EVALUATION CRITERIA

1.0 INTRODUCTION

A Bureau of Land Management (BLM) State Office has a requirement to conduct a Non- Time Critical Removal Action (NTCRA) at the ABC Mine Site located near Anywhere, Western U.S.

2.0 BACKGROUND

2.1 Background

In 1947, ABC Mining Company, mined vanadium and built a mill to process raw ore to separate and concentrate from the mined materials. During the mining operations from 1947 to 1961, approximately 10,000 cubic yards (CY) of ore were processed, resulting in 8,000 CY of waste tailings. The waste tailings, with high concentrations of heavy metals, primarily lead, arsenic, selenium, and uranium were placed in an unlined ravine/drainage area a few hundred yards down-gradient of the mine site. Additionally, there was a series of three detention ponds down-gradient of the tailings that were placed to manage water runoff. The detention ponds have long since silted over and are no longer functioning. The total area of the three detention ponds is approximately 7,500 square feet and the contaminated sediment is estimated to be 8 feet deep.

The mine site is littered with an estimated 5 tons of metal and 2 tons wooden debris which must be removed.

2.2 Location

The Site is approximately 50 miles south of Small City, and 120 miles east of Major City.

The site is located 3 miles northeast of the intersection of State Highway 1 and County Road 2 at an elevation of 8000 feet. The access road leading up to the site is a narrow gravel road that has washed out over the years and will need grading and approximately 1000 feet of gravel surface repair, as well as the placement of two 24-inch culverts, 18 feet long.

Potential laydown/ staging area for contractor equipment is located at the north side of State Highway 1 and County Road 2. The area has been vandalized in the past.

2.3 Site Description

In 2020, the BLM conducted an Engineering Evaluation/Cost Analysis (EE/CA) to characterize the nature and extent of contamination at the Site and to identify and evaluate removal alternatives to protect human health and the environment from risks posed by the hazardous substances at the Site.

The preferred alternative was Waste Consolidation in an On-Site Repository, which consists of moving waste tailings and ponds’ sediment waste into a single lined repository on a nearly level site approximately 2 miles southwest of the ABC Mine Site about 200 feet from the access road. The repository would then be covered with 12 inches of topsoil, sloped 3:1 in all directions and the cover would be stabilized with a soil growth amendment and seeded and mulched. The seed mix formula will be prescribed by the BLM.

There is sufficient space at the site of the repository to use as a borrow and staging area for the required topsoil, however the borrow area borders a culturally sensitive area with remnants and artifacts of historic Native American culture. Contractor will be required to have an archaeologist on site during any ground disturbance of the borrow area.

Upon completion of the repository signage shall be placed in the four cardinal directions around the repository. The BLM will provide the language to include on the signage.

A vehicle ranch-type gate shall be placed along the access road below repository to control access during construction and shall also include signage. The gate will remain following construction.

No threatened or endangered species are known to be present at the Site. Visual observations have indicated that the Site is mostly sparsely vegetated, seasonally dry, and does not provide unique ecological habitat when compared to surrounding land.

3.0 OBJECTIVES

The objective of this requirement is to complete removal actions, pursuant to CERCLA.

The proposed NTCRA involves excavating tailings and detention pond sediments for consolidation and stabilization at the repository location. The work includes the following primary activities:

1. Excavate 8000 CY tailings and 2200 CY detention pond sediment and consolidate these materials at the repository at a ratio dependent on moisture content, necessary to ensure optimal compaction.

2. During placement of the tailings and detention pond sediments, grade and compact the consolidated tailings at a slope no steeper than 3:1. The area upslope (northeast) of the repository will be graded to reduce the potential for stormwater run-on, while the area downslope (north) of the repository will be regraded to promote runoff.

