About this file

This document is a Justification for an Exception to Fair Opportunity Brand Name procurement in accordance with FAR 16.505(a)(4)(i) for the United States Coast Guard's (USCG) requirement for Oracle software licenses and maintenance support. The USCG needs to maintain continued Oracle license support to receive required software upgrades, patches, and security updates that are critical for system performance and interoperability across the USCG's infrastructure. Due to the proprietary nature of Oracle software, the USCG intends to compete this requirement using the DHS First Source II contract vehicle to ensure fair and reasonable pricing through competition among authorized Oracle resellers. The Contracting Officer will conduct a price analysis to determine best value. While the USCG will continue exploring alternative software options, Oracle is currently the only viable solution to sustain its mission-critical systems on unclassified and classified networks.

requirement will be procuring items peculiar to one manufacturer on a brand name basis in accordance with FAR 16.505(a)(4).

Oracle is proprietary and is currently utilized on desktops and servers on unclassified and classified systems throughout the USCG infrastructure. The USCG needs to maintain continued license support in order to receive required software upgrades, patches, and security updates, which provide critical fixes that affect system performance and are required for Oracle software to operate within the USCG architecture.

Furthermore, USCG network architecture, maintenance platforms, and configuration systems require the use of this product to ensure interoperability with other USCG systems at all data centers. Oracle software must be configured in accordance with USCG system architecture requirements. The use of other products could result in interoperability, compatibility, interface customer support.

Failure to upgrade or patch existing Coast Guard owned software will expose systems to cyber security vulnerabilities and threats, degraded system performance, loss of functionality or failure of applications, resulting in disconnection from the USCG network causing system shutdown.

Software upgrades provide critical fixes that impact system performance. This prevents cyber-attacks and protects against Coast Guard data systems and networks being exposed to potential intrusions, which in turn impacts the integrity, availability, and confidentiality of information.

Due to the Oracle proprietary requirements, the contracting strategy that will provide the Government the best value is competing the brand name Oracle software maintenance renewal using the DHS First Source II vehicle.

5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer determines that the anticipated cost will be fair and reasonable based on adequate price competition as there are multiple authorized Oracle resellers on the DHS FSII contract vehicle. The Contracting Officer will seek additional price reductions before placing an order. The Contracting Officer will also perform a price analysis to determine that the price at the time of award still represents the overall best value for the Government and is consistent with the contract vehicle terms.

6. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.

As Oracle software is currently being utilized by the USCG it will be required for the foreseeable future. The availability of multiple resellers able to provide this brand name requirement ensures competition. However, the Government will continue to conduct market research into other software and support options that can meet its requirements.
