Performance Work Statement
MERLIN™ Aircraft Birdstrike Avoidance Radar Maintenance
1.0 Scope
The work shall provide service and maintenance for the MERLIN™ Aircraft Birdstrike Avoidance
Radar manufactured by DeTect, Inc. and installed at Whiteman AFB, Missouri. The system has been supported by the manufacturer to date starting under the original Three-Year System Warranty that included all costs for labor, materials and other costs for system preventive maintenance (excluding routine maintenance that is to be provided by the USAF), 24-7 telephone and internet technical support, remote system monitoring, software upgrades and maintenance, and, repair or replacement of any failed parts or components.
This scope of work provides continued maintenance of the radar including system preventive maintenance (excluding routine maintenance that is to be provided by the USAF), 24-7 telephone and internet technical support, remote system monitoring (via MERLIN FileWatcher® if the system is connected to the Internet), MERLIN operating system software upgrades and maintenance, and, repair or replacement of any failed parts or components. This PWS specifically does not cover wear parts as identified below.
The primary place of performance is Whiteman AFB, MO. The period of performance will be 1 April
2016 thru 30 September 2016 with three (3) consecutive option years.
2.0 General Requirements/Description of Services
2.1 Non-Personal Services
The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor’s responsibility to notify the Contracting Officer (CO) immediately.
2.2 Business Relations
The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel. The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement.
2.3 Personnel Administration
The contractor shall provide the following support as required. The contractor shall maintain regular work hours for employees during designated Government non-work days or other periods where
Government offices are closed due to weather or security conditions. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements.
2.4 Subcontract Management
The contractor shall be responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The prime contractor will manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations. Contractors may add subcontractors to their team after approval by the Contracting Officer (CO). Cross teaming may or may not be permitted.
2.5 Contractor Personnel, Disciplines, and Specialties
The contractor shall accomplish the assigned work by employing and utilizing qualified personnel with appropriate combinations of education, training, and experience. The contractor shall ensure the labor categories are as defined in the wage determination and utilized as specified in the PWS.
Contractor Identification in the Government Workplace. All contractor and subcontractor personnel shall be required to wear company picture identification badges so as to distinguish themselves from
Government employees. When conversing with Government personnel during business meetings, over the telephone, or via electronic mail contractor and subcontractor personnel shall identify themselves as such to avoid situations arising where sensitive topics might be better discussed solely between Government employees. Contractors and subcontractors shall identify themselves on any attendance sheet or any coordination documents they may review. Electronic mail signatures shall identify company affiliation.
3.0 Installation Requirements
The equipment covered by this PWS includes the MERLIN System installed and currently operating at USAF Whiteman AFB, Missouri along with any upgrades to the system made by DeTect since the original delivery date and includes the following:
a. The System hardware as originally supplied by DeTect along with any DeTect-supplied upgrades or modifications made to the System.
b. The MERLIN System operating software and any upgrades and/or add-on functionality supplied by DeTect.
Items not covered by this PWS are the base supplied or installed components or ancillary systems and system wear parts.
The Contractor shall provide service, maintenance and repair of the System as follows:
c. Covered service shall be provided on normal business days, which are Mondays through Fridays, during business hours from 8:00 AM to 5:00 PM CST, except for US Federal and State holidays.
d. Should the Government request an unscheduled service or services outside of normal business hours, the Contractor shall use all reasonable endeavors to comply with the request, but the work will be considered outside the scope of this contract. A separate contract vehicle will be used to acquire those services. No work shall be conducted until approval has been given by the Contracting Officer or an authorized Government Purchase Cardholder.
e. MERLIN System operating software upgrades as released by DeTect will be periodically obtained and installed by the Contractor, either on-site or via remote download, and are included under this plan and no additional cost shall apply for such upgrades.
f. The Contractor shall conduct at least one scheduled site visit to Whiteman AFB annually consisting at a minimum of two full business days at the location. This visit will provide:
preventive maintenance on the system to include system checks, installation of software upgrades, defective or failed component replacement or repair, performance testing, and user training on system use. Additional visits to the base will be coordinated between both parties based upon unforeseen circumstances (hardware faults, training, etc).
g. Repair or replacement of system components deemed defective due to manufacture or workmanship will be performed by the Contractor under this plan and the contractor shall repair or replace such components with new or remanufactured components to maintain system operability within the manufacturer’s design parameters.
h. Internet connectivity services to ensure software and hardware are running properly.
Service and maintenance work will be provided to the Government within the scope of this contract subject to the following requirements:
i. In the event of a system failure or defect, the Government will notify the contractor of such failure in a reasonable and timely manner.
j. Upon such notification, Government personnel will work with the Contractor Technical Support staff by telephone or email to diagnose the cause of the failure, and the base will perform minor software or hardware adjustments, minor repairs, and/or simple LRU (least replaceable unit) change-outs in order to restore the system to full operations.
k. If on-site service is required to correct the failure, the Government will provide the Contractor full and free access to the facilities and the system once an approved Entry Authorization Letter has been filed.
l. The Government will maintain a written log [electronic or paper] of site visits, system inspections, electrical power outages (or other electrical power disturbances), system location changes, significant weather events, routine maintenance, equipment faults and symptoms, and will make such log available to contractor personnel (through e-mail or fax) before and during any required service work.
m. The Government will follow all manufacturer recommended routine maintenance procedures and will ensure that the system is maintained in good, clean condition in accordance with the System Operations & Maintenance Manual.
n. The Government will follow the manufacturer’s guidance and instructions regarding system operations, storage, transport, and routine and corrective maintenance actions.
o. The Government agrees not to install any third party software on any system computers covered under this plan, unless pre-approved by the manufacturer.
p. The base will not otherwise modify any software or computer internal settings such as the BIOS or other configuration files unless pre-approved by manufacturer.