3. Grade and contour the original tailings and area containing the sediment ponds to ensure adequate runoff.

4. Cover the consolidated tailings with 12 inches of topsoil to reduce potential for off-site migration. Cover soils will be obtained from the identified borrow area. Stabilize the cover with a soil growth amendment and seed the soil cover with native vegetation consisting of grasses and shrubs per the BLM’s seed mix formula. Apply mulch over the seeded consolidated pile and the former tailings area.

5. Repair 1000 linear feet of access road and install two 24 inches by 18 feet long galvanized culverts.

6. Install ranch type gate on access road.

7. Install signage around repository and on gate. Signage shall be attached using vandal-proof bolts and nuts.

8. Identify water source and provide dust controls and perimeter air monitoring during all

Site activities.

9. Implement stormwater best management practices and conduct regular stormwater monitoring during remedial activities, as needed.

10. Conduct annual inspections and maintenance activities to monitor the overall condition of signage, fencing, and vegetative cover system remaining on-site for three years.

4.0 SCOPE

4.1 General Requirements

To protect human and ecological receptors by reducing contaminants of concern (COCs) to levels below established remedial action objectives and/or risk-based cleanup levels and to control and/or reduce off-site migration of COCs, the Contractor shall perform the following actions:

• Scoping Meeting

• Schedule, Quality Assurance Plan, Health, and Safety Plan

• NTCRA Work Plan

• Implement NTCRA

• Completion Reporting

The Contractor shall furnish all personnel, facilities, equipment, material, supplies, and services (except as may be expressly set forth in this contract as furnished by the Government) and otherwise do all things necessary for, or incidental to, performing a CERCLA NTCRA and tasks as defined in this Statement of Work (SOW). All tasks must be accomplished in accordance with all Federal, state, and local laws.

The Contractor shall ensure the work is conducted in a manner that protects the safety and health of its employees, other personnel working on site, and members of the public, while complying with all Occupational Safety and Health Administration (OSHA).

The Contactor shall develop the NTCRA work plan and schedule in accordance with the NCP, and all work shall be conducted in a safe and effective manner. The Contractor shall prepare a completion report that details the work performed and lays out a framework for operations and maintenance (O&M) necessary for the work to maintain effectiveness.

Travel shall be limited to rates established in the Federal Travel Regulations for localities where work is performed.

All base tasks shall be completed by the end of the performance period.

4.2 Key Personnel

The Contractor shall provide the resumes of key management and technical personnel that will execute the work that may be awarded under this contract. Specifically, the Contractor shall provide a resume for the key individual(s) as listed below. The resumes shall clearly display proposed job title, education, and special qualifications, along with project experience at least within the last five years that identifies title, specific duties, responsibilities, and assignments. The purpose of this submittal is to identify the level of expertise available for this contract.

After contract award, replacement of any key personnel shall be approved by the Contracting Officer after verifying that they meet or exceed the requirements of the solicitation.

If further key management personnel are required to perform any work under this contract the Contractor shall be required to submit their resumes for approval by the Contracting Officer.

The following key personnel shall be identified:

1. Project Manager(s) – The Contractor shall provide one (1) resume for an individual who is trained and experienced as a Project Manager (PM). The Contractor shall identify the PM and the PM's qualifications; experience and performance history shall be satisfactory to the Contracting Officer before issuance of an award. The PM shall be competent, experienced, and knowledgeable in the field of Hazardous, Toxic, and Radioactive Waste (HTRW). The Contractor shall designate a PM to act as a single point of contact (POC) for coordination with BLM. The PM shall be responsible for the management of work, approved plans, and all federal, state, and local laws and regulations. The PM shall also maintain close communication and coordination with BLM for the duration of the project, including monthly progress and detailed cost reporting. The PM should have, as a minimum, the following qualifications:

• A college degree in environmental/engineering sciences, or related field.

• Professional registration, in their respective field, where applicable or available.

• Five (5) years working experience in Project Management for other contracts/programs with a minimum of three (3) years working experience in HTRW field.

• Working knowledge of applicable Federal, state, and local laws, regulations, and guidance.

