Contractor is responsible for understanding and complying with all requirements specified herein. The requirements listed herein work in conjunction with the technical drawings and other references to describe
4.1.1 The Contractor shall, in accordance with applicable documents listed in § 2 of this SOW, provide the required labor and material to support all facets of Availability. The Contractor shall:
Tow two (2) decommissioned and unmanned USCG 87' “Marine Protector Class” Patrol Boats
(CPB) from USCG Base Honolulu (Sand Island) to storage location in preparation for dry stored and pending heavy lift transportation. The Contractor is responsible for coordinating vessel delivery and pick-up, with the COR, no less than three (3) working days prior to vessel delivery and pick-up. This is the minimum time needed for the COR to coordinate vessel availability with the respective facility.

Vessel Lay-Up. Cradles will not be provided by the government. The Contractor shall construct a cradle IAW the USCG drawings or use the approved USCG blocking plan.
4.1.2 Availability contracts must have the flexibility to add and delete work during availability execution without placing the Government at a negotiating disadvantage. Condition-directed repair makes it impractical to fully scope all work required prior to the start of the availability, making flexibility a necessary component in all contracts.
4.2 Care of Vessel
As soon as the contractor takes custody of a vessel, the Contractor shall be responsible for the care of vessel equipment, materials, trailers, and components related to the work being performed. Each vessel shall be kept free of chips, shavings, refuse, dirt, sandblast grit and dust, scrap materials, welding slag, mailto:Joy.R.Rogers-Cheatham@uscg.mil