5.0 Deliverables
5.1 During an installation or maintenance period, the Contractor shall keep the Flight Safety Office informed verbally at the end of each work day.
6.0 Billing
All invoices shall be submitted in Wide Area Work Flow (WAWF) as specified in the award.
7.0 Special Requirements
Contractor personnel shall present a neat appearance and dress in a professional manner as such is reasonably expected in a professional office setting. Contractor shall wear appropriate security badges, line badges, identification and/or name tag as required by the security procedures of the squadron where performance takes place. Contractor shall utilize company-owned or privately owned vehicles for transportation while on the installation.
9.0 Security and Safety
Contractor personnel shall meet established unescorted installation entry requirements pursuant to
AFI 31-101 before base identification will be issued. In addition, if onsite maintenance is required system operators will need to be placed on an approved EAL prior to arrival. Contractors shall submit requests for installation identification to 509 SFS no later than 72 hours following contract award, and
72 hours prior to the individual(s) requiring subsequent entry on to the installation. Personnel not meeting the minimal standards will not be issued an installation pass and will not be allowed access to the installation.
10.0 Education/Experience
Contracted personnel shall be a U.S. citizen at the time of award. Contracted personnel shall be certified to work on the MERLIN™ Aircraft Birdstrike
11.0 Operational Security
Purpose: The following information provides Operations Security (OPSEC) guidance to
Government Contractors and subcontractors awarded Government contracts at Whiteman AFB.
Government Contractors are provided this guidance to ensure compliance and protection of critical information that may be a threat to national security.
Definition: OPSEC is a methodical process to identify Critical Information (CI), identify threats to that CI and the related vulnerabilities and risks of exploitation to that CI, and identify, develop, and implement countermeasures to protect that CI. CI is specific facts about friendly intentions, capabilities, and activities vitally needed by adversaries for them to plan and act effectively so as to guarantee failure or unacceptable consequences for friendly mission accomplishment. CI includes those facts, which individually, or in the aggregate, reveal sensitive details about US Government, i.e.
Whiteman AFB or the contractor’s security or operations related to the support or performance of the Statement of Work (SOW)/Performance Work Statement (PWS), and thus require a level of protection from adversarial collection or exploitation not normally afforded to unclassified information. OPSEC supplements, but does not replace traditional security practices such as Physical
Security and Information Security. OPSEC is essential to ensure the initial and continued success of our mission, operations, systems, and procedures.
OPSEC Applicability: The 509 OSS OPSEC Program Manager has determined that additional safeguards are essential for this contract, and imposes OPSEC as a requirement in the responsibilities of this contract. During the course of this contract, in addition to those restrictions, instructions and guidelines defined in the contract Statement of Work and/or other references provided the contractor will adhere to the following minimum requirements in support of the 509 OSS OPSEC Program.
a. Introduction of personnel electronic devices into government spaces, laptops, tablet PCs, cellular phones, cameras, recording devices, and data recording/storage devices is STRICTLY controlled and forbidden in some areas of Whiteman AFB. Photography and recording is not allowed except for official use and by permit only. (Unless otherwise stipulated in the contract).
b. Contractor personnel shall not discuss government operations in public or over unprotected or unencrypted communications. Official business, controlled unclassified information may only be transmitted as directed in the SOW/PWS.
c. The Contractor shall not post to company websites, publications, newsletters or other media any images, data or information that reveal sensitive government operations, personnel, equipment, and/or classified or controlled unclassified information, refer to paragraph (d) below. When in doubt, company press releases related to this contract should be coordinated through the 509th
Contracting Office.
d. Because observation of events, operations, physical changes, etc. may reveal National Security information, specific restrictions are needed to preclude unintentional release of this information to unauthorized parties. (Unauthorized disclosure and transfer of National Security Information is punishable under 18 USC § 793.) Therefore, contractor personnel shall not disclose to unauthorized third parties, post to unofficial sites (including Social Networking sites) any images, data or information, or observed events that reveal sensitive government operations, personnel, or equipment.
e. Government issued badges, identification shall be removed and/or concealed from plain sight when off station and shall not be left in vehicles or unprotected. Badges and passes may not be duplicated or copied or loaned to others. Lost or stolen identification badges, vehicle passes etc.
will be immediately reported to the 509th Security Forces LE Desk at (660) 687-3700.
f. Practice OPSEC and implement countermeasures to protect CI and other sensitive unclassified information and execution of military operations performed or supported by the contractor in support of the mission. Protection of CI will include the adherence to and execution of countermeasures which has been provided by the 509 OSS.
g. It is strongly recommended the contractor mark and protect related internal production schedules, deliverables, inventories and shortages and identified vulnerabilities related to production of government material. Internal company markings e.g., Business Sensitive, etc., are appropriate for identifying the aforementioned as sensitive information. Specific Government-provided information, drawings etc., will be protected in accordance with guidance in applicable paragraphs of the SOW.
h. Destroy (burn, shred, etc.) critical and/or sensitive unclassified information no longer needed to prevent the inadvertent disclosure and/or reconstruction of this material.
i. Critical information identified by 509 OSS will be marked and handled appropriately as FOR
OFFICIAL USE ONLY (FOUO). Government CI includes but is not limited to: known or probable vulnerabilities to any U.S. system and their direct support systems, details of information about military operations, unit, vessel, aircraft movements/arrivals, missions and exercises, etc.
j. An applicable list of 509 OSS CI will be provided to the contractor by the 509th Contracting
Office upon award of the contract. Questions regarding Critical Information shall be directed to the Contract Administrator.