2. Health and Safety Officer – The Contractor shall designate a Health and Safety Officer. HTRW sites require a Safety and Health Manager with the designation of Certified Safety Professional with a minimum of 10 years’ experience. This position may not be dual-hatted.

3. Construction Manager - A construction manager for environmental remediation projects will oversee phases of RCRA/CERCLA considered to be construction, i.e., remedial actions (CERCLA). The manager will ensure construction projects are completed on time and to the client's satisfaction and assist in staffing, outlining project plans, setting project goals/deadlines, and evaluating performance. The position requires a bachelor's degree and at least 7 years of experience in the field or in a related area. The manager must be familiar with standard concepts, practices, and procedures within CERCLA and HTRW.

4. Senior Geologist or Senior Project Engineer – This individual can be either a Senior Geologist or Senior Project Engineer.

a. Senior Geologist - This individual shall have as a minimum, a bachelor's degree in Geology, Hydrogeology, or geological engineering and shall have a minimum of 5 years of HTRW experience directly related to the education requirements as stated above. In addition, hydrogeologists shall have specific education, training, and experience appropriate in hydrogeology. The individual shall have experience performing work related to geological investigations, geotechnical and environmental sampling of soil and groundwater, complete logs, field reports and work with geologic data to create maps. This individual is responsible for implementing project work plans, overseeing the maintenance of field equipment, and complying with the project schedule. This individual shall also have at least one PG registration in good standing.

b. Senior Project Engineer - The Environmental Engineer shall have a Bachelor of Science in Environmental Engineering or closely related Engineering Degree, at a minimum. The Senior Project Engineer shall also have a minimum of 5+ years of HTRW experience and have at least one PE registration in good standing. This individual is responsible for implementing project work plans, overseeing maintenance of field equipment, and complying with the project schedule.

5. Archaeologist or Cultural Anthropologist – This individual shall have as a minimum, a bachelor's degree in Archaeology or Anthropology and shall have a minimum of 5 years of Native American historic and cultural survey experience directly related to the education requirements as stated above. In addition, this individual shall have experience in identifying historic Native American cultural artifacts in the field.

This individual shall be onsite during any ground disturbing activities in the borrow area and shall coordinate with BLM personnel should artifacts be located during the ground disturbance.

4.2 Specific Requirements

Task 1 – Post Award Kickoff Meeting The Contractor shall coordinate a meeting with the BLM COR, via email (provided at time of award), to hold a Post Award/Kickoff Meeting within 5 business days after the award of the Task Order. The Post Award/Kickoff Meeting may be held by teleconference call. The purpose of the meeting is to discuss the SOW and meet with the Government Contracting team, BLM staff, and Contractor before the initiation of subsequent tasks. The Contractor shall ensure that all Contractor parties, including those having the authority to sign on behalf of the Contractor, as well as other required parties that shall be coordinating the work efforts daily, are present at the meeting. If the Contractor chooses to physically attend the meeting, any associated travel costs are to be borne by the Contractor and will not be billable to the BLM.

The Contractor shall take meeting minutes and submit to the Contracting POC no later than 1 business day after the meeting. Meeting minutes shall be submitted electronically as a PDF document.

The Post Award/Kickoff Meeting shall occur before performing any other work.

Task 2 – Project Status Meetings, Schedule, QAP, and HASP

The Contractor should prepare and submit a Health and Safety Plan (HASP) and Quality Assurance Plan (QAP) to BLM for review. The HASP and QAP shall reflect the tasks and activities described in this SOW. The plan shall utilize the most current safety requirements by BLM. The HASP and QAP shall be approved by BLM before any field activities begin. The HASP shall also include the contact information of BLM Fire and BLM point of contacts (which will be given at the time of the award).

The Contractor shall prepare a schedule and submit it to BLM for review. The schedule shall present project deliverables, milestones, and start and finish dates.

