1.5 ENGINEERING SERVICES

Refer to Section I for information and requirements regarding layout of work.

1.6 MEANS AND METHODS

Means and methods of construction are solely the responsibility of the Contractor and shall be such as the Contractor or his subcontractors may choose; subject, however, to the Contracting Officer's right to reject means and methods proposed which, in his opinion:

1. Constitute a hazard to the work, persons or property.

2. Will not produce finished work in accordance with terms of the Contract.

3. Are contrary to specified means or methods included in the Contract.

The right to reject means and methods of Contractor or subcontractor shall not be construed or interpreted as acceptance of control of means and methods by the Contracting Officer.

The Contracting Officer's approval or failure to exercise right to reject means and methods will not relieve the Contractor of his obligation to complete the work required by the Contract.

Total responsibility for control of means and methods lies with the Contractor for all work.

1.7 ENVIRONMENTAL PROTECTION

The Contractor shall prevent, abate and control all environmental pollution arising from construction activities by complying with all applicable Federal, State and local laws and regulations concerning environmental pollution control and abatement, as well as the specified requirements in this Contract. It is the responsibility of the Contractor to have subcontractors comply with this requirement.

Fossils and Artifacts - Should the Contractor discover any fossils or artifacts during construction operations, such objects shall become the property of the Government. The Contractor shall cease construction operations in the area of the "find" and immediately notify the Contracting Officer of such discovery. Construction operations may proceed in other areas not affected by this clause. Care shall be exercised by the Contractor so as not to damage fossils or artifacts uncovered during excavation operations.

1. The Contractor shall comply with applicable Federal, State and Local laws and regulations concerning the control and abatement of water pollution.

2. The Contractor shall be responsible for controlling erosion, sedimentation and turbidity (muddy water) in waters which may violate water quality standards. Some common methods of stabilization and turbidity control include hay bales, silt fencing, grassing, SECTION 01 01 00 Page 4 marine-type turbidity screens, and timber work platforms. Contractor shall deploy, where necessary, control devises of a design and method effective in maintaining all water standards.

3. The Contractor's construction activities shall be performed by methods that will prevent entrance or accidental spillage of solid matter, contaminants, debris and/or other objectionable pollutants and wastes into rivers, streams, flowing or dry watercourses, lakes, ponds, and underground water sources. The Contractor shall dispose of all pollutants such as petroleum products, hazardous chemicals, rubbish, cement, concrete, etc., by properly handling and hauling the material away in tanks, barrels or other suitable containers to an approved disposal site.

4. Sanitary facilities, such as chemical toilet, shall be located far enough from a well, live stream or pond to prevent pollution of the water.

5. Dewatering work for structure foundations or earthwork operations adjacent to, or encroaching on, streams or watercourses shall be conducted in a manner to prevent muddy water and eroded materials from entering the rivers, streams, lakes or watercourses by construction of intercepting ditches, bypass channels, barriers, settling ponds or by other approved means. Excavated materials shall not be deposited or stored in, or alongside of, watercourses where it can be washed away by high water or storm runoff.

6. Waste waters from aggregate processing, concrete batching, concrete waste or other construction operations shall not enter streams, watercourses or other surface waters.

1. The Contractor shall comply with applicable Federal, State and local laws and regulations concerning the prevention and control of air pollution.

2. Construction activities shall be performed in such a manner that air pollution is held to a minimum.

3. Burning of materials, trees and brush, combustible construction materials and rubbish will be permitted only if it is approved by the Contracting Officer and properly permitted by Federal, State, and local regulatory agencies, and when atmospheric conditions for burning are considered favorable by appropriate State or local air pollution or fire authorities.

4. Where open burning is permitted, burn piles shall be properly constructed to minimize smoke. In no case, shall unapproved materials, such as tires, plastics, rubber products, asphalt products or other materials that create heavy black smoke or nuisance odors, be burned.

5. All construction areas, access or haul roads, parking areas and storage areas used during construction shall be managed by application of dust inhibitors or by sprinkling with water to suppress dust formation in accordance with Federal, State, and local regulatory agencies.

SECTION 01 01 00 Page 5

QUALITY CONTROL

10/21

PART 1 GENERAL

1.1 TESTING AND QUALITY CONTROL

An independent testing laboratory shall be retained by the Contractor, to inspect and test the materials and methods of construction as herein specified or otherwise directed by the Contracting Officer for compliance with the requirements of the Contract Documents and to perform any other specialized technical services as the Contractor may require.

The independent testing laboratory shall be selected by the Contractor and the name of proposed laboratory submitted to the Contracting Officer for approval.

1. The testing laboratory shall comply with "Recommended Requirements for Independent Laboratory Qualification" by the American Council of Independent Laboratories, and which specializes in the types of inspections and tests to be performed.

The use of laboratory services shall in no way relieve the Contractor of the responsibility to furnish materials and construction in full compliance with the Contract Documents.

The Contractor shall cooperate with and advise the laboratory sufficiently in advance of operations to allow for completion of tests and for the assignment of personnel.

When laboratory results or reports indicate that the material furnished or work performed does not meet professional standards or the requirements set forth in the Specifications, the Contractor shall immediately notify the Contracting Officer verbally and in writing of the deficiencies and the proposed corrective measures.

Failure of any tested area to meet specifications shall be cause for rejection. All deficiencies shall be corrected and retested for compliance at the Contractor's expense.

Payment of all testing and laboratory expenses shall be the sole responsibility of the Contractor.

Tests shall be conducted in accordance with the requirements of the specifications designated or, where not specified, the latest standards of American Society for Testing and Materials.

Written reports shall be prepared and submitted promptly to the Contracting Officer covering each inspection and test.

An Independent Testing Laboratory shall provide the services and tests required below:

1. Density Tests associated with the earthwork backfill and subgrade

- Refer to Section 31 00 00 - EARTHWORK.

SOURCES FOR REFERENCE PUBLICATIONS

02/19

PART 1 GENERAL

1.1 REFERENCES

Various publications are referenced in other sections of the specifications to establish requirements for the work. These references are identified in each section by document number, date and title. The document number used in the citation is the number assigned by the standards producing organization (e.g., ASTM B564 Standard Specification for Nickel Alloy Forgings). However, when the standards producing organization has not assigned a number to a document, an identifying number has been assigned for reference purposes.

1.2 ORDERING INFORMATION

The addresses of the standards publishing organizations whose documents are referenced in other sections of these specifications are listed below, and if the source of the publications is different from the address of the sponsoring organization, that information is also provided.
