1. Contracting Activity: MICC, Fort Stewart, GA

2. Description of Action: Request approval of sole source to procure audio visual equipment upgrade and installation at Fort Stewart and Hunter Army Airfield, GA

3. Description of Supplies/Services: The requirement is for installation, upgrade, and maintenance of four Garrison Audio Visual suites on Fort Stewart, GA and Hunter Army Airfield (HAAF), Savannah, GA. Locations include Fort Stewart Bldgs. 709, 1237 (two suites) and HAAF Bldg. 7920. The existing Garrison’s systems have Multi-Domain Video Network Switches (MDVNS) containing proprietary software. The custom code manages the automated routing of multiple sources to multiple destination displays and the automated switching between classification levels while maintaining STIG compliance. The user interface control units also use proprietary code. This procurement includes upgrades to existing suites and creates new suites that are all compatible and that allow for seamless operation of all suites by a small number of trained operators. The software is proprietary and must be maintained by the software owners, therefore, all hardware will be provided by the contractor to ensure compatibility and correct installation.

4. Authority Cited: FAR 13-501(a) Sole source acquisitions.

5. Reason for Authority Cited: performed the last upgrade to the existing AudioVisual suites and owns the programmed source codes. The source codes are proprietary in nature and only available through their original creator. The Government’s requirement includes removal, installation and annual maintenance on all suites. To perform any and all of these functions, it is critical that the vendor have the capability to access, program, customize, and update the proprietary software currently installed on the Audio-Visual suites. , as owner of the source code, is the only vendor able to fulfill the government needs.

6. Efforts to Obtain Competition: Competitive actions were considered. However, competitive actions are not possible due to proprietary products in nature. Failure to procure these items would have detrimental impacts to Garrison operations during emergency and non-emergency events.

Actions to Increase Competition: Because this is a sole source action, effective competition is not applicable.

Market Research: Initial requests for quotes were made via CHESS, however, no vendor responded to the whole requirement. The received responses were of equipment install, but did not include the software and integration with the existing suites.

Interested Sources: To date, no other sources have written to express interest in the acquisition.

Other Facts: It is recommended to be sole sourced to Procuring audio visual suites from other vendors would have equipment and software incompatible with existing suites, thus will also require new software. Therefore, to avoid these compatibility issues and additional expenses, it is essential to continue procuring the upgrades and software from the ITG, the original source

13. Fair and Reasonable Cost Determination:

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. This determination will be made using price comparison with previous similar purchases and the Independent Government Cost Estimate (IGCE). As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.

Based on the foregoing justification, I hereby approve the procurement of Garrison G6 Audio Visual upgrade and maintenance on a sole source basis pursuant to the authority of the Simplified Procedures for Certain Commercial Items, Title 41 United States Code Section 1901 as implemented by Federal Acquisition Regulation 13.5. The estimated value of the contract is with a period of performance 30 September 2024

– 29 March 2030. The approval is subject to availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition.