Project status meetings shall be conducted monthly and facilitated by the Contractor during the work plan preparation/design phase. Weekly status meeting shall be conducted during all field and construction activities. The Contractor shall prepare an agenda that will be sent out prior to the meeting. The Contractor shall submit meeting notes to meeting attendees within two (2) days after the meeting. Topics to be discussed include, but are not limited to, the following:

• Project progress and schedule

• Comments and responses

• Site safety and other site requirements

Task 3 – NTCRA Work Plan The Contractor shall prepare a NTCRA work plan in accordance with the preferred alternative. The Contractor shall conduct a site visit during the development of the work plan. During the development of the work plan, the Contractor shall follow the State stormwater program. The Contractor is also responsible for meeting the substantive requirements of the State’s stormwater regulations. The work plan shall include, but is not limited to, the following:

• Process for delineating tailings and detention pond sediments prior to excavation.

• Procedure for excavating tailings and detention pond sediments.

• Process for consolidating excavated materials at the repository and grading/contouring of the original site and up and downslope of the repository.

• Detailed drawings of the consolidation of the excavated materials and grading/contouring, including clean soil and mulch cover.

• Procedure for applying soil and mulch cover to reduce potential off-site migration.

• A figure showing the proposed equipment staging areas and access routes.

• Proposed number of confirmation samples and their locations, sampling process, and laboratory analyses.

• Adaptive management strategy if any confirmation sample exceeds cleanup goals.

• Decontamination procedures.

• Gate and signage installation.

• Dust control during field activities.

• Perimeter air monitoring prior to and during field activities.

• Develop a stormwater pollution prevention plan (SWPPP) as an attachment, which includes the implementation of stormwater best management practices (BMPs) and regular stormwater monitoring during removal actions per federal and state regulations; and

• Coordination with BLM and local rancher during the removal activities.

The Contractor shall prepare and submit draft and draft final versions of the NTCRA work plan to the BLM for review. Final versions shall be submitted with responses to comments after receiving approval from the BLM.

Task 4 – NTCRA The Contractor shall perform the NTCRA as described in the subtasks below in accordance with the approved work plan. The Contractor shall also follow any Federal, state, and local regulation. Field notes shall be prepared during the NTCRA and submitted to BLM weekly. An office trailer, generator, potable water, and restroom facilities may be necessary for this task. To avoid encountering utility conduits and other potential obstructions, underground service alerts shall be contacted before field activities begin.

Stormwater Pollution Prevention The Contractor shall not discharge any water accumulated in the excavations or generated during the removal action directly or indirectly into any creeks, ditches, streams, washes, or waterways. The Contractor shall comply with the substantive requirements of all Federal, state, and local regulations and/or guidelines.

Air Monitoring and Sampling The Contractor shall conduct perimeter air monitoring and sampling prior to mobilization and during site activities to provide early detection of COC emissions and during the removal action. The monitoring and sampling program must include an exposure notification plan used to alert the Contractor and the BLM COR of the need to implement contingency measures to reduce the potential for community exposure to

COCs above established levels. Monitoring and sampling shall include off-site background air monitoring before initiation of removal activities. Air monitoring and sampling shall be performed in accordance with the Contractor’s Perimeter Air Monitoring Plan (PAMP) which has been accepted by the BLM.

Field Records The Contractor shall maintain field records sufficient to recreate all field activities. The information shall be recorded in a permanently bound notebook with sequentially numbered pages. The following information shall be recorded for all field activities: (1) location, (2) date and time, (3) identity of people performing activity, (4) weather conditions, and (5) logs of the activities being conducted and observations. For field measurements: (1) the numerical value and units of each measurement, and (2) the identity of and calibration results for each field instrument shall be recorded. A bound field notebook shall be used during all field work to record sample identification numbers and chain of custody numbers, as well as personnel present on site, site conditions, visitors to the site, and all significant events and observations. At the end of each workday, the Contractor shall complete a daily log and submit it to the BLM via email weekly.

