MMS AWS contract, HQ003422F0565, was issued from a competitive acquisition process on NASA SEWP and was awarded to Four Points Technology, LLC in the amount of without the AWS ProServe ZT pilot. In January 2022, the DoD established the Zero Trust Portfolio Management Office (ZT PfMO) within the DoD CIO. As the DoD leverages cloud architecture to host an increasing amount of computing and operational resources, it has become evident that the DoD lacks a standard Zero Trust cloud-based architecture. In June of 2024, PFPA proposed to the ZT PfMO to use our agency's Impact Levels 2 and 4 (IL 2 and 4) cloud architecture as a model for ZT compliance for the DoD. PFPA submitted a proposal to the ZT PfMO and was subsequently granted one year to perform this ZT Pilot with the goal of standardizing an IL 2 and 4 ZT landing zone.

Additionally, all Office of Secretary of Defense (OSD) Components and Defense Agencies and Field Activities (DAFAs) shall use the JWCC contract vehicle for all available offerings to procure future enterprise cloud computing capabilities and services, as required by the DoD CIO Memorandum, dated July 31, 2023. Therefore, the Amazon Web Services (AWS) Virtual Private Cloud (VPC) will be solicited as a sole source award to Amazon Web Services, Inc. under its JWCC IDIQ contract vehicle HQ003423D0019.

7. ACTIONS TO REMOVE OR OVERCOME ANY BARRIERS THAT LEAD TO THE

EXCEPTION TO FAIR OPPORTUNITY BEFORE ANY SUBSEQUENT ACQUISITION

FOR THE SUPPLIES OR SERVICES IS MADE: PFPA is presently researching other cloud base hazard prediction modeling system that can be hosted by any cloud service provider. PFPA is looking at alternative hazard prediction models from the Defense Threat Reduction Agency (DTRA). PFPA has sourced quotes for a new live release to validate a new hazard prediction model.

MIT Lincoln Labs' quote work would cost upwards of 5 million dollars and span over three years.

8. If this acquisition is for new work as a logical follow-on to an order already issued under the contract, was the original order placed under the fair opportunity process?

Yes, all awardees were given a fair opportunity to be considered for the original order.

No, a copy of the previous justification is attached. The actions to remove any barriers to competition cited on the previous justification were were not completed.

Not Applicable. This is a new requirement.
