STATEMENT OF WORK
ORGANIC CHEMICALS
1. BACKGROUND:
The Mass Spectrometry Data Center (MSDC) at the National Institute of Standards and Technology (NIST), Material Measurement Laboratory (MML), Biomolecular Measurement Division (BMD) is responsible for the development of the NIST/National Institutes of Health (NIH)/Environmental Protection Agency (EPA) Mass Spectral Library and Tandem Mass Spectral Library. To carry out this responsibility, the MSDC has a requirement for a variety of chemicals. These chemicals are organic compounds of varying types and do not belong to a specific class.
2. ATTACHMENTS:
Attachment 2 – Chemical List, identified by molecular weight and structure/identifier (InChIKey, InChI, SMILES, CNC_ID, Structure_ID).
3. SCOPE:
The Contractor shall deliver chemicals listed in Attachment 2. Safety Data Sheets (SDS)/Material Safety Data Sheets (MSDSs) shall be provided for each chemical delivered. Either SDS or MSDS is acceptable if it provides the necessary information as required by OSHA (https://www.osha.gov/Publications/OSHA3514.html).
4. REQUIREMENTS:
4.1. The contractor shall deliver the chemicals set forth in Attachment 2 (Chemical List) in quantities not less than 1 mg. Larger quantities may be provided if sufficiently small quantities are not available, but not more than to 1 g. Split shipments of chemicals are acceptable so long as the total number of shipments does not exceed ten (10) per Contract Line Item.
4.2. Packing and delivery shall be divided into two groups (Both, Tandem Only) for different usages. The groups are separate sheets in the Chemical List spreadsheet (Attachment II).
4.3. The contractor shall deliver at least 75% of the chemicals listed at a minimum to be considered for award.
4.4. The Contractor shall provide an SDS or MSDS for each chemical delivered. Acceptable formats are hyperlink, or other electronic version.
4.5. The chemicals shall be of a purity of greater than, or equal to, 90%.
4.6. The Contractor shall supply and deliver each chemical in a clear, sealed glass vial. Vials will have a capacity of approximately 4 ml and shall be packaged in individual boxes containing approximately 100 vials. If the physical state of a chemical is a liquid or oil, these compounds may be supplied in packaging appropriate to prevent evaporation of the compound, not the 4 mL glass vials required for solid compounds.
5. DELIVERY AND PACKAGING:
FOB Destination (or equivalent terms, such as INCOTERMS Delivered Duties Paid) are required. Delivery shall be completed within 60 days, from receipt of an order.
FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery. All shipping costs shall be included in the total firm-fixed price.
All chemicals and SDSs/MSDSs shall be delivered within 60 days from date of award. All chemicals shall be packaged and shipped in a manner that will reduce degradation while in transport.
Chemicals and SDS/MSDS shall be delivered to the NIST campus in Gaithersburg, MD during NIST regular business hours Tuesday through Thursday; deliveries will not be accepted on Friday, Saturday, Sunday, or Monday. Contractor shall supply tracking information to the NIST Contracting Officer Representative (COR) and Technical Point of Contact (TPOC) (to be identified at the time of award) prior to shipping chemicals via email.
Electronic information shall be delivered to the NIST COR and TPOC via e-mail, hyperlink, or CD/DVD disc.
6. INSPECTION AND ACCEPTANCE:
Chemical purity has not been tested prior to award. The Government reserves the right to reject any chemical that does not meet the required purity percentage after analysis of chemicals.
NIST will conduct an analysis of chemicals to inspect the purity of the chemicals, as they are received. If chemicals are deemed to be unacceptable, the Government will notify the Contractor of the chemical(s) rejected. The Contractor shall replace the chemical, at no additional cost to the Government.
7. PAYMENT SCHEDULE:
Advance Payment is not authorized. Payment will be made upon receipt of a proper invoice from the Contractor, and upon receipt and acceptance, by the Government, of chemicals quoted by the Contractor. Partial payments shall be authorized in accordance with the following terms:
· The total number of invoices submitted shall not exceed two (2) invoices per month;
· Chemicals being invoiced have been accepted by NIST.
Should a chemical become unavailable between the time of award and the time of shipment, the Contractor shall notify the NIST TPOC and the Contracting Officer in writing, not later than 3 business days after learning that the chemical has become unavailable. The Contracting Officer shall modify the contract accordingly and adjust the price.