and other extraneous materials. Piping ends shall be covered with appropriate covers to prevent system contamination. Open areas in structure shall be covered to prevent water entry. Tanks and voids opened shall be clean, dry, and pass Government inspection prior to being closed and accepted. Do not operate or utilize existing, newly installed, or repaired shipboard equipment for or in the performance of the contractor’s work effort. Temporary protective measures shall be taken to avoid wear and damage to the vessel and all associated components. Water shall not be allowed to accumulate in the hull or structure during work performance. Measures shall be taken to prevent corrosion and deterioration of the Vessel and all associated components. Vessel shall be broom clean and all preservation coatings fully cured prior to final delivery to the Government.
4.3 Workmanship
Workmanship provided by contractor employees shall be consistent with the highest standards of commercial marine practices and regulatory bodies. The Government reserves the right to accept or reject material and workmanship nonconformance. Noncompliance with contractor’s quality control processes will influence past performance rating provided on contract evaluation. At the time of delivery, work performed shall meet the performance requirements specified. In the event that deficiencies are discovered during the warranty period, an opportunity will be afforded the contractor to witness, inspect and comment on such deficiencies. Materials and articles used for work performed shall be of commercial marine quality, conforming to the requirements of the regulatory bodies listed herein, unless specified to be otherwise. Where terms such as machinery, fittings, structures and equipment are herein specified to be in accordance with government specifications it is intended that commercial marine equivalents, when approved by the government, may be substituted.
4.4 Welding
Upon request, the Contractor shall provide the necessary welding certifications and qualifications to the
COR as required by the specification for the applicable work item(s), Standard Specification 0740 STD.
4.5 Coatings Certification Requirements
Upon request, the Contractor shall provide description of how SFLC Standard Specification 0000 coatings QC/QA requirements for this contract will be met. This plan must include the names of any subcontractors and a demonstration of the ability provide qualified personnel for any proposed QP1 certified painters and/or independent NACE CIP Level 3 inspectors.
4.6 Access to Vessel
A reasonable number of officers, employees, and associates with the U.S. Government, or other Prime
Contractors with the Government, and their subcontractors, shall, as authorized by the KO, have, at all reasonable times, admission to the shipyard, and access to vessel to perform and fulfill their respective obligations to the Government on a noninterference basis. Work hours for the vessel will be discussed at the Arrival Conference. Any work performed outside of those hours will be allowed at the sole discretion of the KO.
4.6.1 The KO or COR will provide the Contractor a personnel list of all USG anticipated to require access to the shipyard and vessel. Access areas include admission to the Contractor's facilities and
87’ DD
shipyard and access to the vessel and to office space, work areas, storage or shop areas, or other facilities and services, necessary for the performance of their respective responsibilities and reasonable to their performance. All such above personnel shall be required to comply with all Contractor rules and regulations governing personnel at its shipyard, including those relative to safety and security.
4.7 Growth Work
The Contractor shall not perform growth work without the KO's authorization. Growth work is work within the scope of the contract, which has not been previously priced as a pre-priced CLIN. The
KO reserves the right to contract for growth work on the basis of a negotiated FFP, when it is in the best interest of the Government. If a FFP contract is awarded, and during the performance period a repair within scope is identified but the KO and Contractor are unable to agree on a fixed price for the repair work, then a bilateral modification may be incorporated into the contract using a Time and Materials
(T&M) priced contract modification utilizing the awarded composite labor rate and General and
Administrative (G&A) rate for specific repair items of this nature. In this situation, FAR 52.212-4, Alternate I, will apply to T&M priced work items.
4.7.1 The Contractor shall furnish a price breakdown directly to the KO, itemized as required by the KO, of any proposal submitted for a contract modification. Unless otherwise directed, the breakdown shall be submitted on an SFLC 002 proposal form provided at the Arrival Conference permitting an analysis of all materials, labor, equipment, subcontract, overhead costs, and profit covering all work involved in the change/modification whether such work was deleted, added or changed. Any amount claimed for subcontracts shall be supported by a separate, similar price breakdown. If the proposal includes a request for a time extension, justification shall be furnished with the proposal. Growth work shall be authorized on a CR. (Deliverable)
4.7.2 The Contractor is required to have and/or furnish all tools and equipment incidental to each bench trade. Supplies such as wiping rags, hacksaw blades, sandpaper, welding wire, helium, and similar supplies, are also to be furnished by the Contractor. Other materials are to be charged at direct material cost and applicable material overhead rates currently in effect and as agreed to by the KO. Material
Overhead Rates shall include only costs clearly excluded from the composite labor rate and may include all appropriate indirect costs allocated to direct materials in accordance with the contractor’s usual accounting procedures consistent with Part 31. Material shall be best commercial quality available except where a precise specification is indicated in which case the specification shall apply, e.g., MIL-
SPEC.
4.8 Composite Labor Rate
The composite labor rate offered shall be the sole labor hour rate used to price the Prime Contractor's direct labor hours for contract changes, e.g. growth work. The Contractor shall not receive any compensation in addition to this rate for the Prime Contractor's direct labor associated with such changes under this contract.
(a) The composite labor hour rate shall represent total compensation for the following:
(1) direct labor wages and salaries;
(2) all employee benefits including, but not limited to, paid leave, supplemental pay, insurance, retirement, savings, and legally required benefits;
87’ DD
(3) other direct costs associated with transit time, delay, disruption, expendable supplies, and equipment;
(4) all indirect costs such as overhead and general and administrative expense;
(5) any port or association fees, rents, or other levies;
(6) profit (fee);
(7) all consumables;
(8) all direct and indirect costs and profit associated with the following support functions:
Supervision and
Management
Planning and Estimating Material Handling
Housekeeping Engineering Transportation/Drivers
Quality Assurance Contract Administration Security Guard
Testing Firewatch Worker Transit Time
(b) The composite labor hour rate will be applied to production labor hours only. Production labor hours include only those hours necessary and reasonable to perform direct production functions and do not include the hours expended on the support functions listed above. This exclusion of support function hours applies whether such support functions are normally charged directly or indirectly by the
Contractor's accounting system. These support functions are to be priced into the composite labor rate quoted and shall not be separately compensated.
4.9 Discoveries and Changes to the Contract
Change Requests (CR) provide for a flexible structure for the expeditious and prompt response to identify and define the requirement, provide assessment on most cost- and schedule-effective option to the KO and COR so that an informed decision can be made by the Government to authorize the
Contractor to proceed or to decline the requirement and pursue another course of action outside the scope of this contract. The key to success for managing CRs is frequent communication between the
Contractor, COR, and KO to collaboratively determine the best solution to promptly resolve the CR.
4.9.1 CRs shall be transmitted electronically by using email. In order to determine price reasonableness, all CRs that list subcontracting or material must have a written proposal from the subcontractor or the company providing the material with complete, detailed information (listing number of hours/price per hour; each part/component & associated cost; and an estimated shipping cost).
4.9.2 If the supplies and materials are not readily available from the shipyard or the Government, the
Government may require the Contractor to provide, as CFM, the supplies and materials that meet the minimum specifications included in each work item from local suppliers or other qualifying countries.
The Contractor shall be responsible for maintaining documentation to ensure all spare and repair parts purchased meet all technical requirements.
4.9.3 Modification to Contract. The KO will issue a single modification to include all authorized CRs.
4.9.4 CRs shall be processed in the following order:
(a) Condition Found Report (CFR)- Generated by the Contractor and provided to COR
(b) Condition Found Report Reply (CFRR)- Generated by the COR and provided to Contractor
87’ DD
(c) Change Requests (CR) and Independent Government Cost Estimates (IGCE) are generated by the COR and forwarded to KO for approval.
(d) COR provides copy of CR to the Contractor for review and quote.
(e) Contractor’s Proposal- Provided to the KO.
(f) Negotiations- If needed, take place to establish pricing
(g) Approved CR- Forwarded to Contractor and COR by the KO. This shall be the Contractors authorization to proceed with the work.
4.10 Condition Found Report (CFR)
All readings and inspections shall be taken within twenty-four (24) hours after the machinery or system is opened. All reports of reading and inspections required by the specifications shall be submitted to the
COR in writing using a contractor provided CFR form, within twenty-four (24) hours after the readings or inspections are made. Promptness in taking and reporting readings is particularly important for underbody work items such as shaft bearing or rudder bearing clearances. Often during the progress of a work item, conditions are discovered by the Contractor which is considered abnormal for reasons of safety, expected reliability, health, or habitability. These conditions must be brought to the attention of the Government using a CFR. Details provided by the Contractor in a CFR are important because the
CFR may result in a contract change. (Deliverable)
4.10.1 The Contractor should include in the CFR the following details as a minimum:

The Contractor shall perform in accordance with FAR clause 52.245-1 Government Property, by means of properly identifying, tracking and controlling property within its possession. This includes: a) GFP to the Contractor in conjunction with specific property identified by CLIN(s) where such property and their respective values are listed in the specification, and b) property that is pre-existing in a location that during the course of performance will be replaced or renewed.
4.11.1 The Contractor shall complete the report provided herein, entitled, “Government Property
Report.” This report is intended as a “living document” whereby relevant fields shall be filled in, maintained and kept current at all times. All property described above shall be reported on the report.

The Contractor shall not take receipt of property that is not listed in the specification, has not been previously identified as becoming part of the contract (via contract modification) or which otherwise cannot be identified. Such irregularities shall be immediately reported to the COR. (Deliverable)
