FEDERAL BUREAU OF INVESTIGATION

FINANCE DIVISION | PROCUREMENT SECTION

JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY

Date: 03/24/2021

In accordance with Federal Acquisition Regulation 13.106(b), I hereby determine that the Following equipment listed on DJF-21-2100-PR-0001918 is available from only one manufacturer (brand name only), and competition is precluded as there are no substitutes available.

1. Nature and/or description of the action being approved.

In accordance with a statutory exception to the fair opportunity process, the FBI contemplates award of a firm fixed price contract in the amount of $66,947 for CCTV equipment.

2. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The FBI will complete construction on 7 buildings in FY21 they are: OPS1, Tech1, Commons/Fitness Center, Defensive Systems Unit, TEDAC Phase 4, TIEDS/ARMAGs, and

Substitution building. As such each building must be outfitted with CCTV as part of the FBI’s security package. Currently at FBI Redstone Avigilon is the current basis for the CCTV platform.

This new requirement must seamlessly integrate with the existing platform, with no additional training, infrastructure requirements, or personnel. The increase in cameras and video also increases the need to expand the control center components to be able to access the new cameras, review and store video. The CCTV infrastructure will be utilized by security components on the FBI campuses to monitor the FBI’s security posture 24 hours a day. The brand name, Avigilon is essential to the Government’s requirements for CCTV on the Redstone campus for the aforementioned reasons.

3. Identification of the exception to fair opportunity and the supporting rationale, including a demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the exception cited.

This report is for Avigilon HD Network Video Recording equipment products, cameras and corresponding components listed previously. CCTV cameras, peripherals and video storage are needed for FBI Redstone Arsenal construction projects with expected completion in mid to late

FY21. CCTV equipment, storage standards, and guidelines are directed by the FBI’s Security Division and the Technical Security Guide. All items must be compatible with existing Avigilon core components such as servers, licensing, and other equipment already in place in on the FBI Redstone Campuses without the need for additional equipment, training, or personnel resources. The component list of exact requirements is crucial to maintain the best CCTV coverage on the Redstone campus, substitution of parts is not allowable due to the differences in performance. Such as focal length of the lens, when security needs to obtain a wider view the camera must have the ability to back out and provide coverage of the requested area.

Conversely when security needs fine detail the camera must be able to zoom in to obtain the picture required. Avigilon has unique abilities required for the FBI’s security posture and the package of items for this requirement is exact for this specific need. For example, the H4/H5 cameras listed in the requirement from Avigilon are ideal for seeing objects and activity in complete darkness. Embedded with proprietary and patented self-learning video analytics, the H4/H5 cameras seamlessly integrate with Avigilon Control Center (ACC)TM, allowing security personnel to respond proactively and mitigate an incident before damage occurs. With unique adaptive IR technology, this camera provides both wide and narrow illumination, enabling consistent illumination in complete darkness to enhance image quality regardless of scene conditions. Avigilon cameras are equipped with new Triple Exposure Ultra-Wide Dynamic Range (WDR), and patented LightCatcher TM technology, ensuring excellent image detail for security personnel. The H4/H5 cameras are effective at monitoring a variety of environments that require discreet nighttime coverage, including parking lots and multiple sensitive campus locations. Avigilon maintains patents on much of its camera and video analytic technology and retains the exclusive rights to manufacture its technology. Only Avilgilon products can furnish the requirements, to the exclusion of other sources, because of the existing security requirements and the in-place CCTV infrastructure.

4. A determination by the contracting officer that the anticipated cost to the

Government will be fair and reasonable.

The estimated cost for this contract is $66,947. Although only Avigilon products will meet this requirement, the solicitation will be competed to a wide small business market and can be a small business set-aside.

5. Any other facts supporting the justification.

CCTV equipment, storage standards, and guidelines are directed by the FBI’s Security Division and the Technical Security Guide. All items must be compatible with existing Avigilon core components such as servers, licensing, and other equipment already in place in on the FBI

Redstone Campuses without the need for additional equipment, training, or personnel resources. The component list of exact requirements is crucial to maintain the best CCTV coverage on the Redstone campus, substitution of parts is not allowable due to the differences in performance.

6. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

The customer and Contracting Officer will continue to monitor the market to determine whether there may be other sources for which the total cost of competing and implementing this requirement is in best interests of the Government.
