RECOVERY - Recovery.gov Website Redesign

JUSTIFICATION FOR OTHER THAN A FIRM FIXED PRICE TASK ORDER

Date: 7/8/09

Solicitation Number: AVT0009100

Contracting Officers: Valerie Bindel and Todd Richards

Contract Award Date: 7/8/09

1) Identification of the Agency and Contracting Activity:

Contracting Activity:

Customer Agency/Place of Performance:

General Services Administration

Recovery Accountability and Transparency Enterprise GWAC Center Southwest Board (RATB) 819 Taylor St.

Washington, DC 20006 Ft. Worth, TX 76102 2) Nature and Description:

The General Services Administration – Enterprise GWAC Center Southwest, on behalf of the Recovery Accountability and Transparency Board (RATB), intends to award a task order for the Recovery.gov website redesign. As established by ARRA, RATB has the responsibility for managing content, operations and maintenance of the website. This includes designing, implementing and operating a Web site that clearly captures and transmits information on stimulus fund expenditures, impacts and results in an intuitive, user-friendly way for use by a wide range of audiences.

3) Type of Task Order:

This effort includes a base period of performance to implement the Offeror’s solution that shall be firm fixed price. This Firm Fixed Price portion of the requirement represents the majority of the dollars being spent on this requirement. There are operations and maintenance Contract Line Items (CLINs) established to ensure the website remains current and fully operational through day to day requirements and those CLINs are Fixed Price Level of Effort. The System Improvement and Enhancement CLINs must be awarded on an “other than fixed-price” basis due to the fact that the environment in which this task will operate creates difficulty in predetermining the volume of work and the schedule necessary to allow a fixed priced task. No public facing website has ever attempted to provide the type of functionality that Recovery.gov has been tasked to offer to the American public. Accordingly, the revisions and enhancements are foreseeable in general, but not specific enough to establish a fixed price arrangement.

4) Any Other Facts Supporting the Justification:

Based upon the above, it is determined that a Time and Materials Task Order is appropriate for the System Improvement and Enhancement CLINs of this requirement and no other task type is suitable because it is not possible to accurately estimate the extent or duration of the work or to anticipate costs with any reasonable degree of confidence at the time of placing the order. It is also hereby determined that the Operations and Maintenance CLINs shall be Fixed Price Level of Effort since these efforts are indefinable upfront but required for this critical project.
