NOTICE FOR FILING AGENCY PROTESTS
United States Coast Guard Ombudsman Program
It is the policy of the United States Coast Guard (USCG) to issue solicitations and make contract awards in a fair and timely manner. The Ombudsman Program for Agency Protests (OPAP) was established to investigate agency protest issues and resolve them without expensive and time- consuming litigation. OPAP is an independent reviewing authority that is empowered to grant a prevailing protester essentially the same relief as the Government Accountability Office (GAO).
Interested parties are encouraged to seek resolution of their concerns within the USCG as an Alternative Dispute Resolution (ADR) forum rather than filing a protest with the GAO or some external forum. Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the Contracting Officer or Ombudsman.
Informal Forum with the Ombudsman. Interested parties who believe a specific USCG procurement is unfair or otherwise defective should first direct their concerns to the applicable Contracting Officer. If the Contracting Officer is unable to satisfy their concerns, interested parties are encouraged to contact the U.S. Coast Guard Ombudsman for Agency Protests and CC the Contracting Officer. Under this informal process the agency is not required to suspend contract award performance. Use of an informal forum does not suspend any time requirement for filing a protest with the agency or other forum. In order to ensure a timely response, interested parties should provide the following information to the Ombudsman at OPAP@uscg.mil and the Contracting Officer: solicitation/contract number, contracting office, Contracting Officer’s name, solicitation closing date (if applicable), and their concerns.
Formal Agency Protest with the Ombudsman. Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the Contracting Officer through open and frank discussions. If the protester’s concerns are unresolved, an Independent Review is available by the Ombudsman. The protester may file a formal agency protest to either the Contracting Officer or as an alternative to that, the Ombudsman under the OPAP program, and CC the Contracting Officer in all communications.
Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined in writing to be in the best interest of the government. The agency’s goal is to resolve protests in less than 35 calendar days from the date of filing. Protests shall include the information set forth in FAR 33.103(d)(2). If the protester fails to submit the required information, resolution of the protest may be delayed or the protest may be dismissed. To be timely protests must be filed within the period specified in FAR 33.103(e). Formal protests filed under the OPAP program should be emailed to OPAP@uscg.mil and the Contracting Officer.
Election of Forum. After an interested party protests a Coast Guard procurement to the Contracting Officer or the Ombudsman, and while the protest is pending, the protester agrees not to file a protest with the GAO or other external forum. If the protest is filed with an external forum, the agency protest will be dismissed.

D.2 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
a) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Factor 1: Technical Capability/Approach, Factor 2: Past Performance, Factor 3: Price
Offerors will receive a confidence rating for Factors 1 and 2, respectively. Factor 3 will be evaluated for reasonableness. Factors 1-3 are in descending order of importance. Factors 1 and 2, when combined, are significantly more important than Factor 3. The Government will conduct a Trade-off to determine the Offeror whose proposal represents the best value to the Government. For the purposes of this RFP, “best value” is defined as the most advantageous acquisition decision for the Government and is performed through a trade-off analysis among the three (3) evaluation factors. In doing so, the Government may award to other than the lowest priced proposal or other than the highest-rated proposal.
b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
1) Technical Capability/Approach The Government will evaluate the Contractor’s proposal for knowledge and understanding of the SOW with feasibility and soundness of the written proposal. The Government will evaluate the Contractor’s capability and approach to describe testing and repair procedures in response to the SOW section 3 determined as requirements returning equipment to class “A” ready for install.
2) Past Performance The Government will evaluate an Offeror’s past performance by reviewing recent and relevant submissions by the Offeror as required per the solicitation. The Government reserves the right to utilize past performance information from sources including, but not limited to, data contained in CPARS.
An Offeror without a record of relevant past performance within the past three years, or for whom information on past performance is not available, will not be evaluated favorably or unfavorably, but will receive a confidence rating of neutral.
3) Price The Government will evaluate each Offeror's total evaluated price for reasonableness and will be evaluated to ensure that they are fair and reasonable for performance of the requirements established in the solicitation and as proposed in the technical submission.
d) Basis for Award.
Award shall be made to the Offeror whose proposal, in conforming to this solicitation, is determined to be the best value to the Government based on a trade-off among the non-priced and priced factors considered.
D.3 FAR 52.212-3 -- Offeror Representations and Certifications -- Commercial Products and Commercial Services (FEB 2024):
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