Task 4.1 – Excavation, Removal, and Consolidation The Contractor shall excavate tailings and detention pond sediments and consolidate these materials in a repository. The proposed NTCRA involves excavating approximately 8000 CY of tailings material and another approximately 2200 CY of detention pond sediments for consolidation and stabilization in the repository. The Contractor shall also grade and compact the consolidated tailings/sediments at a slope no steeper than 3H:1V. The area upslope of the repository shall be graded to reduce the potential for stormwater run-on, while the area downslope of the repository shall be regraded to promote run-off. During site activities, dust controls and stormwater best management practices (BMPs) and monitoring shall be implemented in accordance with the workplan.

The consolidated tailings/sediments shall be covered with 12 inches of soil to reduce potential for off-site migration. Cover soils shall be obtained from the identified borrow area. An archaeologist or cultural anthropologist must be present during ground disturbing activities at the borrow area site. Soil growth amendment, mulch and seed of native vegetation shall be applied to stabilize the cover. Mulch shall be machine crimped over the seeded consolidated pile.

Fencing and signage warning of the potential human health threats shall be installed surrounding the repository.

Task 4.2 – Grade and Contour the Excavated Streambanks The Contractor shall grade and contour the original site to prevent erosion per the approved workplan. Mulch shall be applied after grading and contouring are completed. During site activities, dust controls shall be applied, and stormwater best management practices and monitoring shall be implemented in accordance with the workplan. Mulch would be machine crimped over the former detention ponds area.

Task 4.3 – Confirmation Sampling The Contractor shall perform confirmation sampling after the completion of the excavation and removal activities per the approved workplan. Enough samples shall be collected at the excavated areas to represent the site condition including, but not limited to, the floor and the sidewalls of the excavation.

Task 4.4 – Scrap Metal and Wood Debris Removal The Contractor shall remove and dispose of scrap metal and wood debris at the site.

There is approximately 5 tons of scrap metal and 2 tons of wood debris scattered around the site. The Contractor shall be responsible for identifying the proper transportation and facility for disposing of the scrap metal and wood debris in accordance with Federal, state, and local regulations.

Task 5 – NTCRA Completion Report The Contractor shall prepare and submit the NTCRA Completion Report at the conclusion of field activities. The report shall provide a summary of the soil excavation activities, confirmation sample results, and any deviations from the final approved work plan. As-builts drawings shall be attached in the report. A topographic survey of the repository and the grading/contour work shall also be included.

The Contactor shall submit documentation of all debris removal, including copies of waste manifests, along with the completion report and to the BLM for record.

The NTCRA Completion Report shall also include recommendations regarding annual inspections and maintenance activities to monitor the overall condition of signage, fencing, and vegetative cover system. All native files developed for the as-built drawings shall also be submitted to BLM as part of this task. The draft version of the report shall be submitted to BLM for comments. Final version shall be submitted to

BLM.

Note regarding all task items: The Contractor should include no less than one conference call (phone, WebEx, or other method) for each of the identified tasks. For each task item requiring submission of a written product, the submission shall be considered a “draft” document.

The BLM’s COR will be responsible for circulating drafts for comment and submitting cumulative comments/edits to the Contractor within 30 workdays unless otherwise specified. Generally, one review will be sufficient however, based upon the amount or complexity of the comments, BLM shall have the option of reviewing additional drafts in this same manner until the documents are revised to BLM’s satisfaction.

All documents shall be submitted electronically in both Adobe PDF and Microsoft Word, (Font Times New Roman, 12 pt.) and AutoCAD (2012) compatible formats. The format of the document is subject to approval by the COR through prior approval of the Table of Contents. The document shall follow the APA style manual unless otherwise authorized by the COR. For all draft and final versions, the Contractor shall submit an electronic version of each draft for review via email. The final version shall be submitted electronically via email and on three (3) separate flash drives.

REGULATORY APPROVALS

The contractor shall follow CERCLA and the NCP for conducting this NTCRA. Work shall be performed on lands managed by the BLM. The contractor must comply with all Federal, state, and local laws and regulations.
