About this file
This is a Non-Disclosure and Non-Use Agreement (NDA) attachment for a federal contract opportunity seeking sources for advanced ammunition production. The agreement establishes the terms and conditions under which potential offerors may receive access to restricted technical data related to 120mm APFSDS-T (Armor Piercing, Fin Stabilized, Discarding Sabot with Tracer) tungsten cartridges, specifically the KE-W A1 and KE-W A4 variants or equivalents. The technical data is classified as Distribution D, restricted to Department of Defense personnel and DoD contractors only, with export controlled under the Arms Export Control Act and Export Administration Act.
Prospective offerors must execute the NDA to receive the performance specification and technical drawings required to submit a competitive proposal. The agreement prohibits the disclosure, duplication, or use of the restricted technical data for any purpose other than responding to the solicitation, and requires that all subcontractors, consultants, and employees with access execute similar agreements. The NDA specifies obligations for data protection, storage, and return or destruction of materials upon request. Offerors must also be registered with the U.S./Canada Joint Certification Office and submit a signed DD Form 2345 (Military Critical Technical Data Agreement) along with the AMSTA-AR Form 1350 Technical Data Request Questionnaire to obtain access to the specification and drawings. Foreign subcontractors require export license authorization prior to receiving any restricted technical data.
